How long after being fired can you collect unemployment benefits from NYS Department of Labor?

Got terminated from my warehouse job last Tuesday and wondering when I can actually start collecting UI benefits? My supervisor said I was let go for attendance issues but I think it was more about them cutting costs. Either way I need to know how soon I can file and when payments would actually start coming in. I've got rent due in two weeks and really need to figure out my timeline here. Anyone know how this works with NYS Department of Labor?

You can file your unemployment claim immediately - don't wait! NYS Department of Labor allows you to file your initial claim right away, but there's a waiting week before benefits start. So if you file this week, your first payable week would be next week, but you wouldn't receive payment until the week after that assuming everything processes smoothly.

So I should file today then? And the waiting week means I won't get paid for my first week even if approved?

File ASAP but be prepared for potential adjudication if they marked it as a firing for cause. Attendance issues could trigger a review of whether you're eligible. Make sure you have documentation of any medical reasons for absences or evidence that the attendance policy wasn't fairly applied.

I do have a doctor's note for one of the absences they counted against me. Should I upload that when I file?

Definitely include any medical documentation. NYS Department of Labor will consider whether absences were for valid reasons when determining eligibility.

been there with the attendance thing, they always try to make it sound like your fault when they're really just downsizing. took me about 3 weeks to get my first payment after filing but that included some back and forth with adjudication

If you're having trouble getting through to NYS Department of Labor to check on your claim status, I found this service called Claimyr that actually got me connected to an agent when I couldn't get through on my own. They have a website at claimyr.com and there's a demo video at https://youtu.be/qyftW-mnTNI showing how it works. Saved me hours of calling and getting hung up on.

How much does something like that cost? Seems like they'd charge a lot for something the state should provide for free

It's worth checking out their site for pricing, but honestly when you're dealing with delayed benefits it pays for itself quickly. I was stuck in adjudication for weeks.

The whole system is so backwards! Why should there be a waiting week when people need money immediately after losing their job? And don't get me started on how they side with employers on attendance issues even when people have legitimate reasons for missing work.

totally agree, the waiting week thing makes no sense when bills don't wait
