Denied standby status for requesting 8 weeks - can I reapply for just 4 weeks with ESD?

So I messed up my standby request with ESD last month. My employer told me I'd be out for about 8 weeks due to seasonal slowdown (construction industry), so I requested standby for that full period. Got denied because apparently standby is now limited to 4 weeks max. Has anyone successfully reapplied for standby after being denied? Can I just submit another request but only ask for 4 weeks this time? The ESD website is confusing me and I've called like 15 times with no luck getting through. I really don't want to do all those job search activities when I KNOW I'm going back to my job in a month. Any advice appreciated!

ya i had the same thing happen last yr. u CAN reapply but u need ur employer to submit the new request. they changed the rules after covid, its super annoying. my boss had to fill out some form saying i was only going to be out for 4 weeks instead of the 12 we originally thought. got approved the 2nd time no problem

Thanks! Did you have to wait for the first denial to fully process before reapplying? Or did you do it right away?

Yes, you can definitely reapply for standby after a denial. The key points to remember: 1. Maximum standby period is 4 weeks (reduced from 8 weeks during the pandemic) 2. Your employer must verify you have a definite return-to-work date 3. You must be "able and available" to return to work for your employer 4. File the standby request when you submit your initial claim or during your first weekly claim If you've already been denied, submit your new standby request through your eServices account under "More Services" and then "Apply for Standby." Make sure your employer knows they'll need to verify your return date.

This is super helpful, thank you. I'll check eServices for that option. My employer is definitely willing to confirm the return date.

I went through this exact situation in January. Construction slowdown too! After my initial 6-week standby request was denied, I immediately submitted a new request for exactly 4 weeks through eServices. Got approved in 3 days. Make sure your employer is ready to verify when ESD contacts them - that's what caused delays for me the first time around. Good luck!

That's encouraging! I'll warn my boss to expect that verification request. Did you have to do job searches while waiting for the new standby approval?

THE ESD SYSTEM IS COMPLETE GARBAGE!!!! I tried standby TWICE and got denied BOTH times even though I was only asking for 3 weeks!!!! They claimed my "employer didn't verify" but my boss SWEARS he responded to them. Now they want me to pay back $2,780 because I didn't do job searches while waiting for standby approval that never came. TOTAL SCAM!!!

I tried calling ESD for days with no luck until someone told me about Claimyr. It's a service that helps you get through to an ESD agent without waiting on hold forever. I was skeptical but used it last week and got connected to ESD in like 15 minutes (after trying for literally days on my own). The agent explained the whole standby reapplication process to me. You can check it out at claimyr.com - they have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3

Oh wow, I've never heard of this. I'm definitely going to look into it because I've been trying to reach someone for days now.

just to add, make sure ur doing job searches while waiting for standby approval!! i didnt and got disquakified for a week. even if ur 100% getting standby you still have to do the 3 activities per week until its officially approved on your claim.

This! I made the same mistake. If your standby isn't approved yet, you still have to do job search activities. I lost a week of benefits because I assumed I'd be approved.

One more thing I should mention - when you reapply for standby, you'll need to provide a specific return-to-work date. Don't just say "4 weeks" or "a month" - ESD wants the exact date. Also, keep checking your eServices account daily as sometimes they'll send questions through the message center that require quick responses.

That's really good to know. I'll talk to my boss tomorrow about setting an exact date. The specific 4-week timeframe actually works better for our project schedule anyway, so hopefully this works out.

I've been through this exact process twice in the past year due to seasonal layoffs in my industry. A few key things that helped me get approved on the second attempt: 1. Make sure your employer has the ESD employer portal set up and knows exactly what to expect when ESD contacts them for verification 2. Submit your new 4-week standby request as soon as possible after the denial - don't wait 3. Be very specific with dates (not "around 4 weeks" but exact calendar dates) 4. Keep doing your job search activities until you see "STANDBY APPROVED" actually show up on your weekly claim The system is frustrating but it does work if you follow their exact requirements. Also, if you haven't already, create a paper trail by messaging through eServices about your reapplication - sometimes having written documentation helps if there are any issues later. Hope this helps and good luck!
