Can I collect Washington ESD unemployment while on disability benefits?
I've been getting Social Security disability payments for about 8 months now, but my doctor says I might be able to do some part-time work soon. My question is - if I'm cleared to work part-time, can I still file for Washington ESD unemployment benefits? I'm not sure how disability and UI work together or if there are rules about collecting both at the same time. Has anyone been in this situation before?

This is actually pretty complicated because it depends on what type of disability you're getting and whether Washington ESD considers you able and available for work

•It's Social Security disability, not workers comp or anything like that. Does that make a difference?

•Yes that matters a lot. With SSDI you might have more flexibility than other disability types

The key issue is Washington ESD's able and available requirement. If you're on disability, they might question whether you can actually work. You'd need medical clearance showing you can perform some type of work and are actively seeking employment.

•My doctor said I could probably handle desk work or something not physically demanding. Would that count?

Dylan Mitchell
•That could work but you'd need documentation from your doctor specifically stating your work capacity and any restrictions

•I had a similar situation last year and Washington ESD required a detailed medical report before they'd approve my claim

I went through this exact thing when I was trying to get back into the workforce after being on disability! The Washington ESD adjudication process took forever because they had to verify I was actually able to work. Honestly, calling them was impossible - I'd spend hours trying to get through just to get hung up on.

•How did you finally get through to them? I'm worried about the same thing happening

•I ended up using this service called Claimyr that helped me get connected to an actual Washington ESD agent. They have this system that handles all the calling and waiting for you - there's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Way better than spending all day redialing

•Never heard of that before but sounds like it could save a lot of frustration

Wait I'm confused - if you're on disability doesn't that mean you CAN'T work? How can you collect unemployment for not being able to find work if you're already getting paid for not being able to work??

•Disability benefits and unemployment serve different purposes. Some people on partial disability can work limited hours or certain types of jobs

Ava Martinez
•oh ok that makes more sense I guess

•Right, there are different levels of disability. Some people can do sedentary work but not physical labor, for example

You'll definitely need to report your disability income to Washington ESD when you file your initial claim. They'll want to know the source and amount of all income you're receiving. The adjudication process will likely take longer because they'll need to determine if receiving disability benefits affects your eligibility.

•Do I report it as earnings or is there a separate section for disability income?
0 coins
Miguel Castro
•There should be a specific section for other income sources when you file. Don't try to hide it - Washington ESD will find out anyway

The biggest thing they'll look at is whether you're actively seeking work and available to accept a job if offered. If your disability prevents you from working full time, you might only qualify for partial benefits or none at all.

•What if I can work part-time but not full-time? Would that affect my weekly benefit amount?
0 coins
Sofia Gutierrez
•Possibly yes. Washington ESD calculates benefits based on your ability to work and earn wages. Restrictions could reduce your weekly benefit amount

•They also require you to register with WorkSource and do job searches, which might be challenging depending on your limitations

honestly the washington esd system is so messed up right now, even people without any complications are having trouble getting through to resolve issues

•Tell me about it! I've been trying to reach them for weeks about my claim status

•That's exactly why I mentioned Claimyr earlier - they specialize in getting people connected to Washington ESD agents when you can't get through the regular phone lines. Check out claimyr.com if you're having trouble reaching them

•might have to look into that if I can't get my adjudication resolved soon

Thanks everyone for all the info! It sounds like I need to get proper medical documentation first before even trying to file. Does anyone know what specific information the doctor needs to include?

Dylan Mitchell
•They'll want details about your functional capacity - what types of work you can do, any restrictions, how many hours you can work, etc.
0 coins
Sofia Gutierrez
•Make sure the doctor is specific about your ability to perform work-related activities, not just general health status

One more thing - if you do get approved for UI while on disability, you'll need to report both income sources on your tax return. The combination might affect your tax situation.

Giovanni Rossi
•Good point, I hadn't thought about the tax implications

Connor Byrne
•Yeah both unemployment and disability can be taxable income depending on your total income for the year

I'm dealing with something similar but with workers comp instead of social security disability. The Washington ESD rules seem different for each type of disability benefit.

Miguel Castro
•Workers comp is handled differently because it's usually temporary and tied to a specific injury. Social Security disability is more permanent

Zainab Abdulrahman
•That makes sense. My workers comp is supposed to end in a few months so maybe I should wait

Just be prepared for a long adjudication process. Washington ESD takes their time reviewing cases that involve disability income because they have to verify everything with multiple agencies.

Giovanni Rossi
•How long are we talking? Weeks or months?
0 coins
Yara Elias
•Could be anywhere from 4-12 weeks depending on how complicated your case is
0 coins
Sofia Gutierrez
•Mine took about 8 weeks but that was before they got really backed up with claims

The job search requirement is going to be tricky too. You'll need to show you're actually looking for work that accommodates your disability restrictions.

Giovanni Rossi
•Do I need to apply for jobs I probably can't do physically, or just ones within my restrictions?
0 coins
Connor Byrne
•Stick to jobs within your medical restrictions. Applying for jobs you can't do won't help your case

this whole system is so confusing! why can't they just have clear rules about what you can and can't do
0 coins
Dylan Mitchell
•Because every situation is different. Disability cases especially require individual review

Ava Martinez
•I guess that makes sense but it's still frustrating

Make sure you keep detailed records of all your medical appointments and any communication with Washington ESD. If they deny your claim, you'll need documentation for your appeal.

•Good advice! I'll start keeping a file with everything

Miguel Castro
•Yes, documentation is crucial for disability-related UI claims. Keep copies of everything

Has anyone here actually gotten approved for both disability and unemployment at the same time? I'm curious if it's even possible in practice

•I know someone who got partial UI benefits while on partial disability, but it took months of back and forth with Washington ESD

•That's where having help getting through to agents really made a difference for me. The Claimyr service I mentioned saved me so much time and frustration trying to get answers

Don't forget that if you're approved for UI, you still have to do the weekly claims and report any disability income you receive during that week.
0 coins
Giovanni Rossi
•Would the disability income count as wages or other income on the weekly claim?
0 coins
Keisha Jackson
•It would be other income, not wages. But it could still affect your benefit amount depending on how much you receive

The medical documentation is really key here. Washington ESD will want a very specific letter from your doctor outlining exactly what work activities you can perform.
0 coins
Giovanni Rossi
•Should I ask for a specific form or just have them write a letter?
0 coins
Paolo Moretti
•A detailed letter is usually fine, but make sure it addresses your functional capacity for work activities

I would recommend talking to a disability advocate or attorney before filing for UI. They can help you understand how it might affect your disability benefits.

Giovanni Rossi
•That's a good idea. I don't want to accidentally mess up my disability payments

Miguel Castro
•Definitely worth checking with Social Security too to make sure UI won't impact your SSDI eligibility

One last thing - if Washington ESD approves your claim, make sure you understand how the benefit calculation works with your disability income. It can get complicated.

Giovanni Rossi
•I'll definitely ask about that when I talk to an agent. Hopefully I can actually get through to someone!

•That's where services like Claimyr really help - you don't have to waste time trying to reach agents yourself. Much more efficient way to get your questions answered
