NYS Labor Commissioner withdrawing my unemployment determination for further fact-finding - what happens next?

Just got a letter saying the Commissioner of Labor is withdrawing my determination(s) and will do more fact-finding. The exact wording states "The Commissioner of Labor is withdrawing the determination(s) in the above case. The Commissioner will conduct further fact-finding." The letter mentions that if a new determination is issued, it will be sent to me. It also says if I disagree with any new determination, I must make a new request for a hearing. For questions about the status of any hearing requested on the withdrawn determination(s), they told me to call the Telephone Claims Center at 1-888-209-8124. I've been trying this number repeatedly but haven't had any luck getting through to anyone. The form appears to be from the Unemployment Insurance Division with a form number of AB 664.1 (5/22). Anyone else dealt with this situation before? Not sure what this means for my unemployment benefits or how long this new investigation will take. I'm getting concerned about my payments potentially being interrupted while they do this additional fact-finding. Has anyone experienced this "withdrawal of determination" process and know approximately how long I should expect to wait?

Yeahhh this happened to me last month. They basically start the whole process over and do a new investigation. Took about 3 weeks for them to send me a new determination. Keep certifying every week tho!

3 weeks?! 😫 did you get paid during that time or did everything stop?

I finally found a way to get through to someone! Used this service called claimyr.com that calls and waits on hold for you then connects you when they get an agent. costs $20 but worth it tbh. Here's a video about how it works: https://youtu.be/Rdqa1gKtxuE

sounds kinda sketchy... does it actually work? 🤔

100% legit! used it twice now. beats calling 500 times a day lol

Listen up - here's what you need to know about determination withdrawals: This usually happens when they need more info or found something that needs investigating. Key things to do: - Keep certifying weekly no matter what - Document everything - Save all letters and correspondence - Check your online account daily - If you need to talk to someone, use claimyr.com - saved me tons of time Typically takes 2-6 weeks for new determination. They'll backpay if approved. Don't panic - its pretty common these days with all the fraud prevention stuff their doing.

I went through this exact same thing about 6 months ago. The withdrawal basically means they're hitting the reset button on your case - could be because of conflicting info, new evidence, or just routine quality control. During my withdrawal period (took about 4 weeks), I kept certifying every week like normal even though payments were suspended. Once they issued the new determination in my favor, I got all the backpay for those weeks I was waiting. Pro tip: start gathering any documentation you think might be relevant now - pay stubs, employment records, emails, etc. When they do their fact-finding, having everything organized can speed things up. And yeah, definitely keep checking your online account and email daily for any requests for info. The waiting sucks but it's not necessarily a bad sign - sometimes they just need to dot their i's and cross their t's. Hang in there! 💪

This is really reassuring to hear from someone who's been through it! 4 weeks feels like forever when you're waiting but knowing you got backpay makes me feel better. Did they ask you for specific documents during the fact-finding or did you just submit everything proactively? I'm trying to figure out if I should wait for them to request stuff or just send everything now 🤔

@Keisha Brown They actually sent me a specific request letter about 2 weeks into the process asking for employment records and my resignation letter. I d'say wait for them to ask rather than overwhelming them with docs upfront - they seem to have a specific checklist they re'working through. When they do ask, respond ASAP though! I submitted everything within 24 hours and I think that helped speed things along.

I'm going through something similar right now - got my withdrawal letter about 10 days ago and still waiting. The uncertainty is definitely stressful! 😰 One thing I learned from calling around is that they're required to make a determination within 30 days of the withdrawal, so there is a timeline they have to follow. Also found out that if you had any overpayment issues or employer disputes in your file, that can trigger these withdrawals even months later. Has anyone had experience with how this affects your benefit year? Like if they take 4+ weeks to resolve this, does that eat into your total weeks of eligibility or do they extend it? Trying to plan ahead here... Thanks for posting this @AstroAdventurer - it's weirdly comforting to know others are dealing with the same thing! 🤝

@Madeline Blaze Hey! Just wanted to chime in as someone new to all this - your question about the benefit year is really smart thinking ahead! I m'also curious about this. From what I ve'been reading, it seems like the withdrawal process can be pretty nerve-wracking but at least there s'that 30-day rule you mentioned. That gives me some hope that there s'actually a deadline they have to stick to. Really appreciate everyone sharing their experiences here - makes me feel less alone in navigating this whole mess! 😅

Just want to add that I went through this withdrawal process about 2 months ago and it was honestly one of the most stressful experiences! The not knowing and waiting for payments was rough. Mine took exactly 21 days from withdrawal to new determination. A few things I wish I had known: - They sometimes send requests for additional info through regular mail (not just email), so check your mailbox daily - If you have a lawyer or someone who helped with your original claim, give them a heads up about the withdrawal - they might have insights - The online portal sometimes shows weird statuses during this time, don't panic if it says confusing things Also echoing what others said about claimyr - totally worth the $20 if you need to actually speak with someone. The regular phone lines are basically impossible to get through on your own. Stay strong everyone dealing with this! The system is definitely not user-friendly but most of these withdrawals do get resolved in the claimant's favor from what I've seen. Just document everything and respond quickly to any requests they send. 🤞

@Nia Davis This is so helpful, thank you for sharing! 21 days doesn t'sound too bad compared to some of the other timelines people have mentioned. I m'definitely going to be more diligent about checking my physical mailbox - I ve'been so focused on email and the online portal that I didn t'even think about regular mail. The tip about the online portal showing weird statuses is good to know too, I ll'try not to read too much into whatever confusing messages pop up there. Really appreciate you taking the time to share your experience! 🙏

Going through this exact same thing right now and it's honestly so nerve-wracking! Got my withdrawal letter about a week ago and have been obsessively checking my online account every day since. 😅 Reading everyone's experiences here is really reassuring though - sounds like most people do get resolved in their favor eventually. The 30-day timeline @Madeline Blaze mentioned gives me some hope that there's actually a deadline they have to meet. One question for those who've been through this - did you guys notice any pattern in what triggers these withdrawals? Like was there something specific in your case that might have flagged it for review? Trying to figure out if this is just random quality control or if there was something I should have done differently. Also definitely going to start checking my physical mailbox daily now after @Nia Davis's tip! I've been so focused on digital communications that I totally overlooked regular mail. Thanks @AstroAdventurer for starting this thread - it's so helpful to know we're not alone in dealing with this bureaucratic maze! 🤝
