How to apply for unemployment for IHSS workers through California EDD

I've been working as an In-Home Supportive Services (IHSS) caregiver for about two years now, providing care for an elderly client in Sacramento. My client recently had to transition to a skilled nursing facility, which means my hours have been completely cut and I'm essentially out of work through no fault of my own. I honestly had no idea that IHSS workers could even file for unemployment, and now I'm scrambling to figure out how to apply for unemployment for IHSS workers through California EDD. I went on the UI Online portal and started filling everything out but got really confused when it asked about my employer. Like, do I list the county, the state, or my individual client as my employer? The whole IHSS employment structure is confusing because it's kind of a weird hybrid situation where the client is technically your employer but the county oversees everything. I submitted my application three days ago but I'm not sure I filled it out correctly. The claim just shows as 'pending' right now. Has anyone else been through this process as an IHSS worker? Did you run into problems with how to list your employer on the application? I really need this to work out because I was depending on that income and I don't know how long it will take to find another client through the IHSS registry.

Yes IHSS workers can definitely file for unemployment! I went through this exact same situation about eight months ago when my client passed away. The key thing to understand about how to apply for unemployment for IHSS in California is that under the IHSS program, the client is considered your employer of record for UI purposes, but the State of California is what's called the 'fiscal intermediary' which means when you list your employer on the EDD application you should list the individual client's name. Your wages were reported to EDD under the client's name as the employer. When I filed I listed my client's full name and their address, and my claim went through without any adjudication issues. The weekly benefit amount is calculated based on the wages reported under that client. If you had multiple IHSS clients over the past 18 months, each one would show up as a separate employer in your wage history.

This is so helpful, thank you! I did list my client by name but I wasn't sure if that was right. Should I also list the county IHSS office anywhere in the application? I see a spot for additional employers.

0 coins

No, don't list the county as an additional employer unless you also did separate county work outside of IHSS caregiving. The county isn't your employer for UI wage purposes, they just administer the program. Only list your actual IHSS clients.

0 coins

Wait I'm confused, I thought the state was the employer for IHSS workers? I remember reading something about that when I first started working as a caregiver.

0 coins

The state is involved as fiscal intermediary but for unemployment insurance purposes the individual client is the employer of record. It's a weird system but that's how EDD processes it. Your W-2 would have been issued under your client's name/info.

ugh the IHSS unemployment thing is SO confusing I went thru this last year. my client moved to a family members house out of state and i lost all my hours. took me forever to even get someone at EDD on the phone to explain the process. kept calling and calling just getting busy signals or getting disconnected after waiting on hold for like an hour. the application part is actually not that bad once you know how to fill it out but if you have any questions good luck reaching anyone lol

0 coins

Yeah the phone situation is stressing me out. I need to call to ask about my pending claim but can't get through at all.

0 coins

honestly i ended up just waiting and my claim eventually processed on its own. but i still needed to call eventually for a different issue and it was brutal

0 coins

I was in a similar IHSS situation a few months back and was losing my mind trying to reach EDD by phone to clarify my employer info on the application. A friend told me about a service called Claimyr that basically gets you connected to a live EDD agent without you having to sit on hold for hours. I was skeptical at first honestly but I tried it and actually got through to an EDD rep who walked me through exactly how IHSS employment gets processed in their system. You can check it out at claimyr.com and they have a demo video at https://youtu.be/JmuwXR7HA10 that shows how it works. For IHSS-specific questions it was really worth it because the agent knew exactly what I was talking about and confirmed my application was set up correctly.

0 coins

I've never heard of this. Does it actually work? I really need to talk to someone about my IHSS claim specifically.

0 coins

Yes it worked for me. I was able to actually have a real conversation with an EDD agent who pulled up my claim details and confirmed the IHSS employer listing was correct. Saved me a ton of stress.

0 coins

seconding this, i used claimyr when my IHSS claim got flagged for adjudication and the agent i spoke with was able to tell me exactly what the issue was. way better than staring at a pending screen for weeks.

0 coins

sounds too good to be true tbh, edd phones are impossible

Let me give you a thorough breakdown of the IHSS unemployment application process since there's a lot of confusion around it. When you apply for California EDD unemployment as an IHSS provider, here's what you need to know: First, your base period wages are calculated from your IHSS earnings which are reported quarterly by the state fiscal intermediary on behalf of your client employer. Second, IHSS is considered 'domestic service' employment under California UI law, which means there can be specific eligibility thresholds. You need to have earned at least $1,300 in your highest base period quarter OR at least $900 in your highest quarter AND your total base period wages must equal at least 1.25 times your high quarter wages. Third, when your client's care situation changes (moving to a facility, relocating, passing away) and you lose hours, this is typically considered a valid reason for separation that doesn't result in disqualification. Fourth, make sure your UI Online profile shows your correct contact info because EDD may need to send you an eligibility questionnaire specific to IHSS domestic service workers.

