NYS Department of Labor claim delayed after company closure - how to reverse unemployment denial?
My employer shut down last month due to supply chain issues and I filed for unemployment immediately. NYS Department of Labor initially denied my claim saying I was terminated for cause, but that's completely wrong - the whole facility closed permanently. I appealed the decision but haven't heard anything back in 3 weeks. My adjudication status just shows pending with no updates. Has anyone dealt with reversing an incorrect denial when your company had to shut down operations? I really need help figuring out how to get this fixed because I can't afford to wait much longer.

You definitely have grounds for appeal since business closure isn't termination for cause. Make sure you have documentation of the closure - news articles, company announcements, anything showing it was a business decision not related to your performance. The adjudication process can take 4-6 weeks especially when they need to verify employer information.

Had the exact same thing happen when my manufacturing job ended due to material shortages. NYS Department of Labor automatically codes some closures wrong in their system. You need to upload all your documentation to your my.ny.gov account and also try calling to speak with an adjudicator directly. I know the phone lines are terrible but sometimes you can get through early morning.

When you say supply chain issues caused the closure, are you sure it wasn't considered a temporary layoff initially? Sometimes companies file the wrong paperwork with NYS Department of Labor and it creates these classification problems. You might want to check what your former employer actually reported as the reason for separation.
