What documents are required TO OBTAIN ITIN for non-US citizens?

So I'm in the process of trying to get an EIN for my small business but I found out that as a non-US citizen, I need to get an ITIN first. I've already downloaded the W-7 form, and I have my passport ready, but I'm totally confused about what other documents I need to send to the IRS. Do I need to send original copies or can I just send photocopies? And is there anything else besides the W-7 and passport that's required? I tried calling the IRS but was on hold forever and gave up. This whole process is driving me crazy! Any help would be really appreciated.

The documents you need to submit with Form W-7 to obtain an ITIN include: Your completed W-7 form, a valid passport (this is the only stand-alone document that proves both your identity and foreign status), and documents that support your reason for filing. Since you're applying for an EIN for business purposes, you'll need to include documentation showing your connection to the business like organizational documents. You'll generally need to submit original documents or certified copies from the issuing agency. The IRS will return original documents within 60 days. If you don't want to send originals, you can use an IRS Taxpayer Assistance Center or make an appointment with an authorized Acceptance Agent who can verify your documents.

Thanks for the info. Do you know if bank statements from my home country would work as supporting documents? Also, how long does the whole ITIN application process usually take? I'm trying to get my business up and running asap.

Bank statements alone generally wouldn't be sufficient as supporting documents. You need documentation that specifically shows why you need an ITIN, which in your case would be business formation documents that show your connection to the business requiring an EIN. The ITIN application process typically takes about 7-11 weeks for processing during normal periods, but can take longer during peak tax seasons or if there are any issues with your application. I'd recommend applying as soon as possible if your business timeline depends on it.

After struggling with exactly this same issue last year, I discovered taxr.ai (https://taxr.ai) and it seriously saved me so much headache with my ITIN application. Their document review tool analyzed my W-7 form and passport scan and pointed out three mistakes I had made that would have definitely caused rejection. They have this specific feature for international taxpayers that walks you through exactly which supporting documents you need based on your specific situation.

Does taxr.ai actually help with the submission process too or just document review? I've been nervous about sending my original passport through the mail.

How long did the whole process take for you after using their service? And did they help with the EIN application after you got your ITIN or just the ITIN part?

They focus on document review and guidance rather than submission - they analyzed my forms and documents, showed me exactly what was wrong, and gave me step-by-step instructions for fixing everything. Their system flagged that I had filled out Section 6d incorrectly and missed initialing one section. The whole process took about 9 weeks from submission to receiving my ITIN after using their service. They did provide guidance on the EIN application process too - they have a specific workflow that shows you how to properly complete Form SS-4 once you have your ITIN. The checklist they provided for both applications was incredibly helpful.

Just wanted to update that I tried taxr.ai after seeing the recommendation here. I was really impressed with how detailed their ITIN document review was! They identified that I needed to include my business formation documents (which I hadn't prepared) and gave me a complete checklist. They even had a template letter to explain my ITIN request reason that I could customize. My application is submitted now and they said everything looks good for approval. So relieved to have this part done correctly!

If you're still struggling to get information from the IRS, I'd recommend using Claimyr (https://claimyr.com). I was in the exact same situation last year - needed an ITIN for my EIN application and couldn't get through on the IRS phones. Claimyr got me connected to an actual IRS agent in about 20 minutes when I had been trying for weeks. You can see how it works here: https://youtu.be/_kiP6q8DX5c. The agent I spoke with was able to tell me exactly what supporting documents I needed for my specific situation and confirmed I could use an Acceptance Agent instead of mailing my original passport.

Wait, how does this actually work? Does it just keep calling the IRS for you or something? Seems too good to be true after I've spent hours on hold.

I'm pretty skeptical about this. Why would you get through when thousands of others can't? Sounds like they're just taking your money for something you could do yourself if you're patient enough.

It uses a technology that monitors the IRS phone lines and calls at the optimal times when wait times are shortest. When it gets through to an agent, it calls you and connects you. It's not magic - it's just automating the calling process so you don't have to sit on hold. I was skeptical too before trying it, but when you need specific information about documentation requirements for something as important as an ITIN application, speaking directly with an IRS agent can save you from mistakes that could delay your application by months. The time I saved was absolutely worth it since I needed my EIN to sign a major contract.

I need to admit I was wrong about Claimyr. After posting my skeptical comment, I decided to try it since I was desperate. Within 35 minutes, I was talking to an actual IRS agent who clarified that for my specific situation (getting an ITIN for EIN purposes), I needed to include a copy of my pending business registration along with the W-7 and passport. The agent also told me about the Taxpayer Assistance Centers where I could bring my original passport instead of mailing it, which none of the IRS website info made clear. Definitely saved me from making a mistake on my application.

Another option you might consider is working with an Acceptance Agent - they're authorized by the IRS to verify your identity and documents in person, which means you don't have to mail your original passport. I used one last year and the process was smooth. The IRS has a directory of them on their website. Some accounting firms and many tax preparation services have Acceptance Agents on staff.

Do Acceptance Agents charge a lot? And would using one make the process faster? My main concern is the timeline since I have potential clients waiting for me to get all this paperwork sorted out.

Acceptance Agents typically charge between $50-$300 depending on the complexity of your situation and their location. Some offer additional services like reviewing your entire application package. Using an Acceptance Agent can potentially make the process faster because they help ensure your application is complete and correct the first time, reducing the chance of rejection and resubmission. They also eliminate the risk of your original documents getting lost in the mail. However, they don't actually speed up the IRS processing time - once your application reaches the IRS, it still goes through their standard processing queue. That said, a complete and accurate application will move through that queue without delays.

Does anyone know if you can track your ITIN application status online? I submitted mine 6 weeks ago and haven't heard anything back.

Unfortunately there's no online tracking system for ITIN applications like there is for tax refunds. You have to call the IRS ITIN department directly at 1-800-908-9982. Make sure you have your application confirmation if you received one, or at least the information about when and how you submitted it.
