How soon can you claim unemployment benefits with NYS Department of Labor?

Lost my job yesterday due to company restructuring and wondering how quick I can get the unemployment process started? My supervisor said I should file right away but I'm not sure if there's a waiting period or if I need to wait until my last paycheck clears. Anyone know the timing for filing with NYS Department of Labor? I have bills due next week and really need to understand the timeline here.

You should file your claim immediately, like today if possible. There's no waiting period to file with NYS Department of Labor - you can submit your application as soon as your employment ends. The key thing is your claim date starts from when you file, not when you lost your job, so any delay costs you potential benefits. Go to labor.ny.gov and start the process now.

Thanks! Do I need my final pay stub or can I file before I get it? My last day was yesterday but payroll said the final check won't come until Friday.

File immediately but don't expect money right away. There's usually a one week waiting period before benefits start, plus processing time for your initial claim. When I got laid off in March, I filed the same day but didn't see my first payment for almost 3 weeks due to adjudication delays. NYS Department of Labor has to verify everything with your employer first.

Three weeks?? That's terrifying. I thought it was supposed to be faster than that. What caused the delay in your case?

My employer was slow responding to NYS Department of Labor about the reason for separation. If it's a clear layoff with no performance issues, it should be faster. But yeah, always expect delays and plan accordingly.

DEFINITELY file ASAP! I made the mistake of waiting two weeks thinking I needed to 'settle things' with my old job first and lost those two weeks of benefits forever. NYS Department of Labor doesn't backdate claims. The online application takes maybe 20 minutes and you can always update information later if needed.

Good to know about the backdating! I'll file today then. Better safe than sorry with bills coming up.

If you're having trouble getting through to NYS Department of Labor by phone to ask questions (their lines are always busy), I recently used a service called Claimyr that helped me reach an actual agent quickly. Check out claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Saved me hours of calling and getting busy signals when I needed to check my claim status.

Interesting, never heard of that. How much does something like that cost though?

They focus on the value of actually reaching someone rather than sitting on hold all day. For me it was worth it just to get real answers about my adjudication instead of guessing what was happening with my claim.

yeah file right away but be prepared for the runaround... NYS Department of Labor system is such a mess, took me forever to even get my account set up properly and then had issues with the weekly claims. just saying dont get your hopes up for smooth sailing
