ESD claim ending soon - Questions about refiling, waiting week, and 401k impact
I'm freaking out about my unemployment claim ending in two weeks and need some advice on the whole refiling process. After working at my job for 3 years, I was laid off in December and started receiving benefits in January 2025 after adjudication. Now my benefit year is almost up, and I'm still struggling to find work despite applying everywhere (currently on 57 applications and counting). I'm really worried about the gap between claims and have SO many questions: 1. Will I have to serve another waiting week when I refile? 2. Do I have to go through the whole adjudication process again, or is it faster the second time? 3. I've heard the new claim processing can take 4-6 weeks - is there any way to speed this up? 4. What timeframe will they use to calculate my 680 hours for eligibility? 5. I have about $8,500 in my 401k and I'm considering withdrawing some during this transition - will this affect my eligibility? I'm trying to plan for worst-case scenario because last time I almost got evicted while waiting for my claim to process. I need to figure out how to cover bills during any gap period. Any advice would be SO appreciated!

I went through a similar situation last year. Yes, you'll need to serve another waiting week when you refile - this is required for each new benefit year. The base year for calculating your 680 hours will be the first 4 of the last 5 completed calendar quarters before you apply. As for adjudication, it depends. If your circumstances haven't changed much, it might go faster, but they do need to verify your eligibility again. The 4-6 week processing estimate is unfortunately accurate in many cases. Regarding your 401k - it won't affect your eligibility as long as you report it correctly. Any withdrawal is considered income for the week you receive it, so it may reduce or eliminate your benefit for that specific week only, depending on the amount.

•Thank you for the information! That's really helpful. So if I'm understanding right, since I've been on unemployment for most of this year, I probably won't have enough hours in my base year for a new claim? That's terrifying. For the 401k, does that mean I should time the withdrawal strategically during my waiting week since I won't get benefits that week anyway?

Heya, just wanted to say I feel your pain about the adjudication wait times! Took them 7 WEEKS to process my claim earlier this year and I was calling everyday with no luck getting through. I almost lost my apartment too. The system is completely broken tbh.

•I had the same experience trying to get through to ESD when my claim was stuck in processing. After wasting days trying to call, I finally used Claimyr (claimyr.com) to get connected to an actual human at ESD. Saved me hours of redial hell and the agent was able to expedite my claim review. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. Worth checking out if you end up in adjudication limbo again.

•Really? Only 10 days? Did you have a simple claim situation or something? I'm genuinely curious because everything I've read says it takes weeks. Maybe things have improved since I last filed?

There are a few important details you need to understand about refiling: 1. Yes, every new benefit year requires a waiting week where no benefits are paid. 2. For your base year calculation, ESD will use the first 4 of the last 5 completed calendar quarters before your application date. This is critical - if you haven't worked enough during that period, you won't qualify for a new claim. 3. For the 401k withdrawal - this counts as income in the week received and must be reported. Strategic timing during your waiting week is smart planning. 4. If you don't qualify for a regular claim based on hours, ask about an "alternate base year" calculation, which uses more recent quarters. 5. Processing times vary widely. While adjudication is sometimes faster for refilers, there's no guarantee. Budget for at least 3-4 weeks without payment to be safe. I recommend filing your new claim as soon as eligible (usually the Monday after your benefit year ends) to minimize gaps.

Doesnt the 401k withdrawal also have a 10% penalty if your under retirement age? something to consider

•Yes, you're right about the penalty. I was hoping to avoid touching my 401k at all, but might not have a choice if there's a long gap between benefits. I'm trying to weigh the tax hit vs. potentially missing rent payments.

ESD is THE WORST with communication!!! When my claim was ending last year, I called to ask these exact questions and got 3 different answers from 3 different people. One even told me I didn't need to refile at all which was COMPLETELY WRONG and caused me to miss benefits. I'd take any advice you get here with a grain of salt - even from ESD themselves sometimes!

•This is unfortunately true. The ESD phone agents sometimes provide inconsistent information. For the most reliable answers, I recommend checking the official ESD handbook on their website and getting any critical information in writing whenever possible.

Thanks everyone for the advice! I'm going to file my new claim the Monday after my benefit year ends and plan for at least a month without benefits just to be safe. I'll probably take a small 401k withdrawal during the waiting week to cover essential bills. I'm still confused about whether I'll qualify with enough hours, but I guess I'll find out when I apply. I'll keep job hunting like crazy in the meantime and hope for the best!

•Good plan. One more tip: While waiting for your new claim to process, continue filing your weekly claims even if they show as "pending" or "disqualified" in the system. If your new claim is approved, ESD can pay those weeks retroactively, but only if you filed the weekly claims on time.
