Will answering self-employed question affect my ny unemployment benefits this week?
So I filed my weekly certification this morning and at the end of the process I got this weird question I've never seen before. It asked if my most recent work before filing was self-employment. I'm a hairstylist who got laid off from a salon in October, but I still have about 5-6 regular clients I do house calls for on weekends. I honestly answered "yes" to the question since I did have those clients. Now I'm freaking out - will this mess up my payment for this week? I'm counting on that money for rent. Anyone else run into this question? I've been filing since November and this is the first time I've seen it. Should I have answered differently?

I had a similar issue a couple months ago. You should be careful about reporting self-employment income. With those clients, you need to report any earnings when certifying each week. The rules say you can work part-time while collecting benefits, but they deduct a portion of what you earn from your weekly benefit amount.

•So do you think my payment for this week will be delayed? I did report my earnings from my weekend clients.

•It might be delayed while they review your claim, but if you reported everything honestly you should still get paid. It just might take longer this week.

•This happened to me too! They held my payment for like 3 weeks after I answered a similar question. The system is so broken 🤦♀️

After struggling to get through to ny unemployment for WEEKS, I found a service called Claimyr (claimyr.com) that got me connected to an actual human at the unemployment office. Literally changed everything. I had answered a certification question wrong too and they fixed it right away after I finally talked to someone. Got my payments caught up in days instead of waiting months. Check out this video on how it works: https://youtu.be/Rdqa1gKtxuE - talking to an agent got my money released so fast it was unreal.

•Sounds suspicious. How does that even work? They just call for you?

•Yeah they basically call repeatedly and wait on hold, then when a real person picks up, they forward the call to your phone. Saved me hours of hold time and frustration. I was about to give up on getting my benefits fixed.

•another miracle solution to add to the pile 🙄 does this actually work or you just promoting something?

•It's not a miracle, it's just a service that does the waiting on hold part for you. I was skeptical too but after 3 weeks of not getting through myself I was desperate. Finally got my issue resolved that same day.

I think youll be ok. The system asks different questions sometimes to check for fraud. If youve been reporting your side income all along (the hair clients) then youre good. I'm a massage therapist with the same situation - salon job plus side clients.

From my experience with NY unemployment (which is EXTENSIVE at this point lol), they're doing extra verification now because of all the fraud that happened. If you answered truthfully, you have nothing to worry about. They might put a temporary hold while they verify, but that's normal. Def keep certifying each week regardless!

•That makes me feel better. How long did the verification take when they put yours on hold?

•Mine took about 8 days which felt like forever, but not as bad as some people's experiences. Just keep checking your payment history and account every day.

Your gonna need to call them. Answering yes to that question probly flagged ur account for review. Don't panic, it's fixable but they won't fix it automatically. Gotta talk to a human unfortunately 😫

•Ugh I was afraid of that. I've never been able to get through on the phone. I've tried calling at all different times of day.

•Try calling right when they open at 8am. I got through after only 45 min on hold that way. Later in the day is impossible.

•I had the exact same thing happen! Used claimyr.com to get someone on the phone after trying for days. Worth every penny to get my benefits fixed.

Here's what will probably happen based on my experience working with several clients in your situation (I'm a career counselor): Any time you answer a question differently than previous weeks, the system flags your claim for review. Since you indicated self-employment, they want to determine if: 1) You are truly eligible for regular UI benefits vs. having to file under different rules 2) You're accurately reporting all income from self-employment each week 3) Your self-employment constitutes full-time work (which would make you ineligible) You should immediately try to contact NYSDOL to explain your situation. Your benefits may be temporarily held until they review, but if you've been honest about your part-time self-employment income each week, you should ultimately be fine. I recommend: - Keep certifying weekly even if payments pause - Document all your income carefully - Try to speak with a representative (use claimyr.com if you can't get through - many of my clients have had success with it) - Check your message inbox daily for questionnaires they might send This happens quite often with stylists, artists, and others who mix W-2 and self-employment. Stay persistent!

•Thank you SO much for this detailed explanation! This is incredibly helpful. I'll definitely keep certifying and try to get through to someone ASAP.

•You seem really knowledgeable. Do you know if having more than one type of income (I have a part-time W2 plus gig work) always triggers these kinds of reviews?

Anita George
•Not always, but it does increase the likelihood of periodic reviews. The system has been much more sensitive to mixed income situations since the pandemic because of the high levels of fraud they encountered.

The same exact thing happened to me last month! They put my claim on pending for 3 weeks before it finally went through. I was so mad 😡 The NY unemployment system is completely broken.

•3 weeks?? I cant wait that long for my money! Did you have to do anything to get it fixed or did it just randomly start working again?

•I had to call like 50 times before I got through to someone who could help. Once I finally talked to someone they fixed it that day and released all my payments.

If ur self-employed u should be gettin PUA not regular unemployment! Thats probably y they flagged it. Did u apply back when pandemic started or recently?

•PUA ended a long time ago. They're not accepting new PUA applications anymore. If OP is on regular UI now, they must have qualified based on their W-2 salon job.

•Oh ur right my bad, forgot PUA is over. Gettin all these programs mixed up lol

I'm a paralegal who specializes in employment issues. The most important thing is that you've been consistent with reporting your self-employment income. The question itself isn't necessarily a problem - they're just verifying your work status. But if you haven't been reporting that income from your hair clients each week, that could potentially cause issues with your claim. Have you been reporting all income from those side clients?

Nina Fitzgerald
•Yes I've reported everything! I'm usually making between $100-200 a week from my private clients and I've declared it all when I certify.

•Then you should be fine. They might just take a bit longer to process your payment this week while they verify things. The fact that you've been consistent and honest puts you in a good position.

•I had a similar issue and used claimyr.com after not being able to reach anyone for weeks. It worked - they got me through to an agent who fixed my claim immediately. Before that I was just getting automated messages.
