TWC waiting week confusion - can't certify when expecting job offer?

I've hit the end of my regular unemployment benefits this week, but I have a job interview that went really well and I'm expecting to get an offer next week (fingers crossed!). I'm trying to figure out this whole 'waiting week' situation and I'm super confused. When I tried to request payment for my waiting week, the TWC system asked me to certify that I'm NOT employed - which technically I'm not yet, but I will be soon (hopefully). I don't want to mess anything up by saying the wrong thing. Should I go ahead and file for the waiting week even though I might start work next week? Will I get in trouble if I certify I'm unemployed but then get hired a few days later? Or should I just forget about the waiting week payment entirely? The whole system is so confusing!

You should absolutely file for your waiting week! The waiting week is the first payable week of your claim that you previously weren't paid for. When you certify, you're confirming your employment status AT THAT MOMENT, not what might happen in the future. If you're not employed today when you submit the request, you're answering honestly. If you get a job offer next week, you'll report that when it actually happens on your next payment request (if you're still filing by then).

Oh that makes sense! So I'm not doing anything wrong by filing for it even though I might start work soon after? I was worried they'd think I was trying to cheat the system somehow.

THIS!!! The TWC system is DESIGNED to confuse people out of claiming benefits they're ENTITLED to! Don't let them trick you out of YOUR MONEY that YOU EARNED through YOUR TAXES!!! 🤬 I missed out on almost $600 because I was confused about the waiting week too!!!

Let me clarify how the waiting week works in Texas: 1. The waiting week is the first week of your claim that was initially unpaid 2. You become eligible to receive payment for it after you've received 3 times your weekly benefit amount AND returned to full-time work 3. When filing for the waiting week, you're certifying your employment status at the time of filing 4. If you get hired after filing, that's perfectly fine - you'll just report the new employment on your next payment request 5. If you don't file for the waiting week now, you might regret it later Just answer all questions honestly based on your current situation. You're not employed until you actually start working, regardless of any offers or promises.

Thank you for breaking it down like this! So even though I've reached the end of my regular benefits, I can still file for the waiting week? And I qualify because I've definitely received more than 3x my weekly benefit amount over the past few months.

When I was on unemployment last year I had a similar situation and just waited until after I started my new job to request my waiting week. The TWC website was super confusing but I think there's an option somewhere to request just the waiting week payment even after you're working again. Anyone else done this?

Yes, you can request your waiting week payment after you've returned to full-time work. In fact, that's one of the requirements - you need to have received at least 3 times your weekly benefit amount AND returned to full-time work. The system will have an option specifically for requesting just the waiting week payment after you've reported returning to work.

I just went through this exact situation last month! The TWC phone lines were constantly busy and I couldn't get anyone to explain the waiting week properly. After days of frustration, I found Claimyr (claimyr.com) which connected me to a TWC agent in about 20 minutes. The agent confirmed I should definitely file for my waiting week even though I had a pending job offer. They explained I wasn't doing anything wrong since I wasn't employed at the time of filing. There's a video that shows how it works here: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh Saved me a ton of stress and I got my waiting week payment about 3 days later!

i think ur overthinking this tbh. just file for the waiting week now cuz ur still unemployed until u actually START the new job, not when u get the offer. the system is asking about ur current status not the future

You're probably right. I tend to overthink everything with unemployment because I'm scared of doing something wrong and having to pay money back later. But it sounds like filing for the waiting week is the right move.

The whole "waiting week" thing is another TWC SCAM to make it confusing for people to get their full benefits!!! They DELIBERATELY make the questions confusing so people won't claim what they're entitled to. I've been dealing with their ridiculous system for MONTHS trying to get my benefits straightened out. Don't let them intimidate you!!

While the system can certainly be confusing, the waiting week actually serves a purpose in unemployment insurance programs across the country. It's not unique to Texas. The waiting week helps ensure claims are legitimate and provides time for initial processing. The good news is that Texas does allow you to get paid for this week eventually, which some states don't offer.

One thing to remember about the waiting week payment - when you do request it after finding work, the system might ask you to verify your employment details like start date, employer name, etc. Make sure you have all that information ready when you file for it. I had to submit my first paystub as verification when I claimed my waiting week.

That's really helpful to know, thank you! I'll make sure to save my first paystub and keep all the employment details handy for when I file for the waiting week. Seems like I can either file now or wait until after I start the new job - both are valid options.