0 coins

The domestic service threshold thing is worrying me. I only worked about 20 hours a week so my quarterly earnings might be on the lower side. Is there a way to check what wages EDD has on file for me before my claim is fully processed?

0 coins

Yes, once your claim is filed you can sometimes see the wage information EDD pulled from their records in your UI Online account. Look under the claim details section. If the wages shown seem incorrect or missing, that's when you'd want to contact EDD directly to verify because incorrect wage reporting for IHSS workers does happen sometimes.

0 coins

the 1.25 times high quarter thing trips so many people up. i got denied my first time filing because i just barely missed that threshold. had to appeal and show additional income i had forgotten to account for

0 coins

I applied for unemployment as an IHSS worker twice now (different clients both times) and want to share what I learned. The application itself on UI Online is pretty standard, nothing IHSS-specific about the form itself. You just fill it out honestly. The part where people get tripped up is the separation reason. When it asks why you're no longer working, you choose 'reduction in hours' or 'lack of work' depending on your situation. If your client went to a nursing home, that's lack of work - your position basically ceased to exist, you weren't laid off in the traditional sense but you did lose your job through no fault of your own. Do NOT say you quit or resigned. I've seen people accidentally select the wrong reason and it throws their claim into adjudication for weeks.

0 coins

I said 'lack of work' on mine because my client's circumstances changed and there were no more hours available. Does that sound right?

0 coins

That sounds exactly right. Lack of work is the correct characterization when your client's care needs transferred to a facility or another arrangement. You didn't choose to stop working, the work stopped being available.

0 coins

this is good info, my coworker who does IHSS said the wrong separation reason is why her claim got stuck in adjudication for like 6 weeks. such a small thing to cause so many problems

0 coins

ok wait i'm reading this thread because i'm also an IHSS worker trying to figure out if i qualify for unemployment. my situation is a little different - my client didn't go anywhere but they reduced my authorized hours from 45 a week down to 18 a week because of some reassessment thing. can i still file for partial unemployment? or is it only if you lose ALL your hours??

0 coins

You can potentially file for partial unemployment benefits if your hours were significantly reduced! California EDD has provisions for partial UI when your hours are cut substantially. Your weekly benefit amount would be reduced based on any earnings you still receive from those 18 hours, but you could potentially receive partial benefits for the difference. Worth filing and seeing what EDD determines.

0 coins

oh wow I didn't know that was even a thing. I just assumed you had to be completely out of work. going to look into this now thank you

0 coins

Yes partial UI is absolutely a thing in California. When you certify weekly you report your earnings from those 18 hours and EDD calculates whether you're still owed a partial benefit. Your weekly benefit amount minus your earnings (with a small earnings disregard) determines what you receive. It's worth filing even if you're not sure.

0 coins

I'm an IHSS provider who went through the unemployment process last year and I just want to say the most confusing part for me was the weekly certification after the claim was approved. When it asks if you worked and how much you earned, you need to report your IHSS earnings for that week even if you're still active in the IHSS registry but just don't have a current client. If you have zero current clients you'd report zero earnings. But if somehow you picked up even a small number of hours with a new client during your claim period you have to report those hours and wages accurately.

0 coins

Good to know about the weekly certifications. I'm still on the IHSS registry hoping to match with a new client. So when I certify, I just report zero earnings until I get a new client placement?

0 coins

Exactly. Zero earnings reported while you're registered but not actively working. The moment you get matched with a new client and start earning again, report those wages on your weekly certification. Staying on the registry while filing for UI is completely fine and expected.

0 coins

this is exactly what i needed to know too. I wasn't sure if just being ON the registry counted as working somehow

0 coins

Being on the IHSS registry is equivalent to being job searching, which EDD requires anyway. It doesn't count as employment or earnings unless you're actually providing care hours and receiving payment.

0 coins

IHSS unemployment claims are SO prone to going into adjudication and i hate how little information EDD gives you when that happens. Like my claim just sat there saying 'pending' for 4 weeks and I had NO idea if it was because of the employer listing issue or the domestic service classification or something about my separation reason or what. Finally got through to an agent and it turned out there was just a wage verification thing where EDD needed to confirm my hours with the state fiscal intermediary system. Once that resolved it approved automatically. But those 4 weeks of not knowing were brutal.

