How long after layoff can you apply for unemployment in NY - missed the deadline?
I got laid off from my construction job about 6 weeks ago and just found out I should have applied for unemployment right away. I've been looking for work this whole time but nothing's come through yet. My supervisor said something about needing to file within a certain timeframe but I honestly thought I had to wait a few weeks before applying. Now I'm worried I missed some kind of deadline and won't be able to get benefits at all. Can I still apply to NYS Department of Labor now or is it too late? I really need these benefits to cover rent while I keep job searching.

You can still apply! There's no specific deadline for filing after a layoff, but you should definitely file as soon as possible. NYS Department of Labor benefits are only paid from the date you file your claim forward, not retroactively to when you were laid off. So you've unfortunately lost those 6 weeks of potential benefits, but you can still get benefits going forward if you're eligible.

•Oh no, so I can't get those 6 weeks back? That's like $1800 I missed out on. Should I still mention the layoff date from 6 weeks ago when I file?

File immediately on the NYS Department of Labor website. You're right that there's no deadline to apply after job loss, but the waiting period starts from when you file, not when you were laid off. Make sure you have your employer information and last day of work ready. The system will ask for your separation date but your benefit week will start from when you submit the application.

•This is correct. I made the same mistake and lost about a month of benefits because I didn't know I could file right away.

ugh the NYS Department of Labor should make this clearer!! I see people all the time who think they have to wait or that there's some deadline. It's so confusing and costs people money they desperately need.

•Totally agree, the whole system is set up to confuse people into missing out on benefits they paid into.

I had trouble reaching NYS Department of Labor to ask questions about my claim timing when I was laid off last year. Kept getting busy signals and the online chat was always unavailable. I ended up using a service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo showing how it works: https://youtu.be/qyftW-mnTNI. Made the whole process much less stressful when I could actually talk to someone about my specific situation.

•That might be helpful. I've been dreading trying to call them because I heard the wait times are horrible.

Just want to add that when you do file, make sure you're ready to start your weekly claims right away and keep track of your job search activities. NYS Department of Labor requires you to be actively looking for work and you'll need to document that.

Don't beat yourself up about missing those 6 weeks - it's a really common mistake! The important thing is to file NOW before you lose any more time. When you apply online, you'll put your actual layoff date from 6 weeks ago as your separation date, but your benefit payments will only start from the week you file the claim. Also make sure you have your employer's info handy (company name, address, reason for separation) and be prepared to start doing your weekly certifications right away. The sooner you get this process started, the sooner you can start receiving benefits while you continue your job search.

•This is really helpful advice, thank you! I was beating myself up about it but you're right that I need to focus on getting it filed now. Quick question - when I'm doing the weekly certifications, do I report the job searching I've already been doing these past 6 weeks, or only the job search activities I do after I file the claim?
