Can you only get unemployment if you are fired - Washington ESD eligibility question
I'm really confused about Washington ESD unemployment eligibility. My hours got cut drastically at my retail job and I can barely afford rent anymore. A coworker told me you can only get unemployment if you're actually fired, not if you quit or have reduced hours. Is this true? I'm working like 8 hours a week now when I used to work 35-40. Can I apply for unemployment benefits through Washington ESD or am I stuck because I technically still have a job?

No that's not correct at all! You can definitely qualify for unemployment in Washington state even if you weren't fired. Reduced hours is a common reason people get approved for UI benefits. You might be eligible for partial unemployment if your hours were cut significantly.

•Really? That's such a relief! Do I need to report the few hours I'm still working when I file my weekly claims?

•Yes you absolutely have to report any hours worked and wages earned on your weekly claims. Washington ESD will calculate your partial benefit amount based on what you earn.

Your coworker gave you bad information. Washington ESD has several qualifying reasons for unemployment benefits: being laid off, fired for non-misconduct reasons, having hours reduced, quitting for good cause, and some other situations. Reduced hours definitely counts as long as the reduction wasn't your choice.

•what counts as 'good cause' for quitting? asking for a friend lol

•Good cause includes things like unsafe working conditions, harassment, significant changes to your job duties or schedule, or health issues that make continuing work impossible. Washington ESD reviews each case individually.

•The hours reduction definitely wasn't my choice - they just cut everyone's shifts because business is slow.

I had the same situation last year and got approved for partial unemployment through Washington ESD. The key thing is you have to be available for full-time work and actively looking for a better job. They'll want to see your job search log.

•How many jobs do you have to apply for each week? I've heard different numbers.

Aileen Rodriguez
•It's 3 job search activities per week minimum. Can be applications, networking, job fairs, etc. Just keep good records in case they audit your claim.

I've been trying to call Washington ESD for weeks about my reduced hours situation but can never get through. The phone lines are always busy and I keep getting disconnected. It's so frustrating when you need help figuring out eligibility.

•I had the same problem until I found this service called Claimyr at claimyr.com. They help you get through to Washington ESD agents automatically. There's even a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Game changer for me!

You can also quit and still get unemployment in some cases. I quit my last job because my boss was making me work in unsafe conditions and Washington ESD approved my claim. They call it 'good cause' quitting.

•How do you prove the unsafe conditions? Did you have to provide documentation?

•I had photos and emails to my supervisor about the safety issues. Washington ESD wanted to see that I tried to resolve it with my employer first before quitting.

The system is so confusing! I got laid off completely but my friend who just had hours cut gets the same benefits basically. Why don't they explain this stuff better?

•The benefit amounts are actually calculated differently. Full unemployment vs partial unemployment have different formulas based on your earnings history and current wages.

•Oh okay that makes more sense then. Still wish Washington ESD was clearer about all the rules upfront.

i thought you had to be completely out of work... this is news to me. my hours got cut too and i've been struggling

•Nope, partial unemployment is definitely a thing in Washington. As long as your hours or wages were reduced through no fault of your own, you should apply. The worst they can do is say no.

•thanks, gonna apply today then. been putting it off thinking i didn't qualify

I was fired from my last job for attendance issues (my fault) and still got denied for unemployment. So it's not just about being fired - they look at WHY you were fired too. Misconduct can disqualify you.

•Exactly right. Being fired for misconduct, like repeated tardiness, policy violations, or insubordination typically disqualifies you from benefits. But being laid off or fired for performance issues usually doesn't.

•Yeah I learned that the hard way. Had to wait 6 months before I could reapply.

For anyone reading this - make sure you apply as soon as your hours get cut! I waited 3 weeks thinking I might get more hours back and lost out on those weeks of benefits. Washington ESD doesn't pay retroactively.

•Oh no, I should have applied last month when this started happening. Can I still get benefits going forward though?

Haley Stokes
•Yes, you can still apply now! Benefits start from when you file your claim, not when the problem started. Just don't wait any longer.

The whole system needs an overhaul tbh. Why is it so hard to figure out basic eligibility? Other states make this way clearer on their websites.

•I mean the info is there on the Washington ESD website if you dig for it. But yeah it could be presented better for sure.

•Fair point. I just get frustrated when people are struggling and can't get straight answers about their own benefits.

Quick question - if I'm getting partial unemployment for reduced hours, do I still have to do the job search requirements? Or can I just focus on getting more hours at my current job?

Lourdes Fox
•You still need to meet the job search requirements unless you're on approved standby with your current employer. Most people with reduced hours still have to look for other work opportunities.

•Got it, thanks. Guess I better start applying to other places too then.

I used to work in HR and we had several employees who got partial unemployment when we had to cut everyone's hours during slow periods. It's totally normal and they were all approved by Washington ESD.

•That's reassuring to hear from someone who's seen it from the employer side. Makes me feel less worried about applying.

•Yeah don't worry about it. As long as the hour reduction wasn't disciplinary, you should be fine. We even had to provide documentation to Washington ESD confirming the cuts were business-related.

PSA: you can also get unemployment if you're a contractor and your contract ends, or if you're seasonal and the season ends. Lots of ways to qualify beyond just being fired.

•Wait really? I do freelance work and thought contractors couldn't get unemployment benefits.

Marina Hendrix
•Depends on how you were classified and if you paid into the system. Some contractors are eligible, some aren't. Worth checking with Washington ESD if you're unsure.

Just want to add that if you're denied for any reason, you can appeal the decision. I got initially denied for a partial claim but won on appeal when I provided more documentation about my hour reduction.

Landon Morgan
•How long did the appeal process take? In case I need to go that route.
0 coins
Alana Willis
•About 6 weeks total, but I kept filing weekly claims during the appeal so I got back pay when I won. Don't stop filing even if you're appealing.

This thread has been super helpful! I'm in the exact same boat with reduced hours and was told the same wrong info. Definitely applying today.

•Good luck! The application process is pretty straightforward online. Just have your employment history and pay stubs ready.

One more tip - if you need to talk to someone at Washington ESD about your specific situation, try using Claimyr. I mentioned it earlier but it really does help cut through the phone queue nightmare. Made the whole process way less stressful for me.

•I'm skeptical of services like that but honestly the phone situation is so bad I might try it.

•I was skeptical too but it worked exactly like they showed in their demo video. Worth it when you need actual answers from a real person.

Bottom line - don't let anyone tell you that you can only get unemployment if you're fired. That's completely wrong and you could be missing out on benefits you deserve. Hours reduction definitely qualifies in most cases.

•Thank you everyone for all the help! I'm definitely applying today. Feel so much better knowing I might actually qualify.

•You're welcome! Hope everything works out for you. The worst they can do is say no, but based on what you described you should be approved.
