Can I get Washington ESD unemployment if I'm pregnant?
I'm 6 months pregnant and just lost my job due to company layoffs. I'm worried Washington ESD might deny my unemployment claim because I'm pregnant. I can still work and am actively looking for jobs, but I'm concerned they'll think I'm not available for work. Has anyone dealt with this situation? What should I expect when filing my claim?

Yes, you can absolutely get unemployment while pregnant! Washington ESD can't discriminate based on pregnancy. As long as you're able and available for work, your pregnancy status doesn't matter for eligibility. Just be honest about your situation and emphasize that you're actively seeking employment.

•That's such a relief to hear! I was really worried they'd automatically deny me. Should I mention my pregnancy in my initial application or wait until they ask?

•You don't need to volunteer pregnancy information upfront, but if they ask during adjudication, just be honest. The key is proving you're able and available for suitable work.

I got unemployment when I was pregnant with my second kid. No issues at all with Washington ESD. Just make sure you're genuinely looking for work and can prove it with your job search log.

•How far along were you when you applied? I'm worried potential employers might not want to hire someone who's obviously pregnant.

•I was about 7 months when I filed. The job search requirement is separate from actually getting hired - you just need to show you're making the effort.

The main thing Washington ESD looks at is whether you're able and available for work. Pregnancy alone doesn't disqualify you, but if you have medical restrictions that limit your availability, that could be an issue. Make sure your doctor hasn't put you on bed rest or anything like that.

•My doctor says I can work normally until at least 38 weeks. Should I get that in writing in case Washington ESD asks?

•It wouldn't hurt to have documentation ready, but most of the time they won't ask unless there's a specific reason during adjudication.

If you run into any issues with your claim or need to talk to Washington ESD about your specific situation, I'd recommend trying Claimyr. It's a service that helps you get through to actual ESD agents without sitting on hold forever. I used it when my claim got stuck in adjudication and it saved me hours of frustration. Check out claimyr.com and they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Thanks for the tip! I've already tried calling Washington ESD twice and couldn't get through. How much does Claimyr cost?

•They have different options but it's way cheaper than the stress and lost time from trying to call on your own. Definitely worth it when you need answers quickly.

ugh the whole system is so frustrating. I had a friend who got denied unemployment when she was pregnant but I think that was because she couldn't work nights anymore due to her pregnancy complications. If you can work regular hours you should be fine

Isabel Vega
•That makes sense - I can work any shift right now so hopefully that won't be an issue for me.

•Your friend should have appealed that decision. Having some restrictions doesn't automatically disqualify you if you're still available for suitable work.

Just wanted to say congrats on the pregnancy! The timing with losing your job sucks but at least Washington ESD benefits can help bridge the gap. Make sure to apply as soon as possible since there's usually a waiting week.

•Thank you! I'm planning to file this weekend. Do I need to wait until my last day of work or can I apply before then?
0 coins
Payton Black
•You can apply the week after your last day of work. Don't wait too long though - the sooner you file, the sooner your claim can be processed.

I'm dealing with something similar right now. Filed my claim two weeks ago while 4 months pregnant and still waiting to hear back. The online system shows my claim is pending but no other details. Starting to get worried they're going to deny me.

•Have you tried calling them? I keep seeing people say the phone lines are impossible to get through on.

•I've called probably 50 times and either get busy signal or get disconnected after waiting on hold. It's incredibly frustrating.

•This is exactly why I mentioned Claimyr earlier - it's designed to solve this exact problem. Way better than burning your whole day trying to get through to Washington ESD.

For anyone reading this thread - pregnancy discrimination in unemployment benefits is illegal under federal law. Washington ESD cannot and will not deny your claim solely because you're pregnant. The only question is whether you meet the standard able and available requirements.

Isabel Vega
•That's really good to know! Is there somewhere I can read more about the specific laws around this?

•The Washington ESD website has information about eligibility requirements. You can also look up the federal Pregnancy Discrimination Act for more background.

One thing to keep in mind - when you have the baby, you might be eligible for family leave benefits through Washington State's paid family leave program. That's separate from unemployment but worth looking into for after the birth.

Isabel Vega
•Oh that's great to know! I hadn't even thought about what happens after the baby is born. Is that through Washington ESD too?

Marilyn Dixon
•Yes, it's administered through Washington ESD but it's a different program. You'd apply for that separately when you need the leave time.

Just be prepared for the job search requirements. You'll need to make at least 3 job contacts per week and keep detailed records. Some employers might be hesitant to hire someone who's obviously pregnant, but you still need to apply and document your efforts.

