PA UC eligibility after medical emergency - got let go after stroke at temp agency job
So I had a medical emergency at work last month - I actually had a stroke while on the job at a warehouse where I was placed by a staffing agency. I was hospitalized for 9 days. When I called the agency to discuss returning to work, they told me they 'no longer needed my services' and that my assignment was terminated. I'm finally well enough to work again (doctor cleared me with some restrictions), but now I'm wondering if I qualify for PA unemployment? Does being let go after a medical emergency disqualify me? The agency is claiming I 'abandoned' the job, but I was literally in the hospital! Do I have any shot at getting unemployment benefits in this situation?

They cant fire u for having a MEDICAL EMERGENCY!! thats illegal discrimination! definatly apply for UC, make sure u tell them EXACTLY what happened and have ur hospital paperwork to prove it. temp agencies try to get away with this stuff all the time smh

You absolutely should apply for PA unemployment. Being terminated due to a medical condition you have no control over (like a stroke) generally doesn't constitute willful misconduct, which is what would normally disqualify you. The key factors here: 1. You didn't voluntarily quit - you had a medical emergency and were hospitalized 2. You attempted to return to work after being medically cleared 3. The employer terminated your assignment When you file, list the staffing agency as your employer since they technically employed you. Make sure to upload your medical documentation showing both your hospitalization dates and your doctor's release indicating you're able to work (with restrictions). If the agency disputes your claim (which they might try to do), you'll need to clearly explain the timeline during your appeal. Also, be prepared for them to possibly claim they offered you other work - if they didn't actually do this, be clear about that.

my cousin had something similar happen she got sick and her temp job just stopped calling her. she got approved but had to wait almost 6 weeks cus they put an "open issue" on her claim. really stressful time for her

I work in HR and staffing agencies pull this kind of crap all the time. It's not legal, but they count on people not knowing their rights. Since you had a legitimate medical emergency and attempted to return, you are eligible for UC benefits. However, be prepared for a fight. The agency will likely claim you "abandoned" the position or were a "no call/no show" to try to make it look like willful misconduct. Make sure to appeal if they contest your claim! Documentation is EVERYTHING. Get copies of: - Hospital admission and discharge papers - Doctor's note clearing you to work with restrictions - Any texts/emails with the agency showing you tried to return And yes, in PA you list the staffing agency as your employer, not the worksite where you were placed.

THIS HAPPENED TO ME!!!!!! Except it was a seizure not a stroke. Same deal though - got sick at work, went to hospital, agency said dont come back. I fought them and WON my unemployment claim but it took FOREVER and I almost got evicted waiting. PA unemployment system is BROKEN!!!! The worst part was trying to get thru to someone on the phone - literally called 70+ times a day for WEEKS.

btw make sure u say yes when they ask if ur able and available for work since ur doctor cleared u, even with restrictions. if u say no they'll deny u automatically

Wait I'm confused...if u have work restrictions doesn't that mean u can't work? How does that work with unemployment?

one more thing i just remembered for when u file - my friend who got sick had to explain the separation reason in detail in that little box they give u. make sure u write clearly that u had a MEDICAL EMERGENCY, were HOSPITALIZED, ATTEMPTED to return to work, and were TERMINATED by the agency. use those exact words so its super clear what happened

Update us on how it goes! And if your claim gets denied initially, DEFINITELY appeal. About 60% of denied claims get approved on appeal when the claimant presents their evidence properly. Don't give up if you get denied at first.
