NYS Department of Labor unemployment insurance origins - which new deal law established the system?
I'm doing research for a college paper on unemployment benefits and need to know which New Deal legislation created the unemployment insurance system we use today through NYS Department of Labor. I know it also set up pensions for retired workers but can't remember if it was the same law or different ones. My professor wants specific details about the original framework that states like New York built their UI systems on. Anyone know the exact name of the legislation?

The Social Security Act of 1935 is what you're looking for. It established both the unemployment insurance program (Title III) and old-age pensions (what we now call Social Security). The unemployment portion created the federal-state partnership system that NYS Department of Labor operates under today. Each state runs its own UI program but follows federal guidelines.

•Perfect, thank you! So NYS Department of Labor's current unemployment system traces back to that 1935 framework?

yep social security act. thats why when you file unemployment through NYS Department of Labor they ask for your social security number - the whole system was designed around that identifier from the beginning

Just to add some context for your paper - the 1935 Act created the basic structure, but states like New York had to pass their own implementing legislation. New York's Unemployment Insurance Law was enacted in 1935 to comply with the federal requirements. That's why NYS Department of Labor has some unique features compared to other states while still following the overall federal framework.

•This is really interesting background. I never knew the unemployment system was that old. Makes sense why some of the NYS Department of Labor processes seem outdated sometimes!

For your research you might want to look into how the original 1935 system has evolved. The basic UI structure is the same but things like extended benefits during recessions, work search requirements, and online filing through NYS Department of Labor are all much more recent additions to the original New Deal framework.
