NYS Department of Labor asking about annual federal unemployment tax return - confused about form 940
I'm trying to file my weekly claim and the NYS Department of Labor system is asking me about something called the annual federal unemployment tax return. I think they mean form 940? I'm so confused because I thought that was something only employers file, not people claiming unemployment benefits. Has anyone else seen this question on their weekly certification? I don't want to mess up my claim by answering wrong but I have no idea what they're asking for.

You're absolutely right to be confused - Form 940 is indeed something employers file, not unemployment claimants. This sounds like either a system glitch or you might have accidentally clicked into an employer portal section. The annual federal unemployment tax return (Form 940) is what employers use to report their FUTA tax liability. As a claimant filing weekly certifications, you shouldn't be seeing this question at all.

Clear your browser cache and try again. Sometimes the NYS Department of Labor website gets confused between employer and claimant portals, especially if you've been on different parts of the site. Make sure you're logging into the regular my.ny.gov portal for weekly claims, not any employer sections.

If clearing your cache doesn't work, you might need to contact an NYS Department of Labor agent directly. I had a similar issue where the system was mixing up different types of forms and I couldn't get through on the phone for weeks. Just to clarify for anyone else reading - Form 940 is specifically the Employer's Annual Federal Unemployment (FUTA) Tax Return. Employers use it to report wages subject to FUTA tax and calculate their annual FUTA tax liability. As unemployment claimants, we have nothing to do with this form. If you're seeing it on your weekly claim, it's definitely a system error that needs to be fixed.
