Late backdate claim to April - any success with DEO retroactive payments for self-employment?

Hey everyone, I'm in a bit of a sticky situation with my unemployment claim. I'm self-employed and my business basically dried up completely back in early April, but I didn't file for unemployment until July 15th (yeah, I know... procrastination + confusion about self-employment eligibility 🤦‍♀️). When I filed, I put down the early April date as my last day of meaningful income. Has anyone here had experience with getting a claim backdated like this? I'm especially wondering: 1) How long did it take for approval? 2) Did you actually get the retroactive payments from April-July? 3) Do I need to call DEO after approval to verify my April end date or is that handled automatically? My account is still showing "pending" and I'm getting anxious watching my savings dwindle. Any insights would be super helpful!

I went through almost the exact same thing last year. Self-employed, waited until June to file but hadn't made any money since February. It took about 5 weeks for my claim to be approved, but here's the important part - I DID get backdated payments, but only after I specifically requested them through the CONNECT message center. After approval, go to the "Determination, Pending Issues and Decision Summary" section and check if they approved your claim with the April date. If not, you'll need to request backdating through the message center AND follow up with a phone call. The message will likely sit for weeks without action unless you call.

Thanks for this detailed info! Did you have to provide any proof of no income during those months? I'm worried they'll think I'm trying to game the system or something.

My claim got denied 3 times before I got approval. DEO HATES THE SELF-EMPLOYED!! They made me upload tax returns, 1099s, bank statements, you name it. And then they STILL denied me saying "insufficient work history" even though I'd been working for 2 years! Complete nightmare.

That's pretty common unfortunately. DEO's system wasn't originally designed to handle self-employed claims, so they often get flagged for additional verification. Did you eventually get approved? What finally worked?

yeah eventually got thru after sending in everything AGAIN and then waiting 11 more weeks lol. backdated payments came in one big lump sum, almost fell out of my chair

To directly answer your questions about the backdating process: 1) Approval timeframe varies widely, but for backdated self-employment claims, expect 6-8 weeks minimum. The system automatically flags these for manual review (adjudication). 2) Yes, you can receive backpay, but the process isn't automatic. Your claim effective date needs to match your last work date. 3) You absolutely need to call DEO once your claim is initially processed. Request to speak with an adjudicator specifically about backdating. Critical point: Make sure you complete all your work search requirements for EACH week you're claiming, even the backdated weeks. The system will prompt you to complete work searches for those past weeks if your backdating is approved. Missing this step is the #1 reason people lose their backdated benefits.

wait we still have to do the work searches for the backdated weeks? I didnt do that and still got paid 🤔 this was back in March tho maybe they changed the rules

The rules did change. As of July 1, 2025, all backdated weeks require work search documentation. Prior to that, some periods had modified or waived requirements. But for any new claim like the original poster's, the full requirements apply.

I was in your exact situation! Filed in June for business that stopped in March. Just be prepared for a LONG wait. My claim was pending for TWO MONTHS before it moved to adjudication, then another month to approval. The most frustrating part was trying to reach someone at DEO - I tried calling literally 30+ times a day for weeks and could never get through. I finally discovered Claimyr (claimyr.com) which helped me get through to a live agent in about 20 minutes instead of spending days redialing. There's a video that shows how it works: https://youtu.be/UzW_hbUy-ss?si=zORd51jeq1GX5Ldj - basically saved my sanity. The agent I spoke with was able to escalate my backdating request and I got approved about a week later with all the retroactive payments. Without being able to speak to someone, I think my claim would still be pending honestly.

Two months?! That's terrifying. I don't think I can wait that long. I'll check out that service - at this point I'd try anything to get through to an actual human being at DEO. Did they give you any trouble about the backdating itself or just the normal processing delays?

The backdating itself wasn't the problem - it was just getting someone to actually LOOK at my claim. Once I got through to a rep who actually reviewed my file, the process moved pretty quickly. Just make sure you have documentation ready showing your self-employment income stopped in April. Bank statements helped me prove my case.

i had a simlar issue but i waited even longer (sept) to file for april work stoppage. heres the thing nobody tells u - u have to specifcally say the magic words "I WANT TO BACKDATE MY CLAIM TO APRIL X" in every coversation with deo. if u dont use that exact phrase they dont do it right. also prepare for multiple fact-finding interviews where they ask the same Qs over and over

This is actually really good advice. The terminology matters a lot with DEO. If you just say "I stopped working in April" they might note it but not actually process the backdating request. You need to be explicit about wanting to "backdate the claim effective date."

Important point about self-employment claims that I don't see mentioned yet: Make sure your claim is properly classified as a Regular UC claim with self-employment indicated, not mistakenly filed as a PUA claim (which no longer exists). Many DEO agents still confuse these programs. When you call, verify specifically that your claim type is correct. If they've misclassified your claim type, the backdating request will go nowhere and eventually be denied.

Oh wow, I wouldn't have even thought to check that. Is there a way to see what type of claim I filed in my CONNECT account? I honestly just followed the online application and answered the questions as best I could.

Yes, log into CONNECT and check your Monetary Determination letter. It should clearly indicate "Regular Unemployment Compensation" and not reference PUA. If you see anything about PUA, that's a red flag that needs immediate correction. The determination letter should also show your base period earnings calculation - self-employment income should be factored in if you provided that information correctly on your application.

dont get ur hopes up on backpay tbh. some ppl get it some dont. i had to wait 12 weeks and they only paid me for 4 weeks even tho i asked for 10 weeks backpay. they said something about "administration error" whatever that means

That sounds like you might have been caught by the quarter change rule. If your backdated period crossed between calendar quarters (like from Q1 to Q2), they sometimes only backdate to the beginning of the current quarter rather than your actual last work date. Did you appeal that determination? Many people have won those appeals.

i didnt know i could appeal that! they never said that was an option. too late now i guess 🤷‍♀️

Thank you everyone for the advice! This is all super helpful. I'm going to try calling DEO tomorrow (wish me luck!) and specifically ask about backdating my claim to April. I'll make sure to document everything and use the exact terminology you all suggested. If I can't get through after a reasonable number of tries, I'll check out that Claimyr service - at this point, waiting another 2-3 months for payment isn't really an option for me. I'll update once I hear anything!

Good plan. One more tip: call as close to 7:30 AM as possible when their lines open. The queue fills up incredibly fast, often within the first 15-20 minutes of the day. And make sure to have your claimant ID number, social security number, and the exact date you're requesting to backdate to written down in front of you before you call.
