Can 1099 contractors apply for Washington ESD unemployment benefits?

I've been working as a 1099 independent contractor for the past 2 years doing freelance graphic design work. My main client just ended our contract and I'm scrambling to find new work. A friend told me that contractors might be able to get unemployment now but I'm not sure if that's true in Washington state. Has anyone who was classified as a 1099 worker successfully applied for Washington ESD benefits? I'm really confused about whether independent contractors are eligible.

Unfortunately, traditional 1099 independent contractors typically aren't eligible for regular unemployment insurance in Washington state. You need to have been an employee (W-2 worker) who had payroll taxes withheld to qualify for standard UI benefits. However, there might be some exceptions depending on your specific work arrangement.

That's what I was afraid of. So there's really no safety net for contractors at all?

There used to be PUA during the pandemic but that ended in 2021. Now it's back to the old rules.

Actually, this can get complicated because sometimes workers are misclassified as 1099 when they should legally be employees. If you worked for one main client, had set hours, used their equipment, or they controlled how you did your work, you might have been misclassified. Washington ESD can investigate misclassification cases.

Interesting! My main client did set my hours and I used their software licenses. How would I go about getting that investigated?

You can request an employment status determination from Washington ESD. If they determine you were actually an employee, your former client would owe back payroll taxes and you could become eligible for benefits.

I went through something similar last year. Getting Washington ESD to investigate misclassification took months and I couldn't get through to anyone on the phone to check status. Finally used Claimyr.com to actually reach an agent who explained the process. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

Never heard of Claimyr before. Did it actually help you get through to Washington ESD?

Yeah, it calls the Washington ESD phone number automatically and holds your place in line, then connects you when an agent picks up. Saved me hours of redialing.

Wait I'm confused - I thought all contractors could get unemployment now? My cousin in California got benefits as a freelancer.

California has different rules than Washington state. Some states have expanded coverage but Washington still follows the traditional W-2 employee requirement.

Yeah every state is different. Don't assume what works in one state applies everywhere.

THIS IS SO FRUSTRATING!!! Contractors pay self-employment taxes but get ZERO protection when work dries up. The system is completely broken for freelancers and gig workers.

I feel you. Been freelancing for 5 years and always worried about this gap in coverage.

Right? We pay taxes but don't get the same safety net as regular employees.

Have you looked into whether you might qualify as an employee under Washington's ABC test? For 1099 workers to be properly classified as independent contractors, the work must be: A) free from control, B) outside the usual course of business, and C) performed by someone in an independent trade. If any of these fail, you should have been an employee.

This is really helpful. My work was definitely part of their usual business operations, so that might fail the B test.

Exactly! If you were doing core business functions like their regular graphic design work, that's a red flag for misclassification.

Even if you can't get regular unemployment, check if you qualify for any other assistance programs. WorkSource Washington might have job training funds for displaced workers, including freelancers.

Good point. I should look into retraining programs while I'm figuring out the unemployment situation.

I was in your exact situation 6 months ago. Filed for unemployment as a misclassified worker and it took forever to get a determination. Couldn't reach Washington ESD by phone for weeks until I tried that Claimyr service someone mentioned earlier. Finally got connected to an agent who walked me through the whole process.

What was the outcome? Did they determine you were misclassified?

0 coins

Yes! Took 3 months but they ruled I should have been an employee. Got back benefits and my former client had to pay penalties.

0 coins

Be prepared for a long fight if you go the misclassification route. Companies don't like paying back payroll taxes and will fight it.

How long are we talking? I need income soon, not in 6 months.

My case took 4 months for the initial determination, then another 2 months to process benefits. Start the process ASAP if you're going this route.

Quick question - did you ever receive any W-2s or just 1099s? Sometimes companies mess up the paperwork.

Yara Abboud

•

Only 1099s, but now I'm wondering if they should have been issuing W-2s based on how controlled my work was.

Document everything about your work relationship before you lose access to any records. Screenshots of emails, work schedules, any training materials they provided. You'll need evidence for the misclassification claim.

Smart thinking. I still have access to their project management system where they assigned my daily tasks.

0 coins

Perfect! That shows they controlled your work methods and schedule, which supports employee classification.

Another contractor here - have you considered applying for emergency assistance while you sort out the unemployment situation? Some counties have emergency rental/utility assistance for displaced workers regardless of employment type.

I hadn't thought of that. Which programs should I look into?

Start with your county's human services department. Many still have pandemic-era emergency assistance programs running.

If your client controlled your work schedule, provided equipment, and your work was integral to their business, you have a strong misclassification case. The fact that they were your main income source for 2 years also supports employee status.

They did provide the software licenses and set my daily hours. Sounds like I should definitely pursue the misclassification angle.

Just want to add - even if you don't qualify for unemployment, keep track of your job search activities. If the misclassification gets approved later, Washington ESD might require proof you were actively seeking work during the benefit period.

Good point! I'll start keeping a job search log just in case.

The process can be frustrating but don't give up. Washington state has been cracking down on worker misclassification lately, so you might have better luck now than in previous years.

That's encouraging. I'm going to start gathering my documentation and file for an employment status determination.

One more resource - the Washington State Department of Labor & Industries also handles misclassification cases from a different angle. Sometimes it helps to file with both agencies.

Last tip - if you do need to call Washington ESD about your case, try that Claimyr thing people mentioned. The regular phone system is impossible to get through on, but having something call for you automatically makes a huge difference.

Yeah I'm definitely going to try that if I can't get through on my own. Thanks again everyone!
