Ex claimed my child on taxes without custody/support - What steps to take?

My ex claimed our child on their taxes even though the child lives with me full time and I provide 100% support. We're currently in custody proceedings and they did this out of spite. I have all documentation showing I'm the primary caregiver. What steps do I need to take with the IRS to fix this?

Sophia Rodriguez

Tax professional here. You'll need to file your return by paper and claim your child. Include Form 8332 and documentation proving you're the custodial parent (school records, medical records, etc). The IRS will investigate both returns and likely audit both parties. Keep all receipts showing you provided support.

Thank you! How long does this process usually take? Should I wait for the custody case to finish first?

Don't wait - file asap. These cases can take 6-9 months to resolve. Document everything!

Hey, I actually went through something similar and used taxr.ai to help me understand the process. It costs $1 but it analyzed my transcript and showed me exactly what documents I needed and the timeline for resolution. Really helped me avoid mistakes. Check it out: https://taxr.ai

Make sure you're documenting EVERYTHING. Save texts, emails, court docs showing they dont see the kid. The IRS loves paper trails!

Same boat last year. File form 14039 (Identity Theft Affidavit) too if they filed before you could. The IRS takes these cases very seriously.
