real wage unemployment is when your job pays so little you cant afford basic stuff even while working full time!! its different from regular unemployment where you just dont have a job. the government doesnt really track this kind properly
The whole system is such a mess. I tried to reapply last month and they're saying my wages don't count or something even though I definitely worked. Now I'm stuck in adjudication AGAIN. NYS Department of Labor makes everything so complicated for no reason.

THE WHOLE SYSTEM IS SET UP TO CONFUSE SMALL BUSINESS OWNERS! They make it so complicated with all these different thresholds and requirements. Why can't they just have ONE place to register for everything instead of making us jump through hoops with federal AND state agencies?
To answer your specific question - yes, you're likely already liable based on what you described. With two employees, you should register with NYS Department of Labor immediately and start tracking your quarterly wages. For federal, if you're paying more than $1,500 in any quarter, you'll need to file Form 940. Better to register early and stay compliant than deal with penalties later.

The NYS Department of Labor system is so confusing about these requirements! I've been working gig jobs for over a year and still wasn't sure if I qualified when my main contract ended. Turns out as long as you have W-2 or 1099 income during the base period quarters, you should be fine. Don't let the uncertainty stop you from applying.