0 coins

This is exactly my fear. My claim has been pending for 3 days now. How did you eventually get through to EDD to find out what was happening?

0 coins

Honestly tried calling for two weeks straight, mornings only because I heard that's the best time. Eventually got through but it still took ages. A lot of people in my IHSS worker Facebook group started using that Claimyr service which apparently cuts through the phone queue. Wish I had known about it when I was in my stressful pending limbo period.

0 coins

Several people in this thread have mentioned Claimyr now. I think I'm going to try it, 3 days of pending status with no info is already stressing me out.

0 coins

something nobody mentioned yet: make sure you're meeting the job search requirement while your IHSS claim is active!! california edd requires you to contact 3 employers per week as part of your UI eligibility unless you're on approved standby status. for IHSS workers this gets weird because your 'job search' should ideally include reaching out to clients through the IHSS registry OR applying for other caregiving/similar jobs. i almost got disqualified once because i only logged registry-related activity and an EDD rep told me that might not count fully as employer contacts in all cases. ended up logging actual job applications alongside registry activity just to be safe

0 coins

wait this is news to me. so being on the IHSS registry isn't enough for the job search requirement? I need to also apply to other jobs??

0 coins

I honestly am not 100% sure of the official answer, that's just what one EDD rep told me. I've seen conflicting info on this. Might be worth clarifying directly with EDD given your specific situation to make sure you're compliant.

0 coins

The official stance is that IHSS workers are generally expected to search for work similar to their prior employment, which would include seeking new IHSS clients and other caregiving positions. Documenting your contacts through the IHSS registry system plus any applications to home care agencies or similar employers is the safest approach to satisfy the job search requirement.

0 coins

yeah that's what i ended up doing. playing it safe with a mix of registry activity and broader caregiver job applications. better than risking a disqualification over it

0 coins

lol california edd is just impossible no matter what kind of claim you have, IHSS worker, regular employee, doesn't matter. the system is designed to make you give up. i filed for unemployment twice now and both times I got some random disqualification that made no sense and had to fight it. second time they said I voluntarily quit which was completely WRONG i was an IHSS worker and my client literally moved out of state. had to go through the whole appeal process to get it overturned. be prepared for anything

0 coins

That's terrifying. How long did the appeal take?

0 coins

took about 9 weeks from when i filed the appeal to when the ALJ hearing happened. then another 3 weeks for the written decision. but i won. keep all your documentation, texts from your client, any official IHSS program correspondence about changes to care authorization, everything.

0 coins

The voluntary quit misclassification for IHSS workers is unfortunately common. The key is clearly documenting in your initial application that the work ended due to the client's changed circumstances, not your choice. If you do get disqualified and need to appeal, like the above person said, gather any documentation showing the change in your client's care situation.

0 coins

i work for a nonprofit that does IHSS provider support and we help caregivers navigate this all the time. the number one thing I tell IHSS workers applying for unemployment is to SAVE EVERYTHING. save your timesheet records, save your IHSS notice of action documents, save any correspondence about changes to your client's care plan or authorized hours. EDD sometimes requests verification of employment details for IHSS claims specifically because the employment relationship is unusual. having documentation ready can save you weeks of delay.

0 coins

I do have my timesheet records saved electronically through the IHSS Electronic Services Portal. Should I upload those with my initial application or wait to see if EDD requests them?

0 coins

You don't need to upload them with your initial application, EDD will request anything they need. But knowing where they are and having them ready means you can respond quickly if EDD does reach out, which helps avoid delays in processing.

0 coins

this is great advice. I lost my documentation once when I switched phones and it made a difficult EDD situation so much worse. screenshot everything related to your IHSS work and claim

0 coins

random q but does anyone know if you can collect unemployment as an IHSS worker if the reason your hours got cut was because the county reduced your client's authorized hours through reassessment? like the client didn't go anywhere, they're still in their home, but the county came in and cut the approved care hours from 60 to 30 per week. is that still a valid reason for UI??

0 coins

Yes, a significant reduction in authorized IHSS hours resulting in substantial wage loss is generally a qualifying reason for California UI. The key is that the reduction wasn't your choice and isn't a temporary situation. If the county officially reduced your client's care authorization and your hours and income dropped substantially as a result, you'd likely qualify for partial or full UI depending on how drastic the reduction was.

0 coins

ok good because i've been afraid to file thinking they'd just deny me since technically i still have a client. the income drop is really significant though

0 coins

File! The worst they can do is deny you and then you know for sure. But a 50% reduction in hours is definitely worth filing a claim for. Document the notice you received about the hour reduction as your evidence.

