New York Unemployment denied due to fake attendance records - employer lying about absences
My employer denied my unemployment claiming excessive absences but their records are wrong. They counted covid quarantine days, work from home days, and even marked me absent on days that don't exist (June 31st). They also counted Saturdays when our office is closed. Nothing in the employee handbook specifies what excessive means. Requested a hearing but still waiting. Need advice on fighting this.

omg same thing happened to me! my employer tried to say i had 15 absences but they counted days I was actually on approved vacation 🤡 I won my hearing btw. Make sure you bring all documentation showing the errors. Print out a calendar marking all the wrong dates they listed.

Employment lawyer here. This is actually pretty common. NY law doesn't define 'excessive absences' specifically, but they can't count protected leave like COVID quarantine or approved medical leave. Document EVERYTHING. Get written proof of your WFH days. Calendar screenshots, emails, anything showing you were actually working those days. Also that June 31 error is a gift - use it to show their records are unreliable.

I had something similar but with different dates. Took it to hearing and won BUT it took 3 months to get the hearing scheduled. Start documenting everything now. Also if u have any coworkers who can verify you worked those WFH days get their statements NOW before people forget or move on to other jobs.
