EDD payment after returning to seasonal work then being laid off again?
I'm confused about my fiancé's unemployment situation and hoping someone can help clear this up. He exhausted his previous claim last fall, then opened a new EDD claim in December. In January, he got called back to his seasonal construction job but yesterday was his last day - they're cutting hours to make sure there's enough work for the core crew through the slower months. He certified for benefits yesterday right after his last shift. Since he worked for about 4 weeks before being laid off again, will he actually receive an unemployment payment this week? Or does he need to reopen his claim or something? The EDD website is super confusing about going back to an existing claim after brief employment. Anyone dealt with something similar?

Your fiancé shouldn't need to reopen his claim as long as it's still within the benefit year (which it sounds like it is since he just opened it in December). When he certified, he would have reported his earnings for each week. If his earnings were below his weekly benefit amount, he'll receive a partial payment. If his earnings were more than his weekly benefit amount, he'll get $0 for that week but his claim stays open. The important thing is that he keeps certifying every two weeks, even for weeks where he worked. This keeps his claim active. As long as he reported his return to work and then his subsequent layoff correctly during certification, the system should automatically adjust and start paying again for eligible weeks.

I went thru EXACTLY this with my seasonal job at the apple orchard. when i got laid off in November i opened a claim, got called back in January for pruning season (4 weeks), then laid off again. I DID get paid after the second layoff but there was like a weird 1-week gap where I didn't get anything even though I certified. EDD system is SO FRUSTRATING ARRRGH!!!

Make sure he checks that the employer reported his last day correctly. My boyfriend had issues because his boss reported the wrong date and it messed everything up for weeks.

This is a common situation with seasonal work. Since he already has an open claim and it's within the same benefit year, he doesn't need to file a new claim. He just needs to continue certifying. For the weeks he worked, he needs to report those earnings accurately. The EDD uses a formula to determine if he gets partial benefits or no benefits for weeks with earnings. The key things that might affect his payment: 1. If his earnings in any week exceeded his weekly benefit amount, he won't receive benefits for that week 2. If he worked full-time hours (even if earnings were low), he may be considered "not unemployed" for that week 3. There is NO new waiting period since this is a continuation of his existing claim He should see the payment status update within 2-3 days after certification. If it stays pending for more than a week, there might be an eligibility interview required.

I had a similar situation last yr with seasonal retail and when i got laid off, i couldnt get ANYONE at edd to pick up the phone and my certification was stuck on pending for like 3 weeks!!! does he have a UI online account set up? thats the first thing he should check. it will show if hes getting paid or if theres an issue. also he needs to make sure he did his work search activities

So wait I'm confused... if you work for a few weeks and then get laid off again, do you have to do a whole new application or just keep certifying on the old claim????

•You just keep certifying on your existing claim as long as you're within the same benefit year (which is typically 12 months from when you first filed). No need to file a new application unless your benefit year has ended. Simply report your earnings for the weeks you worked, and when you're laid off again, you'll report zero earnings for those weeks.
