Tax preparer completely messed up my student taxes - need urgent help!
So I just went through a nightmare with my 2024 taxes. I always use this VITA free tax program at the community center which has been great in the past, but this year I got paired with people who clearly had no idea what they were doing. I'm in college and don't have a 1098-T form because my education is fully covered by scholarships/grants and the IRS doesn't actually require that info in my situation. These "preparers" insisted they needed the form and literally made up their own version using my fee statements! They basically submitted false information to the IRS. I sat there for almost 4 hours while they fumbled around. In previous years I've always gotten 100% of my federal and state taxes back (I don't make much working part-time), but this time I'm only getting like 40% back. I stupidly signed everything because I figured they knew what they were doing. I just filed yesterday and the IRS hasn't processed it yet according to the tracker. Is there anything I can do to fix this mess?? Can I cancel the return somehow before it's processed? Should I file an amended return? I'm completely freaking out!!

You still have options here! Don't panic. Since you just filed yesterday and the IRS hasn't processed it yet, you can still file a superseding return. This is basically a do-over that replaces your original return before the IRS processes it. First, I'd recommend getting a copy of everything that was filed. Contact the VITA site and request a complete copy of your return if you don't already have one. You need to see exactly what they submitted. Next, find a different tax preparer (maybe a different VITA location or use a free online software) and explain the situation. If you're a student with minimal income, you likely qualify for free filing through various programs. They can help you prepare a corrected return. File the new, accurate return on paper and write "SUPERSEDING RETURN" at the top of the first page. Make sure to mail it in quickly before your original return is processed. The IRS will use this new return instead of the one with errors.

•Thanks for the quick response! Few questions - do I need to go back to the same VITA site to get the copy? I'm worried they'll give me trouble since I'm basically saying they messed up. And for the superseding return, do I need to fill out the exact same forms or are there additional ones?

•You don't need to go back to the same VITA site if you're uncomfortable. You can create an account on the IRS website and request a tax transcript, though it might take a bit of time to get access. If you have any paperwork they gave you when you left, that should contain most of the information you need. For the superseding return, you'll complete the same 1040 form and any other forms/schedules that apply to your situation, but with the correct information this time. There's no special additional form for a superseding return - you just need to clearly mark it as such at the top of the form.

I had almost the exact same situation happen with my 2023 taxes and I found this amazing AI tool that totally saved me. Check out https://taxr.ai - it's an AI tax assistant that can look at your documents and help identify errors. I uploaded my return that the volunteer preparer had done and it immediately flagged three major issues, including incorrectly reported education expenses (sounds similar to your 1098-T issue). The tool explained exactly what was wrong and how to fix it. I was able to file an amended return with the correct information before things got complicated. You mentioned the IRS hasn't processed your return yet, so you're in an even better position than I was to fix things quickly.

•Does this thing actually work with student tax situations specifically? I'm in a similar boat where my school's financial aid office told me one thing but the tax preparer said something completely different about my scholarship reporting.

•I'm skeptical about AI tools for something as serious as taxes. How do you know the advice is actually correct and not just making things worse? Is this like an official IRS tool or just some startup?

•It definitely handles student tax situations well. It has specific knowledge about scholarship and grant reporting, education credits, and student loan interest deductions. The tool explains the difference between qualified and non-qualified education expenses, which is exactly what confused my preparer. The AI isn't making things up - it's trained on actual tax code and IRS publications. It's not an official IRS tool, but a third-party service created by tax professionals. Everything it suggested to me matched what I later confirmed with an actual CPA. The difference is that I didn't have to pay $200+ for a consultation just to identify the errors.

Just wanted to update that I tried taxr.ai after seeing it recommended here, and wow - it actually helped me find exactly where my preparer went wrong with my education expenses! The AI immediately identified that my scholarships were incorrectly reported as taxable income when they were used for qualified expenses. It gave me a detailed explanation of how education funding should be reported based on my situation, and even showed me the specific line items that needed to be corrected. I was able to file a superseding return before the IRS processed my original one, and my refund amount increased by over $800! Definitely worth checking out if you're in a similar situation with education-related tax issues.

