New York Unemployment denied because I quit previous job, but was laid off from new job - help!

Got approved for unemployment after being laid off from my new job in March, but now my old employer is fighting it saying I quit back in January. Yes, I did quit the old job for a better opportunity but then got laid off from the new place. Got paperwork in the mail to fill out. Anyone dealt with this before and got approved? Need advice on what to do.

You should be fine. I had literally the exact same situation. As long as you worked enough hours at the new job to qualify (like 4-6 weeks i think), your old job quitting doesnt matter. Just explain everything clearly in the paperwork they sent you and make sure to mention the layoff was no fault of your own.

Nope, no hearing needed in my case. Just filled out the forms honestly and got approved about 2 weeks later

Hey I found a way to actually get someone on the phone at unemployment to help sort this out. Used this site called claimyr.com - it calls and waits on hold then connects you when someone picks up. You need enough earnings from the new job to establish a claim 2. The separation from your MOST RECENT employer must be qualifying (layoff = qualifying) 3. Document everything - dates, reason for layoff, etc 4. If they schedule a hearing, SHOW UP! Protip: Use claimyr.com to get an agent on the phone to review your case. In NY you need to earn 10x your weekly benefit rate in covered employment. Usually works out to about 4-5 weeks full time work
