ESD claim stuck in adjudication for answering 'not available' during vacation - what's the right way to handle?

I just stepped in my own unemployment trap and I'm freaking out a bit. I was laid off on 2/28/25 and immediately went on a quick vacation 3/1-3/2 that was planned before I knew I'd lose my job. When I got back, I reopened my claim from last August and filed for that first week after layoff. I honestly answered that I wasn't available for work for 2 days and didn't do job searches while on vacation (I was literally on a plane/out of the country). Now that week is stuck in adjudication! I uploaded my flight tickets as proof of why I wasn't available, but nothing's happening. I did file correctly for this past week with all my job searches complete. Two questions: 1) How long will this adjudication take? My bills aren't waiting around... 2) Should I have just said I WAS available even though I was on vacation? I was trying to be honest but now I'm worried I screwed myself over for that week. Anyone dealt with something similar? I really need that money and I'm kicking myself for being so straightforward.

You did the right thing by being honest. If you had said you were available when you weren't, that could potentially be considered fraud if they found out later. The ESD system flags any week where you answer "no" to availability as requiring adjudication - it's automatic. For the timeline, adjudication is currently taking about 3-4 weeks in most cases. Actually, the adjudication is only for that specific week where you answered "no" to availability. Your other weeks should process normally as long as you answer "yes" to being available and complete your job searches. I went through almost the exact same thing last year when I took a weekend trip right after getting laid off. My first week went to adjudication, but my subsequent claims were paid on schedule. They eventually approved my first week but prorated it (reduced the amount slightly because of the days I wasn't available).

NEVER LIE on yr claim!!!! ESD is super strict about this stuff and they can make you pay back EVERYTHING if they catch you being dishonest. three of my coworkers got hit with overpayment notices for thousands last year and one even had to go to a hearing cus they said he committed fraud (he didnt get charged but still!

^^^^ This!!!! Especially now that they've implementing that new identity verification system. They're matching data with employers and cross-checking everything. My cousin's neighbor tried to game the system and ended up with a 6-month disqualification AND had to pay everything back. Not worth it!

I had something simmilar happen to me back in January. I was in the hospital for 3 days and answered that I wasn't able/available. My claim got stuck for 5 weeks!!! I tried calling ESD every single day and could never get through. Always busy signals or disconnects after waiting on hold forever. The whole system is designed to trip people up! They WANT you to make mistakes so they can delay paying you. I've been on UI three times in the past decade and every single time they find some reason to put things in adjudication. My neighbor had the same thing happen - he took a pre-planned trip right after layoff and ended up waiting 7 weeks for resolution!!! And don't get me started on their phone system. Total joke. ESD knows exactly what they're doing - making it as difficult as possible to actually get benefits we've paid into the system for. It's all part of the same game to save money on their end.

That's not entirely fair. The system has rules they have to follow by law, and availability for work is a core requirement for unemployment benefits. The delays are frustrating for sure, but they're not deliberately trying to deny benefits to eligible people. That's a separate issue. ESD implemented new identity verification requirements this year. Everyone has to go through it, but it's especially common for people reopening claims. You'll need to verify your identity before they'll release any payments, even for weeks that aren't in adjudication. You should prioritize completing this ASAP - it's a separate process from your vacation adjudication issue.

Not yet! It's been 2.5 weeks now and still shows as adjudication. I did get through the ID verification by calling early in the morning (like 7:55am right before they opened). My second and third weeks are still pending payment because of the ID verification, but at least those aren't in adjudication. The ESD agent said they're working through a backlog and my case should be reviewed "soon" but couldn't give me a definite timeline. Super stressful.

Quick update to my earlier comment - I checked with a colleague who works with unemployment cases, and the current adjudication time for straightforward cases like yours (with documentation already submitted) is running closer to 2-3 weeks rather than the 3-4 I mentioned earlier. So you might hear back sooner. Regarding the identity verification issue - that's completely separate but equally important to resolve. Unfortunately, having two issues at once is fairly common with ESD. The good news is that once both are resolved, any back payments you're eligible for will be processed at once.

Thank you for checking! That gives me a little hope. I did manage to resolve the ID verification by calling repeatedly yesterday morning. The agent said my account was noted as verified now, but it might take 48 hours to update in their system. Fingers crossed this all gets sorted soon - I've got rent due next week.

i had this happen back in 2023 and heres a tip: if u call right when they open at 8am and keep hitting redial youll eventually get thru. took me 26 tries one morning but i finally got a person! they can sometimes push ur adjudication thru faster if u explain ur situation. good luck!!

This doesn't work anymore. I tried calling at 8am EVERY DAY for two weeks straight in February. They've changed their system again. Now it just tells you they're experiencing high call volume and hangs up automatically. Doesn't even put you in a queue anymore. So frustrating!
