The unemployment rate statistics you see in the news (like 3.8% or whatever) don't tell the whole story about how many people are actually dealing with the NYS Department of Labor system. That percentage is based on surveys, but the actual number of people filing claims, appealing decisions, or dealing with overpayment notices is much higher. Plus those stats don't capture people whose benefits expired or who gave up navigating the system.
Yeah my cousin works at one of the NYS Department of Labor offices and she says they're constantly backlogged. Even when unemployment rates look good on paper there's still tons of people cycling through the system - seasonal workers, people between jobs, folks dealing with reduced hours. The numbers you see publicly are just a snapshot.
This reminds me of what happened during the pandemic when unemployment spiked but then dropped really fast in some areas. Employers were offering crazy signing bonuses because they couldn't find workers anywhere. Restaurants were closing early, construction projects got delayed. Even though unemployment was low, it created other problems.
Makes sense from a macro perspective but honestly the NYS Department of Labor system seems designed like they WANT some people to stay unemployed longer with all the bureaucracy and delays...

DOCUMENT EVERYTHING! I cannot stress this enough. NYS Department of Labor will scrutinize voluntary quits very carefully. Get doctor's notes, save those emails, maybe even consider filing a complaint with your state labor department about the working conditions first. The more paper trail you have showing the employer created an unsafe or unreasonable work environment, the better your chances.
same boat here... my job is killing me slowly but i'm terrified to quit without something else lined up. this whole system is so backwards - they expect us to stay in jobs that are literally making us sick

The whole system is rigged against workers. Employers know most people can't afford to fight these contests so they just lie and hope you give up. I've seen companies claim 'misconduct' for everything from being 5 minutes late to disagreeing with management. It's disgusting.

•While employer abuse definitely happens, NYS Department of Labor does investigate these claims thoroughly. The adjudication process exists specifically to sort out legitimate claims from fraudulent ones.

Don't give up! I went through this last year and it took 6 weeks but I eventually won my appeal. Document everything and be prepared for your phone interview with specific dates and details.
