Why would I be denied unemployment benefits by NYS Department of Labor?

I just got laid off from my warehouse job after 2 years and I'm thinking about filing for unemployment but I'm worried I might get denied. What are the main reasons NYS Department of Labor denies people? I left my previous job before this one because my boss was making the workplace really hostile but I'm not sure if that counts as good cause. Should I even bother applying or will they just reject me automatically?

The most common reasons for denial are: 1) Quitting without good cause 2) Getting fired for misconduct 3) Not being able and available for work 4) Refusing suitable job offers 5) Not meeting the wage/work requirements. Since you were laid off from your current job, that shouldn't be an issue. The previous job situation might come up during adjudication though - they'll look at your entire work history.

You should definitely apply! Being laid off is usually a straightforward approval. Even if there are questions about your work history, you can explain your side during the adjudication process. NYS Department of Labor will send you forms to fill out if they need more info about why you left previous jobs. Don't let fear stop you from getting benefits you're entitled to.

This is good advice. I had issues with a previous employer too and still got approved. They mainly care about your most recent separation.

ugh the whole system is so confusing and they make it seem like they're looking for any excuse to deny you!! I've been waiting 3 weeks just to hear back about my claim and I'm going crazy

If you're having trouble getting through to NYS Department of Labor to check on your claim status, I used a service called Claimyr that helped me reach an actual agent. just apply already! worst case they say no and you appeal it. I got denied first time because of some paperwork issue but got it sorted out on appeal. you're overthinking this