Just wanted to pop back in and update that I successfully got my IHSS unemployment claim approved after about 3 weeks of pending status. For anyone going through this: after I used Claimyr (claimyr.com) to actually reach an EDD agent, they told me my claim had a wage verification flag because of how IHSS wages get reported. The agent was able to manually verify my wages right on that call and push my claim forward. I got my approval notice two days later and my first payment posted the following week. Don't sit and stare at a pending screen for weeks - actually talking to an agent can speed things up a lot.

0 coins

This is SO good to hear, thank you for coming back to update. I'm going to try Claimyr today honestly, my pending status has been going on too long with no updates.

0 coins

Glad it worked out for you! The wage verification flag is super common for IHSS claims, exactly what happened to me too. Once an agent manually addresses it the claim usually moves pretty fast.

0 coins

congrats on getting approved! gives me hope for my partial UI situation

0 coins

can i ask a dumb question... if i'm an IHSS worker and i get approved for unemployment, do i still have to do the 1 week unpaid waiting period that california has? or is there some exception for IHSS workers?

0 coins

No exception for IHSS workers - you go through the same standard California UI waiting period as any other claimant. Your first week of eligibility is an unpaid waiting week. So the first payment you receive covers your second week of eligible unemployment. This is the same for everyone regardless of what type of employment you had.

0 coins

ok thanks, just wanted to make sure. i've heard people say different things about whether certain workers get exceptions

0 coins

The waiting week is standard for all California UI claimants. There are no occupational exceptions. Just make sure you certify for that first week even though you won't receive payment for it - you have to certify to 'use' the waiting week and start your payment clock.

0 coins

I'm in the middle of this right now too, applied for unemployment as an IHSS worker 10 days ago. My claim is pending and I've been calling EDD every single morning, redial game starting at 8am, can never get through. The anxiety of not knowing if I filled out the application correctly is eating me alive. Is there anything I can do while waiting besides just staring at UI Online hoping the status changes?

0 coins

The morning redial game is exhausting and honestly unreliable. I mentioned it above but a lot of IHSS workers in my support group have been using Claimyr to get through to EDD without the whole redial nightmare. The demo video at https://youtu.be/JmuwXR7HA10 explains how it works. When I finally did get through to an agent during my pending period they were able to at least tell me what stage my claim was in which brought a lot of relief even when nothing was resolved yet.

0 coins

10 days of this anxiety is rough. I'll check out that video. Honestly at this point I just want to hear a human voice tell me my application is at least in the system correctly.

0 coins

I feel you so much on this. I ended up using Claimyr to get through and the relief of just talking to an actual EDD agent who could look at my claim details was huge even before anything was resolved. Hang in there.

0 coins

something that helped me understand IHSS unemployment eligibility better: the domestic service employment rules that apply to IHSS are really about minimum earnings thresholds, not about whether you QUALIFY as an employee. IHSS providers ARE employees for UI purposes since the landmark legal decisions on this. so don't let anyone tell you that IHSS workers are independent contractors who can't file for UI - that's wrong. you pay into the UI system through your paycheck deductions and you have every right to claim benefits when eligible.

0 coins

THANK YOU for saying this. I've seen so much wrong info floating around telling IHSS workers they can't file unemployment because they're 'not real employees.' That's completely false and it stops people from claiming benefits they've earned and paid into.

0 coins

This is reassuring. I was a little uncertain about my eligibility status and this clarifies it.

0 coins

i literally told my friend this last week and she didn't believe me. sending her this thread

0 coins

one more practical tip for anyone newly applying for IHSS unemployment: after you file, activate your UI Online account notifications so you get email or text alerts when your claim status changes or when EDD sends you any messages. I missed a notice EDD sent me early in my claim process because I wasn't checking my UI Online inbox and it delayed my claim by like two weeks. EDD sends everything through that inbox and they won't call you proactively in most cases.

0 coins

Doing this right now, thank you. I hadn't thought to check my UI Online inbox separately from just looking at my claim status page.

0 coins

Yes this is so important!! The UI Online inbox is easy to overlook but EDD puts critical notices and questionnaires in there. Missing a response deadline can hold up your claim significantly.

0 coins

oh no I haven't been checking my inbox at all. logging in right now to set up notifications and check if anything is waiting there.

0 coins

yes notifications are essential. also make sure your email address on file with EDD is one you actually check regularly. seems obvious but I had an old email on my account and almost missed everything
