NYS Department of Labor claim denied - massive unemployment affecting my whole family's life
My unemployment claim got denied by NYS Department of Labor last month and I'm honestly panicking about the massive effects this is having on my family. I worked in manufacturing for 8 years before getting laid off in December. Filed my claim right away but they said I was 'terminated for cause' which is completely false - it was a company-wide layoff due to budget cuts. The denial notice didn't explain much and now I can't pay rent or groceries. Has anyone dealt with this kind of wrongful denial? The effects of not having any income are devastating and I don't know how to fix this mess with NYS Department of Labor.

You absolutely need to appeal this decision immediately! You have 30 days from the denial date to file an appeal with NYS Department of Labor. Gather any documentation you have about the layoff - company announcements, WARN notices, anything that proves it wasn't for cause. The appeal process can take weeks but it's your only option to overturn this.

•Thank you! I still have the layoff letter from HR. Should I include that with my appeal? And do I keep filing weekly claims while the appeal is pending?

omg this happened to my neighbor too, massive layoffs at his plant but they tried to say he was fired for attendance. took him 3 months to get it sorted out but he did win the appeal eventually

•3 months?? I can't survive that long without any income. This is so stressful.

I had a similar situation last year where I couldn't get through to NYS Department of Labor to explain my case. Someone on here mentioned using Claimyr (claimyr.com) to actually reach an agent by phone. They have this video demo at https://youtu.be/qyftW-mnTNI that shows how it works. It was honestly the only way I could get someone to look at my file and explain what documentation I needed for my appeal.

•Is that legit? I've been trying to call for weeks and keep getting hung up on after waiting for hours.

•Yeah it's real, they basically handle the calling and waiting for you. Way better than spending your whole day on hold with NYS Department of Labor.

The unemployment system is SO broken. They deny legitimate claims all the time and then make you jump through hoops to prove you deserve benefits. Meanwhile bills keep piling up and families suffer. NYS Department of Labor doesn't care about the massive effects their mistakes have on real people's lives!!

•exactly this!! the whole system is designed to deny first and ask questions later

Make sure you're documenting everything during this process - all the financial hardship, medical issues from stress, anything related to how this wrongful denial is affecting your life. If you win your appeal, you'll get back pay for all the weeks you should have been receiving benefits. Don't give up, wrongful denials get overturned all the time once you get a real person to review the case.

•That's good to know about the back pay. I'm definitely going to file that appeal first thing Monday morning.