If your return has already been processed by the time you try to fix this, you're going to need to get a human at the IRS on the phone to sort this out - which is nearly impossible these days. I spent 3+ hours on hold multiple times trying to fix a preparer error last year. I finally found this service called Claimyr (https://claimyr.com) that actually got me through to a real IRS agent in less than 20 minutes. They have this system that navigates the IRS phone tree and waits on hold for you, then calls you when an agent picks up. You can see how it works here: https://youtu.be/_kiP6q8DX5c The agent I spoke with was super helpful once I explained the situation with my preparer's mistakes. They guided me through the amended return process and even flagged my account with notes about the situation.

•How does this actually work? Does it give you some secret IRS number or something? I've been trying to reach someone about my stimulus payment for weeks with no luck.

•Sounds like a scam honestly. Why would I pay for something to just call the IRS for me? Plus how do they have any special access the rest of us don't have?

•It's not a secret number - they call the same IRS number everyone else does. The difference is they have an automated system that navigates all the menus and stays on hold so you don't have to. When a human IRS agent finally answers, their system calls your phone and connects you directly to the agent. I had the exact same thought initially - why pay for something I could do myself? But after wasting literally hours of my life on hold multiple times, the time savings was absolutely worth it. They don't have special access - they just handle the frustrating part (waiting on hold) for you. It's basically like having someone stand in line for you.

I have to admit I was completely wrong about Claimyr. After posting my skeptical comment, I was desperate enough to try it because I couldn't get through to the IRS about my amended return that had been pending for 9 months. The service actually worked exactly as described. I entered my phone number, they called the IRS, navigated through all those annoying menu options, and then waited on hold (for what turned out to be 67 minutes according to their tracker). I just went about my day, and then got a notification when they were about to connect me to an agent who had just picked up. The IRS agent was able to see that my amended return had been received but was stuck in processing. She put notes on my account to expedite it since it had been well beyond the normal processing time. Three weeks later, I finally got my refund. Definitely changed my mind about this service!

Former VITA volunteer here. What happened to you shouldn't have happened. VITA volunteers are supposed to be certified and supervised. You mentioned they created their own 1098-T, which is a big no-no. Here's what I'd recommend: 1) Contact the site coordinator for that VITA location. Every site has a manager who oversees the program, and they need to know about this serious error. 2) Ask for a complete copy of what was filed. You're entitled to this. 3) Use the superseding return advice others mentioned, or if it's too late, file Form 1040-X to amend. 4) Consider filing a complaint if the site coordinator doesn't take this seriously: https://www.irs.gov/individuals/free-tax-return-preparation-for-qualifying-taxpayers

•I'm definitely going to contact the site coordinator. Should I specifically mention which volunteers made the mistakes, or just explain the situation generally? And is there any chance this could get me in trouble since I signed it even though the information was wrong?

•It's helpful to mention specifically which volunteers made the mistakes so the coordinator can address the training issues, but don't worry about getting yourself in trouble. The IRS understands that taxpayers rely on preparers' expertise, especially in VITA programs. You're taking the proper steps to correct the return, which shows good faith on your part. Remember that VITA volunteers are trained specifically not to create forms or enter information they don't have documentation for. The site coordinator needs to know this happened so they can make sure those volunteers receive additional training or supervision. This protects future taxpayers from experiencing the same issues.

Quick question - does anyone know if using the free tax software like TurboTax Free or H&R Block Free would be better than going back to VITA for fixing this? I'm also a student and had issues with VITA last year (though not as bad as OP's situation).

•I've used both VITA and TurboTax Free. Honestly, for basic student returns, the free software is pretty foolproof. It asks straightforward questions about your education expenses and walks you through everything. Plus, you can save your work and think about it or do research before submitting.
