What to expect at NY unemployment arbitration hearing? Got a date but no idea what happens next
Just got notified that my unemployment arbitration request was accepted and I have a date scheduled for next month (mid-July). Feeling super anxious because I have no clue what the process actually involves. Anyone been through this before? I requested arbitration after they denied my appeal in April - been fighting this since February when they claimed I wasn't eligible due to 'voluntary separation' when I was actually laid off during budget cuts. The determination letter said I'd get a notice with details before the hearing but nothing has arrived yet. Will I need to prepare documents? Will they ask specific questions? Is there anything I should absolutely avoid saying? Really want to be mentally ready for whatever comes my way.

I went through an arbitration hearing last fall. It's basically like a mini court hearing. There will be an arbitrator who acts like a judge, you'll get to present your side, your employer will present theirs. Make sure you have any emails or documentation showing you were laid off and didn't quit. Also prepare a simple timeline of events. The whole thing took about 45 minutes for me. Just stay calm and stick to facts - don't get emotional or start ranting about how unfair the system is (even if it is!).

β’Thanks for the breakdown! Did you have to speak first or did your employer? And did they give you any notice about what documents to have ready?

β’The arbitrator started by explaining the process, then my former employer went first since they were contesting my claim. I went second. I got a letter about a week before with instructions, hopefully yours is just running late. Bring EVERYTHING you have - better to have too much evidence than not enough.

After weeks of not getting anywhere with ny unemployment I finally used a service called Claimyr that got me connected to an actual person on the phone. Ended up getting all my questions answered about my arbitration hearing and they even helped me prepare. Best decision I made - talking to an agent got my case moving forward so much faster than trying to figure it out myself. Check them out: claimyr.com and there's a video explaining how it works: https://youtu.be/Rdqa1gKtxuE

β’Is this for real? I've been trying to reach someone for 3 weeks straight with no luck π©

β’100% real. I was skeptical too but after trying for over a month to get through I was desperate. They call for you and when they get someone on the line, they transfer the call to your phone. Saved me hours of waiting on hold.

β’yeah right, another 'miracle solution'... what's the catch? π

β’No catch - they just do the waiting on hold part for you. I was ready to give up before trying it. The unemployment office actually helped me prepare a list of documents I needed for my hearing once I finally got through to them.

β’It worked for me! Got connected to an agent within a few hours after spending days trying to get through on my own. The agent walked me through exactly what to expect at the hearing.

Had my arbitration back in March. Here's what happened for me: got a letter about 10 days before with instructions. Hearing was on Zoom (not in person). Arbitrator was actually pretty nice and let me tell my whole story. My employer didn't even show up which automatically helped my case lol. Make sure you dress professionally even if it's virtual and have all your facts straight. I won my case and got all my backpay in about 3 weeks after the decision.

THESE HEARINGS ARE A FREAKING JOKE. I prepped for weeks and then the arbitrator basically ignored everything I said and sided with my employer who straight up LIED about why I was let go. The whole system is rigged against workers. Don't get your hopes up.

β’Sorry that happened to you. Did you have an attorney? I'm wondering if I need to hire one for mine.

β’No I didnt have a lawyer cause I couldnt afford one. Maybe thats why I lost idk. But everyone I know who's been through this says its totally hit or miss depending on which arbitrator you get.

β’Not all arbitrators are bad. I had a fair one who actually listened. I think having documentation is the key. Without proof it's just your word against theirs.

β’I HAD documentation!!!! Emails, performance reviews, everything! Arbitrator didnt even look at half of it. Just sayin, be prepared for dissapointment.

My best advice is to be SUPER organized. I created a binder with tabs for each issue they mentioned in my determination letter. I practiced what I was going to say beforehand. Be respectful and don't interrupt anyone, even when they're saying things that aren't true. My hearing was scheduled for 1 hour but only took about 30 minutes. I won my case btw.

β’The binder idea is brilliant. Did you send copies of your evidence to the arbitrator beforehand or just bring it with you?

β’I had to submit copies 5 days before the hearing (the letter explained how). But I still brought everything with me and it was good I did because they lost one of my documents π€¦ββοΈ

Just a heads up - sometimes these hearings get postponed at the last minute. Mine got rescheduled twice. Super frustrating. Make sure your contact info is up to date so they can reach you if anything changes.

β’Ugh that's the last thing I need. How long was your case delayed?

β’Almost 2 months total from original date to when it actually happened. And then another month for the decision. The whole thing is designed to wear you down so you'll give up.

