Part time work reporting on ny unemployment - no payment when claiming 4 days?
So I've been working part time at this cafe while trying to get my benefits. Last week they had me working 4 days (Tuesday through Friday) and I honestly reported it when filing my weekly claim. I got ZERO payment from unemployment. Now they have me scheduled for all 5 days next week but only like 4-5 hours each day. Thats still way less than full time hours but I'm worried I'll get nothing again if I claim all 5 days worked. Can someone explain how this partial unemployment actually works? I'm making way less than my old job but keep getting penalized for being honest about working these few shifts. Is there a way to fix this or am I just screwed for trying to make some income while job hunting?

In NY you claim by days not hours. If you work more than 4 days, you get zero benefits regardless of hours. If you work 4 days, you get 25% of your weekly benefit. 3 days = 50%, 2 days = 75%, and 0-1 days = full benefit. It's a totally broken system that punishes part time work.

This is so messed up. So basically i'm better off only accepting 3 shifts a week max? Otherwise I end up making less overall between both sources

Yep, that's the stupidity of the NY system. A day where you work 1 hour counts the same as a day where you work 8 hours. Tons of ppl in the service industry get screwed by this.

its honestly better to find places that will give you 3 full days instead of 5 partial days. Atleast until you find something permanent

Wait is this for real?? I've been reporting my hours not days. Do i need to call them to fix this? 😳

They ask specifically how many DAYS you worked, not hours. If you've been reporting incorrectly you might have an overpayment issue. You should probably talk to someone at unemployment ASAP.

I had the exact same problem with my retail job. Was about to give up completely but found this service called Claimyr (claimyr.com) that got me an actual person on the phone at unemployment instead of waiting for weeks. The agent explained exactly how the day calculation works and adjusted some of my past claims. Worth every penny since talking to an agent got my $ unlocked so fast. They have this demo video showing how it works: https://youtu.be/Rdqa1gKtxuE

They basically call the unemployment line for you and stay on hold, then when a real person answers they connect you. Saved me like 4 hours of hold time. The agent I spoke with fixed my claim on the spot.

I get the skepticism but after 3 weeks of not getting through myself, I was desperate. Got connected to a rep in under 2 hours who actually solved my issue. Check the reviews online if you're worried.

do they need your personal info or anything sketchy like that?

They just need your phone number to connect the call when an agent picks up. You only share your personal info directly with the unemployment agent once you're connected, just like a normal call.

NY unemployment system is the WORST with part time work. So many ppl don't know this and get screwed over. I have a friend who had the same problem working at a grocery store - ended up LOSING money by picking up an extra shift. Makes zero sense.

dont work more than 3 days a week if you can help it. thats the magic number where you still get half your benefits. I had to literally turn down shifts at my restaurant job to avoid hitting that 4 day limit. Tell your manager you can only work 3 days max or you lose your unemployment.

I'll try that but not sure if they'll work with me. Already scheduled for next week. Do you know if I can change how I report for last week? I feel like I should've gotten something

The NY system is designed to keep people from working part time. It's based on days not hours which makes no sense. I actually calculated that working 4 days at 4 hours each (16 total hours) cost me more than if I'd worked 3 days at 8 hours each (24 total hours). The whole system needs an overhaul.

Here's a detailed breakdown of how the NY unemployment system works with part-time employment: The NY system uses DAYS worked, not hours, which is why you're running into trouble. Here's how it breaks down: - Work 0-1 days: Receive 100% of your weekly benefit - Work 2 days: Receive 75% of your weekly benefit - Work 3 days: Receive 50% of your weekly benefit - Work 4 days: Receive 25% of your weekly benefit - Work 5+ days: Receive 0% of your weekly benefit This system often penalizes part-time workers who work multiple days at low hours. Many people don't realize this and end up losing benefits unnecessarily. In your situation, I'd recommend: 1. Try to consolidate your hours into 2-3 days if possible 2. Speak with an unemployment representative to see if your past claim can be adjusted 3. Calculate your total income (work + potential UI) for different scheduling options Getting through to unemployment by phone can be nearly impossible. I had success using claimyr.com which got me connected to an agent who fixed my claim issues. Before that I spent weeks trying to get through on my own. Hope this helps clarify the situation for you!

If your manager is cool try to get them to schedule you for 3 longer shifts instead of 5 short ones. Explain the situation. I did this with my retail job and they were willing to work with me.

this system is such hot garbage. Like they want us to work but then punish us for working? make it make sense 🤔

Pro tip: ask for shifts that span midnight. If you work 10pm-2am, that technically only counts as ONE day worked, not two. Saved me big time when I was bartending while on unemployment.

Worked for me but your mileage may vary. The key is that NY counts the day as when you START the shift.

I actually confirmed this with an agent when I finally got through on the phone. It's a weird loophole in the system.

I know it sounds sketchy, but document EVERYTHING. If they ever come back with an overpayment claim, you'll need it. NYS loves to claim you owe them money months or years later.

One trick I learned: if you have the option to pick your schedule, try to cluster your hours into 3 days max. I went from making essentially nothing to getting at least half my benefit each week just by rearranging when I worked (same total hours).

Just a heads up, they can audit your claims at any time. Make sure whatever you report matches what your employer is reporting or you could end up owing it all back with penalties. Don't mess around with this.

Not to freak you out, but they're SUPER strict about this. If you misreport (even accidentally) they can hit you with fraud penalties later. Make sure you're claiming exactly what your employer reports.
