Can I reapply for NY unemployment after my benefit year ends if I haven't worked since?
I've been collecting unemployment since May 2021 when I lost my job due to our company downsizing. My benefit year is ending next month and I still haven't found work despite applying to literally hundreds of places. My question is - can I reapply for a new claim in October even though I haven't worked at all during this benefit year? I'm really worried because these payments are the only thing keeping me afloat right now. I've got rent and utilities piling up, and the job market in my field is still terrible. Anyone know if there's some work requirement before you can file again? The website is super confusing about this and I can't get through on the phone.

Unfortunately you need to have worked during your benefit year to qualify for a new claim. You need to have earned at least 10x your weekly benefit rate in covered employment to establish a new claim. If you haven't worked at all, you won't be eligible for a new claim period.

•Well that's depressing news. What am I supposed to do now? There are barely any jobs in my field and I've been applying everywhere.

•This is why the system is so messed up. They expect people to magically find jobs when there aren't any available. it's ridiculous 🤦♀️

•Try looking into state assistance programs like SNAP or emergency rental assistance. Not ideal but might help bridge the gap until you find work.

I was in the exact same boat last month. I couldn't get through to anyone on the phone for answers - kept getting disconnected. Finally tried this service called Claimyr (claimyr.com) and they got me connected to a live agent who sorted everything out. Talking to the rep got my issue resolved in like 10 minutes - best decision after weeks of frustration! They have a video explaining how it works too: https://youtu.be/Rdqa1gKtxuE

•Is this actually real or just another scam trying to take advantage of desperate people? 🧐

•Totally get the skepticism, I was hesitant too. But it actually worked - they basically wait on hold for you and then call you when they get through to an agent. Saved me hours of hold music hell.

•wait hold up - does this actually work or is it just the usual BS? I've been trying to reach someone for 3 weeks now

•Yeah it works. I was shocked too. The hold times are insane right now but they somehow get through faster. Talking to a real person made all the difference for my claim.

•I've been burned by so many of these 'services' before... what makes this different from all the other unemployment 'helpers'?

•The difference is they don't claim to fix your unemployment issues themselves - they just connect you with actual DOL agents who can. All they do is solve the phone problem, which was the biggest hurdle for me.

the main rule is you need to have worked and earned wages in at LEAST 2 calendar quarters during your base period to qualify for a new claim. If you haven't worked at all since yr last claim, ur probably not eligible for a new one. Sorry dude thats how it works.

You should call and ask them directly. The rules change all the time and theres so much misinformation out here. I spend 2 days calling nonstop before I got someone on the phone last time I had a question.

•Good luck getting through on the phone lol. I tried for weeks and kept getting disconnected or told to call back later.

•Pro tip: call exactly at 8:00 am when they open. I got through after only 20 min on hold that way.

Hey I went thru this exact thing in June. I had been on unemployment since April 2021 and when my benefit year ended, I tried to file a new claim. The system automatically reviews your work history, and if you haven't worked enough during the benefit year, you'll get a determination letter saying you're ineligible for a new claim. I recommend: 1) Apply anyway - sometimes there are exceptions 2) Be prepared for a denial 3) Look into emergency assistance programs through your county 4) Contact your local state rep's office - mine helped me navigate alternatives 5) Consider taking ANY job temporarily even outside your field If you absolutely need to speak with someone, claimyr.com was the only way I managed to get through on the phone. The unemployment system is completely overwhelmed still. This situation is so stressful, I know. But you're not alone in this.

•Thank you for such a detailed response. Did you end up finding any programs that helped after your benefits ran out?

•Yes! I got on SNAP benefits (food stamps) which helped a lot. Also check out HEAP for utility assistance and your county should have emergency rental assistance too. The waiting lists can be long so apply ASAP.

The ny unemployment system is such a joke. They make it impossible to get answers and then penalize you when you do something wrong because you couldn't get clarification. 😡

•THIS!!! I spent 3 months fighting with them over a simple question that could have been resolved in 5 minutes if anyone would pick up the damn phone.

•It's designed to be difficult on purpose... they hope people just give up rather than get the benefits they deserve.

•exactly! if they spent half as much energy fixing the system as they do making it complicated we'd all be better off

I believe you can apply for an extension in certain circumstances even if you havent worked. At least thats what my neighbor told me happened with her claim. Might be worth trying to apply and see what happens?

•The extensions ended last year. That was a COVID thing and it's gone now.