For anyone struggling with ny unemployment issues including arbitration hearings, I HIGHLY recommend using Claimyr.com to actually get someone on the phone. I wasted 4 weeks trying to call myself. Used their service and got a callback with an agent in 2 hours who answered all my questions about the hearing process. Worth every penny because talking to an agent got my issues resolved quickly.

β’I was skeptical too but it literally just does the hold time for you. After 3 months of fighting with the system I was desperate enough to try anything. The agent I talked to walked me through the whole arbitration process step by step.

β’So it just calls for you? Thats it? I've been on hold so many times I literally have the hold music memorized at this point π

β’Yep, they call and wait on hold (sometimes for hours), then when a real person picks up, they connect them to your phone. Genius idea honestly. I finally got clear answers about what to expect at my hearing.

You have the right to bring a representative with you - either a lawyer or even just a friend who can take notes while you focus on answering questions. I brought my cousin who's a paralegal and it helped SO much to have another set of ears in the room.

One thing nobody mentioned yet - be prepared for technical difficulties if it's a virtual hearing! My internet cut out right in the middle of my explanation π Make sure you have a backup plan like phone data or somewhere else you can go if your wifi fails.

β’Oh man I hadn't even thought about that. My internet is pretty spotty too. Did they let you reconnect or did it hurt your case?

β’They gave me 10 minutes to fix it and I was able to rejoin. The arbitrator was understanding but it definitely threw me off my game. Maybe see if you can go to a library or somewhere with reliable internet if yours isn't great.

Here's the most comprehensive guide to NY unemployment arbitration hearings I can provide based on my experience and research: Before the hearing: - You should receive official notice 10-14 days before with specific instructions - Gather ALL documentation: emails, texts, termination letters, performance reviews, witness statements - Create a chronological timeline of events - Write out your main points but don't read from a script - If virtual, test your equipment and connection in advance During the hearing: - Be professional in dress and manner - Address the arbitrator as Sir/Ma'am or by their title - Answer questions directly - don't ramble - Stick to FACTS not emotions - Don't interrupt others - If you don't understand something, ask for clarification After: - You'll usually get a decision within 2-4 weeks - If you win, backpay processing takes another 2-3 weeks typically - If you lose, you still have options for further appeal If you're having trouble reaching someone at unemployment to get answers before your hearing, I recommend claimyr.com - they can connect you with an actual agent who can provide guidance specific to your case.

My arbitration was actually kinda chill? The arbitrator just wanted to understand what happened. It wasn't like Law & Order or anything lmao. Just be honest and you'll be fine.

β’Same! Mine took like 20 minutes and the arbitrator was super nice. I think it depends on who you get. Some people have horror stories and others have easy experiences.

whatever you do, DON'T badmouth your previous employer during the hearing! I made that mistake and it made me look unprofessional. Even if they were horrible, just stick to the facts of what happened.

I had to fight for unemployment for 8 MONTHS including an arbitration hearing. Was ready to give up until I found a way to actually talk to someone at the unemployment office using claimyr.com. After struggling to get through on my own, they got me connected to an agent who helped me understand the hearing process and what documents I needed. It was the game-changer I needed - talking to an agent helped me win my case and get all my backpay.

β’This isn't a hack though - it's literally just a service that does the hold time for you. After months of trying on my own I was desperate enough to try anything. Got through to someone who actually knew what they were talking about. So relieved I did.

β’So I was about to throw my phone after 3 hours on hold when I remembered seeing this. Tried Claimyr and got a callback with an agent in about 2 hours. They walked me through everything I needed for my hearing next week. Feeling actually prepared now.

Pro tip: if your hearing is by phone, use earbuds/headphones so your hands are free to look through your documents while talking. Sounds obvious but I didn't think of it until halfway through my hearing and was struggling to juggle everything.

Ok but has anyone actually WON one of these hearings when the employer showed up? My old boss is def gonna be there with HR and probably a lawyer. I feel like I don't stand a chance.

β’I won against my employer with their lawyer present! The key was having documentation that contradicted what they were claiming. They said I was fired for attendance issues but I had proof that my absences were approved.

β’I lost mine when going against a company lawyer. Wish I'd had my own representation. Don't underestimate how prepared they'll be.

β’It really depends on the specifics of your case. If you were genuinely laid off and have any proof, that should be enough regardless of who they bring. The burden of proof is on the employer to show why you shouldn't get benefits.
