Washington ESD unemployment with severance pay - can you get unemployment if you get severance?
Just got laid off from my job after 6 years and they're giving me a severance package worth about 8 weeks of pay. I'm planning to file for unemployment benefits but I'm not sure if the severance will affect my eligibility or how much I can get from Washington ESD. Does anyone know if you can collect unemployment while receiving severance pay? I really need to understand this before I file my claim.

Yes, you can usually get unemployment even with severance, but it depends on how Washington ESD views your specific severance arrangement. The key thing is whether it's considered wages for services or just a lump sum payment. You should definitely file your claim right away since there's usually a waiting period anyway.

•Thanks! Should I report the severance when I file my initial claim or wait until my weekly claims?

•Report it on your initial application and then on your weekly claims. Washington ESD needs to know about all income sources to determine your benefit amount correctly.

I went through this exact situation last year. Washington ESD told me that severance pay usually doesn't disqualify you from unemployment benefits, but it might affect the timing of when your benefits start. In my case, they calculated it as if I was still employed during the severance period, so my benefits were delayed by about 6 weeks.

•That's really helpful to know. Did you have to provide documentation about your severance package to Washington ESD?

•Yes, I had to submit a copy of my severance agreement and a letter from my employer explaining the terms. Make sure you keep all that paperwork handy.

This is so confusing! I'm in a similar boat and can't get through to anyone at Washington ESD to ask about my severance situation. Been trying to call for days but either get busy signals or get disconnected after waiting forever. Has anyone found a way to actually talk to someone there?

•I had the same problem trying to reach Washington ESD about my severance questions. Someone on another forum mentioned this service called Claimyr (claimyr.com) that helps you get through to ESD agents. I was skeptical at first but tried it last week and actually got connected to someone who could explain how my severance would affect my benefits. They have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

Wait, I thought severance automatically disqualifies you from unemployment? That's what my former HR department told me when I got laid off. Now I'm wondering if I should have filed a claim months ago...

•No, that's a common misconception. Severance pay doesn't automatically disqualify you from unemployment benefits in Washington. Your HR department might not have had complete information about how Washington ESD handles these situations.

•Ugh, I probably missed out on months of benefits because of bad advice. Is it too late to file now?

•You can backdate a claim in some circumstances, but there are time limits. You should file as soon as possible and explain the situation to Washington ESD.

The whole severance thing is so complicated. My company is offering me either a lump sum or payments over 12 weeks. Which option would be better for unemployment benefits?

Liam Duke
•That's actually a really good question that depends on how Washington ESD treats each type of payment. Generally, lump sum payments might be treated differently than ongoing wages, but you'd need to check with an agent to be sure.

•This is exactly why I need to talk to someone at Washington ESD, but the phone situation is impossible.

I've been dealing with this for weeks now. Filed my claim, reported my severance, and now my claim is stuck in adjudication. No idea what's happening or how long this will take.

•Adjudication for severance issues can take a while because they need to review the specific terms of your agreement. Usually takes 2-4 weeks in my experience.

•It's been 5 weeks already. I'm starting to panic about my bills.

•This is exactly the kind of situation where Claimyr helped me. I was able to get through to an adjudicator who could actually check on my case status and explain what documentation they still needed.

Does anyone know if the amount of severance matters? I'm getting a pretty substantial package - like 4 months of salary. Will that affect my benefit amount or just the timing?

Liam Duke
•The amount will mainly affect timing rather than your weekly benefit amount. Washington ESD calculates your weekly benefit based on your previous wages, not your severance. But a larger severance might delay your benefits longer.

•That makes sense. I guess I need to plan my finances around a longer delay then.

Just want to add that you should also check if your severance includes continuation of health benefits. That might affect other aspects of your unemployment claim or eligibility for state programs.

•Good point! My severance does include COBRA coverage. Should I mention that to Washington ESD?

Rosie Harper
•It wouldn't hurt to mention it, though health benefits usually don't affect unemployment eligibility directly.

This thread is super helpful! I was worried my severance would completely block me from getting unemployment. Sounds like I should definitely file my claim even though I'm getting severance pay.

•Absolutely file! The worst thing you can do is not file at all. Even if there's a delay, you'll at least have your claim in the system.

•Thanks for the encouragement. Going to file tomorrow morning.

I'm a former Washington ESD employee and can confirm that severance pay does NOT disqualify you from unemployment benefits. The main issue is timing - we treat severance as wages for the period it covers, which can delay when your benefits start. Always report it honestly on your application.

•I understand the frustration with phone wait times. The system has been overwhelmed for years now.

Question - if my severance is being paid out over several months instead of a lump sum, do I report it every week on my weekly claims?

Demi Hall
•Yes, you'll need to report any severance payments on your weekly claims, whether it's lump sum or installments. Be accurate about the amounts and dates.

ugh this is all so complicated!! why cant they just make it simple - if you lose your job you get unemployment end of story. all these rules about severance and timing just make everything harder when youre already stressed about losing work

•I totally understand the frustration. The system is complex because they're trying to prevent abuse while still helping people who genuinely need it. But you're right that it can be overwhelming when you're already dealing with job loss.

For what it's worth, I got both severance and unemployment benefits. There was about a 6-week delay before my benefits started, but once they did, I got the full amount I was eligible for. The severance helped bridge that gap.

Dana Doyle
•That's reassuring to hear. How long did the whole process take from filing to getting your first benefit payment?

Philip Cowan
•About 8 weeks total - 2 weeks for initial processing plus the 6-week severance delay. But every situation is different depending on your specific severance terms.

Does anyone know if unused vacation pay affects this too? My company is paying out my accrued vacation time along with severance.

Demi Hall
•Vacation pay is typically treated the same as severance - it can delay benefits but doesn't disqualify you. Report both on your application.

•Thank you, that helps a lot!

I'm seeing people mention Claimyr for getting through to Washington ESD. Has anyone else used this? I'm curious if it's worth it for severance questions.

•I tried it last month when I had questions about how my severance would affect my benefits. It actually worked - got connected to an agent who could pull up my claim and explain everything. Way better than the endless busy signals I was getting before.

Just to close the loop on my situation - I filed my claim reporting my severance and got approved! My benefits start in 8 weeks once my severance period ends. Super grateful for all the advice in this thread.

One more tip for everyone - make sure you keep detailed records of your severance agreement and any communications with your former employer. Washington ESD might ask for documentation during the review process.

This has been incredibly helpful. I was so worried about messing up my unemployment eligibility because of my severance. Now I feel confident about filing my claim and know what to expect with the timing.

I'm in a very similar situation - just got laid off and have a severance package. Reading through all these responses has been incredibly reassuring! I was panicking that I'd have to choose between taking the severance or filing for unemployment, but it sounds like I can do both. The timing delay makes sense since they're essentially treating the severance period as if I'm still employed. Going to gather all my paperwork and file my claim this week. Thanks everyone for sharing your experiences - it really helps to hear from people who've actually been through this process with Washington ESD!