When my benefit year ended I just applied anyway and got denied, but then I found out about the 597 form you can request if you're facing financial hardship. It doesn't guarantee anything but worth trying. You have to call to request it tho.

•What's the 597 form? I've never heard of this and I've been dealing with unemployment for ages.

•It's a hardship review form. Not widely advertised (of course) but it exists. You have to specifically ask for it when you talk to a rep.

You could also look into whether you qualify for disability if you have any medical conditions. The pay is lower but at least its something if ur running out of options.

In theory ur supposed to be actively looking for work while collecting unemployment so if youve been on it since 2021 and havnt found ANY work in all that time... they might question that. Just saying.

•I HAVE been looking for work. I've applied to over 200 jobs in my field and even retail/service jobs. Nobody's hiring or they pay so little I couldn't even cover my rent.

•Sorry, wasn't trying to be a jerk. The job market is brutal right now. Just meant that they might ask for proof of your job search if you reapply.

•No worries. I've been keeping track of all my applications. It's just been really discouraging.

I filed a new claim after my benefit year ended with no new work and got denied. Then I called (finally got through after using claimyr.com) and found out I could appeal the decision. Still waiting to hear back on my appeal but at least I have a chance.

I'm so sorry you're going through this - the stress of potentially losing your only income source is unimaginable. From what I've researched, NY requires you to have earned wages in at least 2 quarters during your base period to qualify for a new claim. Without any work since May 2021, you likely won't meet this requirement. However, don't give up completely! Here are some steps I'd suggest: 1. Apply anyway - sometimes there are exceptions or the system might find qualifying wages you forgot about 2. If denied, you can appeal the decision 3. Look into emergency assistance programs immediately - SNAP, HEAP for utilities, and county rental assistance 4. Contact your local state representative's office for help navigating resources 5. Consider contacting legal aid organizations that help with unemployment issues The phone system is definitely broken, but if you absolutely need to speak with someone, several people here have mentioned success with claimyr.com for getting through to actual agents. You're not alone in this situation - many people are facing the same impossible choice between taking jobs that don't pay enough to survive and losing benefits entirely. Stay strong and explore every option available to you.

•This is such helpful advice, thank you Carmen! I'm definitely going to look into those emergency assistance programs right away. Do you know if there are any income limits for SNAP or if unemployment benefits count against the eligibility? I'm worried they might say I make "too much" even though it's barely enough to survive on.

I'm in a similar situation and just went through this process last month. The harsh reality is that without any work during your benefit year, you won't qualify for a new regular unemployment claim in NY. You need to have earned at least 10x your weekly benefit amount in covered employment during your base period. However, here's what I learned that might help: 1. Apply anyway - sometimes there are system glitches or overlooked wages that could work in your favor 2. If denied, you have the right to appeal within 30 days 3. Ask specifically about the 597 hardship review form when you call (as mentioned by The Boss above) 4. Start applying for emergency assistance NOW - SNAP, HEAP, emergency rental assistance through your county 5. Contact your local One-Stop Career Center - they sometimes have emergency funds or job placement programs 6. Look into temporary staffing agencies - even short-term work could help you qualify for future claims The system is absolutely broken and designed to discourage people from getting help. Don't let that stop you from fighting for what you need. Document everything, keep records of all your job applications, and don't give up. You've made it this far - you're stronger than you know.

•Thank you Benjamin, this is incredibly thorough and helpful! I had no idea about the One-Stop Career Centers or that they might have emergency funds. I'm definitely going to look into that along with the 597 form. It's frustrating that these resources aren't more widely advertised - feels like you have to know someone who knows someone to find out about them. I really appreciate you taking the time to share your experience and give such detailed advice. It gives me hope that there might be some options I haven't explored yet.

I went through this exact situation last year and it's absolutely terrifying when you're facing the end of benefits with no work history. The reality is NY does require wages during your benefit year to qualify for a new claim, BUT don't lose hope completely. Here's what worked for me: 1. Applied anyway (got denied as expected) 2. Immediately appealed the denial 3. During the appeal process, I got connected with a local workforce development program that helped with emergency rent assistance 4. Found a part-time gig through a temp agency - even just a few weeks of work can sometimes help establish eligibility The appeals process bought me crucial time to find other resources. Also, call 211 - they have a database of local emergency assistance programs that many people don't know about. Some churches and community organizations also have emergency funds. I know it feels hopeless right now, but there are more safety nets than it initially appears. You just have to dig deeper to find them. Don't give up - you deserve support while you keep searching for work in this brutal job market.
