Can you apply for TWC benefits 5 months after being laid off?

My brother-in-law lost his job back in January after working at a manufacturing plant for 3+ years. He's been living off savings but now running low on funds. He just told me he never applied for unemployment this whole time because he thought he'd find work quickly! Can he still file for TWC benefits now in June, or is it too late? He was officially laid off (has termination paperwork) and definitely qualifies otherwise. Anyone know if there's a hard deadline or if he can still get benefits retroactively for the past 5 months? Really worried about him as he's burning through his last bit of savings.

He needs to file ASAP! Texas allows you to backdate a claim, but there are strict limits. The general rule is you can backdate up to 3 weeks without special approval, but he's way beyond that at 5 months. He'll need to explain the good cause for the delay when he applies. Valid reasons might include illness, misinformation from TWC, or not understanding eligibility. Have him call TWC directly to explain his situation - though getting through is nearly impossible these days.

Thanks for the info! He'll definitely apply today. Do you think 'I thought I'd find a job quickly' counts as good cause? Or should he just be honest about not knowing he could apply?

Tell your brother-in-law he should ABSOLUTELY still apply!!! I had a similar situation (waited 2 months tho not 5) and I was able to get SOME backpay but not all. The most important thing is to APPLY NOW because every week he waits is another week lost forever!!!! The TWC system will ask him why he's filing late and he'll need to provide a reason. To be honest, "I didn't know I could apply" sometimes works but "I thought I'd find work quickly" probably won't. Either way he should get SOMETHING even if not the full 5 months backpay!!

That's really helpful! I'll let him know to apply immediately. Did you have to do anything special to request the backpay or did they just ask during the application process?

my cousin waited like 4 months to apply after getting fired and twc gave him nothing for the missed weeks. they only paid him going forward from when he actually applied. worth a shot tho whats he got to lose?

Good point - nothing to lose by trying. Sorry about your cousin's situation though, that's exactly what I'm worried might happen.

The actual TWC rule is that claims can only be backdated for "good cause" and there's a specific list of what qualifies. Unfortunately, not knowing you should apply or thinking you'd find a job quickly aren't considered good cause. According to TWC guidelines, good cause includes: - TWC gave incorrect information - You were physically unable to apply (hospitalized, etc.) - You attempted to file but the system was down - You were misinformed by a TWC representative However, he should ABSOLUTELY still apply immediately! He won't get the full 5 months, but he could potentially get benefits going forward if he's still unemployed. And there's always a small chance they might approve some backdating depending on his specific circumstances.

Honestly, TWC is so backed up right now he might actually be better off skipping the phone nightmare and going in person to a Workforce Solutions office if there's one nearby. They can help with applications and sometimes give better advice than the phone reps.

If he's having trouble reaching someone at TWC (and who isn't?), I used a service called Claimyr last month that got me through to an actual TWC agent in about 20 minutes instead of days of trying. It was a lifesaver for my complicated claim situation. There's a video showing how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh and their website is claimyr.com. Totally worth it if he needs to explain his situation to a real person rather than just submitting online.

wait so what happens if he applys late? does he at least get money from now going forward?

Yes, if he qualifies for unemployment benefits, he can still receive them going forward from the date he applies. He just likely won't get payments for the time between his job loss in January and whenever he applies now in June. That's why it's crucial he applies immediately to stop losing more potential benefit weeks.

Please don't advise people to lie on government applications. That's fraud and can result in having to pay back all benefits with penalties, or even criminal charges in severe cases. Always be truthful on TWC applications - they do verify information with former employers and other sources.

Thanks everyone for the advice! I've told him to apply immediately and be honest about why he waited. He's going to try calling TWC tomorrow and explain his situation, then submit his application online. I'll update here if we find out anything that might help others in the same situation.

Good luck! Just be prepared that calling might take DAYS of attempts. Make sure he has his employment documents ready - especially his termination notice and anything showing the exact date he was laid off. The more documentation he has, the better!
