EDD appeal filed 4 months ago still no hearing date - normal wait time?

I submitted my appeal paperwork after being disqualified back in March (over 4 months ago now). I got the confirmation letter that they received my appeal about a week later, but since then I've heard absolutely NOTHING. The appeal branch number just goes to voicemail that's always full. Is this normal for 2025? How much longer should I expect to wait before I get a hearing date? I'm starting to panic because my savings are almost gone and I really need this resolved. Has anyone else experienced such a long wait time for their appeal hearing to be scheduled?

The appeal process is taking FOREVER right now. I filed my appeal in February and just got my hearing date last week - so about 5 months total waiting time. From what the judge told me, they're extremely backlogged because of some new system implementation they did in January that created a ton of incorrect disqualifications. You should be getting your hearing notice soon, but if you need to reach someone, try Claimyr (claimyr.com). I was in the same boat and couldn't get through no matter how many times I called, but Claimyr got me connected to someone who could at least confirm my appeal was in the system. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km

5 MONTHS?? Oh my god, I'm gonna be homeless by then. Did contacting them through Claimyr speed anything up or did it just confirm your appeal wasn't lost? I'm terrified my paperwork fell through the cracks somehow.

Appeals wait times are significantly longer in 2025 compared to previous years. The current average is 16-20 weeks from receipt of appeal to scheduled hearing date. This is due to a combination of staffing shortages at the Appeals Board and the implementation of their new case management system. If it's been 16+ weeks, you can try these options: 1. Contact your state representative/assembly member's office - they can often help check status and sometimes expedite 2. Submit an online inquiry through your UI Online account specifically about the appeal status 3. Mail a status request letter to the Appeals Board directly (include your appeal case number) 4. Visit an in-person EDD office with your appeal confirmation letter Also, while waiting, make sure you continue to certify for benefits every two weeks, even if showing $0 or disqualified. If you win your appeal, you can only be paid for weeks properly certified.

Thank you for this detailed info! I've been certifying every two weeks religiously so that's good to know I'm doing that part right. I'll try contacting my assembly member - never would have thought of that on my own.

Did they send you the appeal acknowledgment letter? I had to call like 50 times before I finally got through to someone who could confirm they even had my appeal on file. The wait times are crazy but at least check they have it.

Yes, I did get the acknowledgment letter about a week after I mailed my appeal form. That's the only communication I've received though.

I went through this exact situation in January. The appeals process has been severely backlogged since they updated their systems at the beginning of the year. Current wait times are 4-6 months for most people, but it can be longer depending on your county. One thing that helped me was requesting an expedited hearing due to financial hardship. You need to send a letter to the Appeals Board explaining that you're facing severe financial difficulties (be specific - mention risk of eviction, inability to pay for necessities, etc). Include your case number and all contact information. I did this and got my hearing date within 3 weeks of sending the hardship letter. If that doesn't work, I second the suggestion to contact your local assembly member's office. Their staff often has direct contacts at EDD who can check your status and sometimes move things along.

I had no idea I could request an expedited hearing! I'm definitely going to do that immediately. I really am facing eviction next month if this doesn't get resolved. Where exactly do I send the hardship letter? To the same CUIAB address that was on my appeal confirmation?

Yes, send it to the same CUIAB address that's on your appeal acknowledgment letter. Make sure to put "EXPEDITED HEARING REQUEST - FINANCIAL HARDSHIP" in big letters at the top of your letter, and include your appeal case number (should start with F-). I'd recommend sending it certified mail so you have proof of delivery. Also, keep certifying for weeks even while waiting - if you win the appeal, you'll only get paid for weeks you certified for.

I waited almost 6 months for my appeal hearing and then another 6 WEEKS after the hearing to get the judge's decision! The entire process took over 7 months for me. It's absolutely ridiculous how long this takes when people are depending on this money for basic survival. While you're waiting, make sure you gather ALL your evidence and documentation to support your case. The more organized you are, the better your chances. During my hearing, the judge specifically commented on how well-prepared I was compared to most appellants. Also, don't forget you can have a representative with you at the hearing. Doesn't have to be a lawyer - could be a friend or family member who can help keep you calm and organized during the hearing.

Something else to consider - if your financial situation is truly dire, you might want to look into emergency assistance programs while waiting for your appeal. Many counties have rental assistance, food banks, and utility payment help available. 211 is a good resource to find what's available in your area. The appeal process is definitely taking much longer than it should, but there are resources to help bridge the gap.

Thank you for this suggestion. I've already been using the food bank, but I'll call 211 to see what other assistance might be available. At this point, I need all the help I can get.
