Can I get current unemployment while ESD is reviewing backdated claims?
I messed up and didn't file my weekly claims for about a month (March to mid-April) because I thought I wouldn't qualify after some temp work. Turns out I still could have claimed partial benefits for those weeks. I submitted the late claims through eServices about 10 days ago and now my account shows they're all under 'adjudication' status. My question is: Can I still claim and receive benefits for current weeks while they're reviewing my backdated claims? Or will they freeze my current payments until they finish the adjudication process for the older weeks? I really need the current payments to make rent next month and I'm worried this might hold everything up. Anyone dealt with this before?

Yes, you can still claim and receive benefits for current weeks while your backdated claims are in adjudication. The adjudication process for your late-filed weeks is separate from your current weekly claims. Just make sure you're filing your current weekly claims on time and accurately. Keep in mind that if they determine you weren't eligible for those backdated weeks, they won't pay those, but it shouldn't affect your current claims as long as you're currently eligible. The most important thing is to stay current with your weekly claims while they sort out the older ones.

Im in kinda the same boat right now! I had 3 weeks i didnt file for back in feb and when i finally did file for them they went to adjucation. My current weekly claims were still going thru fine for like 2 weeks but then suddenly EVERYTHING got put on hold. They told me when i called that they found a "eligibility issue" they had to investigate. Its been 6 weeks now and i havent been paid for ANY weeks including current ones!!! So frustrating!!!!!

I went through something similar in January. When they put past weeks into adjudication, they can sometimes discover issues that affect your overall claim. For me, they found out I had been working a few hours at a second job I hadn't reported (honest mistake!). If there aren't any issues with your eligibility in general, your current claims should process normally. But if they find something in those backdated claims that makes them question your overall eligibility, they might put everything on hold. I'd recommend calling ESD directly to ask about your specific situation. Good luck getting through though - I spent days trying to reach someone.

The answers above are correct, but I want to clarify something important: While you CAN continue to receive current benefits during adjudication of backdated claims, whether you WILL or not depends on if your adjudication is for a "blocking issue" or a "non-blocking issue." Blocking issues affect your entire claim and halt all payments until resolved. These include: - Voluntary quit situations - Work availability questions - Identity verification issues - Ability to work concerns Non-blocking issues only affect specific weeks and don't stop other payments. These include: - Late filing for specific weeks - Failure to do job searches for specific weeks - Reporting errors for specific weeks Since yours is just about late filing for specific weeks, it's likely a non-blocking issue, but ESD sometimes finds other issues during adjudication that can become blocking.

Just wanted to add that when I was in adjudication last year they made me redo my job search activities for the weeks I filed late. Make sure you have your job search logs ready! They might ask for those.

One other thing to keep in mind - if you were eligible for those backdated weeks but they deny them just because they were filed late, you have the right to appeal that decision. ESD can waive the "timely filing" requirement if you had "good cause" for filing late. Things like illness, confusion about eligibility, or technology issues can sometimes qualify as good cause. So even if they initially deny those backdated weeks, don't give up if you were actually eligible during that time!

I thought any work at all disqualified me, but I learned later that I could have claimed partial benefits for those weeks. I'll definitely appeal if they deny them for being late.
