EDD appeal hearing process - worried my claim might expire before court date

I received a disqualification notice after my eligibility interview last month and immediately filed an appeal. Finally got my court appeal date scheduled but it's not until May 2025 (almost 3 months away)! I'm really concerned my claim might expire before the hearing happens. Has anyone gone through the appeals process recently? How long did yours take from filing to actual hearing? And does anyone know if there's a time limit where your claim just 'expires' if the appeal takes too long? My benefits stopped when I got disqualified and I'm really struggling financially right now.

Your claim won't expire while waiting for an appeal hearing. The benefit year lasts for 12 months from when you first filed, but appeals can extend beyond that if needed. The 3-month wait is unfortunately pretty standard - the appeal office is backed up. What matters most is that you filed the appeal within 30 days of receiving the disqualification notice. If you win your appeal, you'll get backpay for all the weeks you would have been eligible.

Thanks for explaining! Yes, I definitely filed within the 30 days (did it the same week actually). Good to know the claim won't just disappear while I'm waiting. The backpay would be such a relief if I win.

my appeal took 4 months to get scheduled last year and then another month till the actual hearing. its crazy how long they make ppl wait when ur literally struggling to pay bills!!!

4 MONTHS? That's absolutely ridiculous! How are people supposed to survive when the system takes THIS LONG to fix their mistakes?? This is why I tell everyone to document EVERYTHING when dealing with EDD. Record your interviews if they're over the phone (California is a two-party consent state so make sure you say you're recording), save ALL correspondence, and print those UI Online screenshots!!!

I went through an appeal in January and my hearing was about 2.5 months after I filed the appeal paperwork. Here's what helped me prepare: 1. Gather ALL documentation related to your disqualification reason 2. Write out a clear timeline of events 3. Practice explaining your situation concisely 4. Bring copies of everything (even if you submitted it already) 5. Be respectful but firm about your position My hearing lasted about 45 minutes, and I received the decision letter about 10 days later. The judge overturned my disqualification, and I received all my backpay within 2 weeks after that. While you're waiting, make sure you continue certifying for benefits each week even though you won't get paid until (hopefully) after your appeal. This ensures you'll get all your backpay if you win.

Thank you so much for this detailed advice! I didn't realize I should still be certifying during this waiting period. I'll start doing that right away. Did you have a representative or lawyer with you during your hearing?

No, I represented myself. For most EDD appeals, you don't need a lawyer unless your case is very complex. The administrative law judges are used to people representing themselves and will guide you through the process. Just be honest, stick to the facts, and explain why you believe the disqualification was incorrect.

I tried for WEEKS to get more information about my appeal process and couldn't get through to anyone at EDD. Finally used a service called Claimyr (claimyr.com) that got me connected to an EDD rep in about 20 minutes after weeks of busy signals. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km The rep I spoke with gave me the status of my appeal and explained exactly what to expect. Might be worth trying if you need more specific info about your situation while waiting for the hearing date.

I've been struggling to get through too! Their phone lines are always busy. I'll check out that service - at this point I'm desperate for any information I can get about my case.

The entire appeals system is BROKEN and designed to make you give up!! I waited 4.5 months for my hearing last year and then they RESCHEDULED it with only 2 days notice!!! By the time I finally had my hearing, it had been nearly 7 MONTHS since my disqualification. The system is DELIBERATELY slow to force people to give up their rightful benefits!!!

Same happened to my cousin they rescheduled his hearing twice! EDD is so unfair to people who are already struggling

anyone know if u can request an earlier date? my friend said she called and got her hearing moved up by like 3 weeks

Yes, you can request an expedited hearing if you're facing eviction, utility shutoff, or other severe financial hardship. You need to submit documentation proving the hardship with your request. It doesn't always get approved, but it's worth trying if you're in a desperate situation.

This reminds me of when I got disqualified back in 2023 because my former employer claimed I quit when I was actually laid off. My appeal hearing was scheduled for 3 months out too but then I got lucky because they had a cancellation and offered me an earlier slot. So sometimes you might get it sooner. The whole thing was really stressful though. I had to borrow money from family the whole time I was waiting.

One more important tip: When you attend your hearing, whether it's phone or video, make sure you're in a quiet place with good reception/internet. I've heard stories of people missing crucial questions or having their testimony cut off due to connection issues. The judge may not be sympathetic if you can't participate properly due to technical problems on your end.

Good point - my hearing is going to be via phone. I'll make sure I'm somewhere quiet with good reception. Did you get any kind of practice run or tech check before your actual hearing?

No practice run, but they'll send you detailed instructions before the hearing date. They usually call you 5-10 minutes before the scheduled time to make sure you're there and the connection is good. Just be ready early and answer when they call.
