Can u collect unemployment if u quit your job in New York?

hey everyone so i'm thinking about quitting my job because my boss is making my life miserable but i need to know if i can still get unemployment benefits? i've been working there for like 2 years and pay into the system so shouldn't i be able to collect? does anyone know the rules about this in NY?

Generally, if you quit voluntarily, you won't qualify for unemployment benefits unless you have what NYS Department of Labor considers 'good cause.' This includes things like unsafe working conditions, harassment, significant changes to your job duties, or constructive discharge situations. You'd need to document everything and be prepared to prove your case during the adjudication process.

what counts as harassment? my supervisor yells at me constantly and makes comments about my appearance. would that be enough?

I quit my job last year because of a hostile work environment and got approved for benefits, but it took forever. You need to file your claim right away and explain in detail why you quit. NYS Department of Labor will investigate and might contact your employer. Make sure you have emails, texts, or witness statements if possible.

How long did the adjudication take? I'm in a similar situation and wondering if I should just stick it out or quit and file.

Mine took about 6 weeks to get resolved. During that time I couldn't get any payments so make sure you have some savings to cover bills.

this is so frustrating! i tried calling NYS Department of Labor to ask about this exact situation but could never get through to anyone. spent hours on hold just to get disconnected. how is anyone supposed to get real answers about whether quitting qualifies you?

I had the same problem trying to reach someone at NYS Department of Labor about my claim. Found this service called Claimyr that actually got me through to an agent in like 10 minutes. They have a website at claimyr.com and there's a demo video at https://youtu.be/qyftW-mnTNI showing how it works. Might be worth checking out if you need to talk to someone about your specific situation.

just quit if you hate it life's too short!! i quit tons of jobs and always figured something out

That's not good advice when it comes to unemployment benefits. There are specific legal requirements that determine eligibility, and quitting without good cause can disqualify you from receiving benefits you might desperately need.

I'm dealing with something similar where my hours got cut to basically nothing and my boss is being hostile when I ask for more work. Would that count as constructive discharge? I feel like I'm being forced to quit but technically they haven't fired me.

Constructive discharge can qualify you for benefits if you can prove the employer made working conditions so intolerable that a reasonable person would feel compelled to quit. Document everything - the hour reductions, hostile behavior, any communications. NYS Department of Labor will review all the evidence during adjudication.

ugh the whole system is so complicated! why can't they just make it simple - if you worked and paid in you should get benefits period. instead its all these rules and investigations and waiting around for months
