Dealing with code 810 freeze - unreported W2 from 2021? Should I continue waiting?

This is sooo frustrating. I've been checking my transcript almost every day and I'm pretty sure this freeze code is because of a W2 I didn't report in 2021. That's probably what triggered the 810 code on my account. I've literally gone to the IRS office in person pretending I was there to verify my identity (just to get someone to talk to me). I've also tried getting a tax advocate but getting almost zero help. The IRS agents keep telling me I don't need to file an amendment, but they won't give me a clear timeline. Some people in similar situations say they've been waiting for over 18 months! Should I just keep waiting or is there anything else I can try? Getting really desperate here.

I had the same issue and finally got my refund after 8 months of waiting. My 810 was triggered by a missing 1099 that a client failed to send me a copy of (but they sent it to the IRS). The 810 code is actually a "Freeze" on any refund because there's a discrepancy - your missing W2 totally makes sense as the trigger. Had this happen to me too. Don't file an amendment. In my case, the IRS eventually processed an adjustment themselves and released the money (minus the tax on the unreported W2). It took about 4 months total. The most important thing is to NOT keep calling/visiting them because that can actually flag your account for even more review and slow things down.

This can go either way. If you file an amendment when they're already processing an adjustment, it can cause a mess. But if they haven't started the adjustment process yet, an amendment can sometimes speed things up. It's a gamble.

lol have you tried calling the IRS lately? i called 40+ times and either got a busy signal or the "we're too busy, call back later" message. literally impossible to get through during normal hours. this service waits on hold for you and only calls when they actually get a human.

What's your cycle code on your transcript? If it's a weekly code (ending in 05), check for updates on Fridays. If it's daily (ending in 01-04), check every day. My 810 resolved after 5 months - one day it just switched to 571 (freeze released) followed by 846 (refund issued). Never got any notification, it just happened.
