Apartment complex demanding ITIN for my wife on H4 visa to sign lease - legal?
Hi everyone, I'm in a bit of a stressful situation and need some advice. My wife and I are planning to move to a new apartment complex in about two months, but we've hit a snag with the application process. The leasing office is demanding that my wife provide her ITIN in order to be on the lease with me. The problem is she's on an H4 visa and doesn't have an SSN - I know she'll qualify for tax benefits at the end of the year due to substantial presence test, but that's not helping us now. We currently live in a different apartment complex where her foreign passport was sufficient documentation - they never asked for an ITIN. When I explained to the new place that she can't just get an ITIN outside of tax filing season, they're insisting she must have one or she can't be included on the lease with me. So my questions are: 1. Is the apartment complex within their rights to require an ITIN from my wife? I was under the impression ITINs can only be applied for when filing taxes, which can't start until next year. 2. If they are allowed to require this, is there any way to get an ITIN for her now, outside of tax season? Any advice would be hugely appreciated - we really like this new place but this ITIN requirement caught us completely off guard.

The quickest option is usually going through a Certifying Acceptance Agent as they can verify original documents without you having to mail them. The processing time is typically 7-11 weeks currently for new ITIN applications.

Something nobody has mentioned yet - have you asked the apartment complex if they'll accept proof that you've submitted the ITIN application? Many places will let you sign the lease if you can show them the W-7 that's been submitted. Also, would they accept her as an occupant but not on the lease? That might be a workaround if you qualify for the apartment based on just your income.

Has anyone actually challenged an apartment complex on this requirement? My understanding is they need either an SSN or ITIN for credit check purposes, but a foreign national with no US credit history won't have a US credit report anyway, so what are they actually checking?
