Can you collect unemployment if you have a severance package - Washington ESD rules?
My company just laid me off after 8 years and they're giving me a severance package worth about 12 weeks of pay. I'm not sure if this affects my ability to file for unemployment benefits with Washington ESD. The HR person wasn't very clear about it and just said to 'check with the state.' Does anyone know how severance payments impact UI eligibility in Washington? I really need to know before I file my claim because I don't want to mess anything up.

Severance packages don't automatically disqualify you from unemployment in Washington, but the timing and structure matter a lot. If it's a lump sum payment, it typically won't affect your weekly benefits. If it's paid out over time like regular paychecks, Washington ESD might consider it wages and delay your benefits until after the severance period ends.

•It's being paid as a lump sum, so that sounds promising. Do I need to report it when I file my initial claim?

•Yes, always report all severance payments when filing. Washington ESD will determine how it affects your claim during the adjudication process.

I went through this exact situation last year. Had a 10-week severance package and was still able to collect UI benefits immediately. The key is being honest about everything when you file your claim with Washington ESD.

•That's really reassuring to hear! Did they ask for any documentation about the severance during the application process?

•They wanted a copy of my severance agreement and termination letter. Keep all that paperwork handy when you file.

You should definitely apply right away regardless of the severance. I tried calling Washington ESD about this same question and spent hours on hold without getting through. If you're having trouble reaching them, I found this service called Claimyr (claimyr.com) that helped me get connected to an actual agent. They have a video demo showing how it works: https://youtu.be/7DieNd3C7zQ

•Never heard of Claimyr before, is it legit? Sounds too good to be true.

•I was skeptical too but it actually worked. Saved me from wasting more time on hold. Sometimes you just need to talk to a real person about these complicated situations.

•I might try that if I can't get through the normal way. The phone system is so frustrating.

WAIT - this is so confusing! I thought ANY money from your employer disqualifies you from unemployment. My friend got severance and couldn't collect benefits for months. Are the rules different now??

•Your friend's situation might have been different - maybe they had ongoing severance payments or other factors. Washington state rules distinguish between lump sum and periodic payments.

•This unemployment system is way too complicated. Why can't they just have clear answers?

The Washington ESD handbook specifically addresses this. Lump sum severance payments are generally not considered wages for unemployment purposes. However, if your severance includes continuation of regular pay periods, those would be treated as wages and could delay benefits.

•Where can I find this handbook? I want to read the exact wording before I file.

•It's on the Washington ESD website under employer resources. Look for the unemployment insurance handbook section.

•It's always better to be upfront about severance rather than risk an overpayment determination later.

Just to follow up on my earlier comment - I actually used Claimyr specifically to ask about severance and unemployment eligibility. The Washington ESD agent I spoke with was really helpful in explaining how they evaluate different types of severance packages. Worth the peace of mind if you can't get through on your own.

•How much does that service cost? I'm already stressed about money with the layoff.

•They focus on helping you get connected rather than charging high fees. Check their site for current info - claimyr.com

Update: I called Washington ESD this morning and actually got through after about 45 minutes on hold! The agent confirmed that my lump sum severance won't delay my unemployment benefits. She said to report it when filing but it shouldn't affect my weekly benefit amount or eligibility.

•Awesome! That matches exactly what happened with my claim. Glad you got a straight answer.

•45 minutes isn't too bad actually. Maybe I should try calling about my situation too.

My brother went through this exact thing when Boeing had layoffs. Severance didn't impact his UI at all, but he had to provide documentation during the adjudication process.

•Good to know about the documentation requirement. I'll make sure to have everything ready when I file.

For anyone reading this later: Washington ESD treats severance differently than vacation payout or bonuses. Vacation pay is considered wages and can delay benefits, but true severance (compensation for job loss) typically doesn't affect UI eligibility timing.

•Wait, vacation payout affects benefits? I didn't know that. I'm getting both severance and vacation payout.

Malik Thompson
•Yes, accrued vacation is usually treated as wages. You'll want to clarify this with Washington ESD when you file your claim.

The unemployment office is IMPOSSIBLE to reach by phone. I've been trying for weeks about my own severance question. Might have to try that Claimyr thing someone mentioned earlier.

•That's exactly why I ended up using it. The regular phone system is so overwhelmed, especially with all the recent layoffs in tech.

•Yeah, I work in tech too and know a bunch of people dealing with this right now. Thanks for the tip.

Just want to echo what others said - be completely honest about your severance when filing. Washington ESD has access to wage records and will find out anyway. Better to report it upfront than deal with complications later.

•Definitely planning to be totally transparent. Not worth the risk of messing up my claim over it.

I work in HR and deal with this question all the time. Washington state is actually more generous than some other states when it comes to severance and unemployment. The key is understanding the difference between severance compensation and continuing wages.

NeonNinja
•Could you explain that difference a bit more? I'm not sure I understand the distinction.
0 coins
Diego Vargas
•Severance is compensation for job loss - usually a lump sum. Continuing wages means you're still technically employed and receiving regular paychecks for a period after termination.

Filed my claim yesterday with severance info included. The online application was pretty straightforward about it - just asked for the amount and payment date. No red flags so far.

•That's encouraging! I'm planning to file this weekend. Did you have to upload any documents right away?

•Not during the initial filing, but I have my severance agreement ready in case they request it during adjudication.

This thread has been super helpful! I was worried my severance would disqualify me completely. Sounds like as long as I'm honest about it, I should be fine.

•Exactly right. Washington ESD just wants accurate information to make the correct determination for your specific situation.

One more thing to consider - if you have a non-compete clause in your severance agreement, that could potentially affect your job search requirements for unemployment. Worth mentioning to Washington ESD if applicable.

•I don't have a non-compete, but that's a really good point for others to keep in mind.

Final thought for anyone still worried about reaching Washington ESD with questions - I ended up using Claimyr three different times during my unemployment claim process. Really helpful for getting quick answers when the phone lines are jammed. Worth checking out their demo video if you're on the fence: https://youtu.be/7DieNd3C7zQ
