Just whatever you do dont lie about the dates or try to hide the gap. HR departments can verify employment history easily now. Be upfront about being laid off, mention any productive activities during the unemployment period, and emphasize that you're ready to get back to work. Most reasonable employers will understand that good people sometimes get caught up in layoffs.
Wait, I'm confused about something. If I'm getting workers comp but my doctor says I can work, why wouldn't I be able and available? Seems like the NYS Department of Labor rules don't make sense here.

The 'when' really depends on WHY you're unemployed. Layoffs = immediate eligibility. Firing for performance = usually eligible after adjudication. Quitting = very limited eligibility unless you can prove good cause. just wanted to add my experience - i was able to file immediately when i got laid off but it still took forever for my first payment because of some stupid adjudication thing. the whole process is such a nightmare honestly