Isabel Vega
•That's what I'm worried about. How do I handle interviews when I'm clearly pregnant? Do I have to disclose it?
0 coins
Amun-Ra Azra
•You don't have to disclose pregnancy during interviews, and employers can't legally ask. Just focus on your qualifications and ability to do the job.

I worked in HR for years and can confirm that pregnancy status has no bearing on unemployment eligibility. The only time it might come up is if you voluntarily quit your job due to pregnancy-related issues, but that doesn't sound like your situation since you were laid off.
0 coins
Isabel Vega
•Right, it was definitely a layoff due to company downsizing, not anything related to my pregnancy. Good to know that makes a difference.
0 coins
Summer Green
•Exactly. Since you were laid off through no fault of your own, your pregnancy is completely irrelevant to your unemployment claim eligibility.

Does anyone know if there are any special accommodations for pregnant women during the job search process? Like if you can't lift heavy things or work certain jobs?

Dominique Adams
•The key is 'suitable work' - you're only required to accept jobs that are suitable for your situation. If you have medical restrictions, those would be taken into account.

Gael Robinson
•That makes sense. I guess as long as you're not turning down jobs you could actually do, you should be fine.

Filed my claim while pregnant last year and had zero issues. The whole process was actually pretty smooth. Just make sure you file your weekly claims on time and keep up with the job search requirements.

•How long did it take for your claim to be approved? I'm hoping it won't take too long since I need the income.

Edward McBride
•Mine was approved within about 2 weeks. Some claims take longer if they need to verify information, but pregnancy shouldn't cause any delays.

The Washington ESD website has a section about ability to work that might be helpful. It basically says you need to be physically and mentally able to work, and available for work during normal business hours. Being pregnant doesn't affect either of those unless you have complications.
0 coins
Isabel Vega
•I'll check that out! I haven't had any complications so far, just normal pregnancy symptoms.

Darcy Moore
•Sounds like you'll be fine then. The vast majority of pregnant women continue working until close to their due date, so unemployment shouldn't be any different.

Update on my situation - I finally got through to Washington ESD using that Claimyr service someone mentioned. Turns out my claim was just waiting for routine verification, nothing to do with my pregnancy. The agent was really helpful and explained everything clearly.

•That's great news! I'm so glad it worked out. How long did it take to get through with Claimyr?

•Maybe 15 minutes total? Way better than the hours I spent trying to call directly. Definitely recommend it if you need to actually talk to someone at Washington ESD.

I think the most important thing is just to be honest and straightforward in your application. Don't try to hide anything, but also don't volunteer information that isn't asked for. Pregnancy is a protected status, so you have nothing to worry about legally.

Isabel Vega
•That's really reassuring. I've been stressing about this for weeks. Sounds like I should just file the claim and stop overthinking it.
0 coins
Dana Doyle
•Exactly! The sooner you file, the sooner you can start receiving benefits. There's really no reason to delay based on pregnancy concerns.

One more thing to consider - make sure you understand what happens to your unemployment benefits if you do find a job and then need to take maternity leave. You might be able to transition to the paid family leave program at that point.
0 coins
Isabel Vega
•That's a good point. I'm hoping to find something soon but it's good to know there are options for after the baby comes.

•Washington State actually has pretty good family leave benefits compared to other states. Definitely worth researching as you get closer to your due date.

Just to echo what everyone else is saying - being pregnant absolutely does not disqualify you from unemployment benefits. I've known several women who collected unemployment while pregnant without any issues. The key is just meeting the normal eligibility requirements.

Isabel Vega
•Thanks for the confirmation! It's really helpful to hear from people who have actually been through this.

•No problem! Don't let pregnancy anxiety stop you from getting the benefits you're entitled to. You paid into the system, so you deserve to use it when you need it.

The job market can be tough when you're visibly pregnant, but remember that the unemployment job search requirement is about making good faith efforts, not necessarily getting hired. Document your applications and interviews, and you'll be fine.
0 coins
Isabel Vega
•That's a good way to think about it. I was putting too much pressure on myself to actually get hired quickly.

Rita Jacobs
•Right - the system recognizes that not everyone finds work immediately. That's the whole point of unemployment benefits, to provide support during the job search process.

If you do end up having any issues with your claim, don't hesitate to file an appeal. The appeals process exists for a reason, and pregnancy discrimination cases are taken seriously. But honestly, I doubt you'll have any problems.
0 coins
Isabel Vega
•Hopefully it won't come to that, but good to know appeals are an option if needed.

•Most pregnancy-related unemployment claims go through without any issues. The system is designed to be fair, and pregnancy is a well-established protected status.
