PA UC appeal hearing conflicts with niece's wedding - can I reschedule?

I've been collecting PA unemployment benefits for about 2 months now without any issues, but today I received a notice for an appeals hearing that I need to attend in person. Before this, I went through 8 weeks of stress with no payments until I was finally approved. Now it looks like my former employer is appealing that decision. My big problem is that I'm supposed to fly out the morning of the hearing date for my niece's wedding in Arizona. I already bought the tickets months ago ($480 that I really couldn't afford) and my whole family is expecting me there. Is it possible to change the hearing date? Has anyone successfully rescheduled an appeal hearing before? How do I request this? I'm really worried they'll deny my benefits if I don't show up, but I also can't miss my niece's wedding - I promised I'd be there and she'd be devastated.

Yes, you can absolutely request to reschedule your appeal hearing! You need to contact the UC Appeals office ASAP though. Call the number on your hearing notice and explain your situation. Having pre-purchased plane tickets is considered a valid reason for rescheduling. Make sure you explain you had these plans before receiving the notice. The law allows for postponements when you have a compelling reason and provide documentation. Have your flight confirmation email ready when you call. They'll likely approve your request if you act quickly.

Thank you so much for the quick reply! I've been panicking since I got the notice this morning. I'll call them first thing tomorrow. Do you think I should email them too with a copy of my flight confirmation just to have proof I contacted them? I'm so afraid of messing this up.

I went through this exact situation last year! Don't worry too much - I was able to get my hearing rescheduled. Here's what worked for me: 1. Called the Appeals office number on the notice immediately 2. Submitted a written request explaining the conflict (you can fax or mail this) 3. Included copies of my travel documents with the request 4. Followed up by phone 2 days later to confirm they received everything They rescheduled mine for 2 weeks later. Just make sure you request the postponement BEFORE the hearing date. If you wait until after, you're automatically considered a no-show.

THIS IS IMPORTANT ADVICE! I didn't request my postponement in time and they DENIED ALL MY BENEFITS and I had to start the entire appeal process over again!!! The system is designed to trip people up. They want us to fail so they don't have to pay!!!!

I've tried calling the appeals office for THREE DAYS STRAIGHT and keep getting busy signals or disconnected. So frustrating trying to get through to anyone at PA UC! I finally used Claimyr (claimyr.com) to get through to an actual person. They have this service that calls for you and connects you when they reach a representative. Saved me hours of redial hell. They have a demo video that shows how it works: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2 Worth it for me because I needed to reschedule my hearing due to a medical procedure, and waiting any longer would have been too late.

Yeah it definitely worked for me. Got through in about 40 minutes instead of spending days trying to call. The UC rep I spoke with was actually helpful once I finally reached someone.

just went thru this last month my friend. gotta say the postponement thing is a HASSLE but its doable. make sure u got ur confirmation emails and ticket receipt ready. also they gonna wanna know when u booked the flight to prove it was before u got the notice. good luck!

Thanks for the tip about when I booked the flight - I wouldn't have thought to mention that specifically. I purchased the tickets back in December, so well before this appeal notice. I'll make sure to have all that documentation ready when I call.

My employer appealed my case too and the hearing was super stressful. They brought their lawyer and I wasn't prepared at all. Make sure you understand exactly why they're appealing and gather any documents that support your case for when the rescheduled hearing happens. Separation reason? Job performance? Attendance? Get your documentation together ASAP regardless of the date change.

Oh wow, I didn't even think about preparing for the actual hearing yet - I've been so focused on the date conflict. They fired me claiming "poor performance" but never gave me any written warnings. I was really blindsided. Should I bring performance reviews? Or emails showing they were happy with my work before?

0 coins

Absolutely bring those performance reviews and emails! Any documentation showing positive feedback or lack of formal warnings will be extremely helpful. Also bring your employee handbook if you have it, and any communication about your termination. The referee will want to see evidence that contradicts your employer's claims. Focus on showing you weren't terminated for willful misconduct, which is the standard they must prove.

i had to reschedule mine cuz my kid was sick. they gave me a hard time about it but eventually agreed. just be super nice on the phone even if they act like jerks. oh and write down who u talk to and when!!! i learned that the hard way lol

That's great advice about writing down who I talk to. I'll definitely do that. I'm going to call them first thing in the morning and be super polite. Fingers crossed they'll be understanding about the wedding situation!

Make sure when you do attend the rescheduled hearing that you arrive at least 30 minutes early. They're very strict about starting on time. Bring multiple copies of all your documents - one for yourself, one for the referee, and one for your employer's representative. Dress professionally too - it actually makes a difference in how they perceive your case.

Thank you for these tips! I would have probably shown up right on time otherwise. And I wouldn't have thought to bring multiple copies of everything. I'll definitely dress professionally too - I have a nice blazer I can wear with slacks. Would that be appropriate?

Yes, a blazer and slacks would be perfect! You want to look put-together and serious about the process. Also, organize your documents chronologically and tab them if possible. Makes it much easier to find what you need when you're nervous in the hearing. Good luck!

Just checking in - were you able to get through to request the postponement? I'm curious if you had better luck than I did with the phone system.

I tried calling all morning and kept getting busy signals! Finally got through around 2PM after probably 50+ attempts. They said they'd send me a postponement request form that I need to fill out and return with my flight documentation. Now I'm just waiting for that to arrive and hoping they approve it. This whole process is so stressful.

Don't just wait for the form to arrive! You can download the postponement request form directly from the PA UC website under the Appeals section. Fill it out immediately and submit it with your documentation. Time is critical with these requests!

btw once u get the new date dont forget to check ur mail like crazy. they might send u important stuff about the case before the hearing. my cousin missed some document deadline cuz he didnt check his mail and it messed up his whole case

That's a really good point! I just set up informed delivery with USPS so I can see what's coming in the mail each day. I definitely don't want to miss any deadlines.

The ENTIRE system is designed to MAKE YOU FAIL!!! I had to reschedule my hearing TWICE and they kept "losing" my paperwork!!! Document EVERYTHING and send EVERYTHING certified mail so they can't claim they never got it!! Don't trust ANYTHING they tell you over the phone!!!

I don't think it's quite that bad. I had a pretty straightforward experience with my appeal hearing. The referee was actually very fair and professional. I think it just varies depending on who you deal with.

You got LUCKY then. Most people get SCREWED by the system. They WANT to deny benefits!! That's their JOB!!

Good news - I just checked the UC website and they recently updated their postponement policy. They now allow you to submit postponement requests online through your dashboard. Might be faster than waiting for mail forms or faxing things in. Look for the "Appeal Hearing Actions" section after you log in.

0 coins

Oh that's fantastic news! I just logged in and found that section. You're right - there's an option to request postponement right there. I'm uploading my flight information now. Thank you so much for letting me know about this!

UPDATE: I just heard from a colleague who works with UC appeals that they're currently processing postponements within 3-5 business days. So you should hear back about your request fairly quickly. Once approved, they typically reschedule 2-3 weeks out, but it can sometimes be longer depending on their backlog.

That's really helpful information! I'm hoping to hear back soon. I'll be nervous until I get the official rescheduled date. I really appreciate everyone's help and advice here - it's made this situation so much less stressful knowing what to expect.
