EDD Portal login failure led to claim termination - need appeal advice ASAP

I'm so frustrated right now! My husband successfully completed the ID.me verification step but then couldn't log into the actual EDD Portal afterward. The system kept giving him errors and kicking him out. Yesterday we received a TERMINATION NOTICE with an appeal form because he missed some 'time-sensitive' deadline that we couldn't even complete because the portal wouldn't let him in! We started this whole unemployment process on March 15th, and now his claim is terminated before he could even properly file it. The EDD website issues caused him to miss critical deadlines that HE HAD NO CONTROL OVER. Has anyone else dealt with this ridiculous technical glitch? Is filing an appeal even worth it? We're desperate for any advice on how to fix this mess - especially if anyone has successfully appealed a termination due to EDD's own technical issues.

This has been happening to a LOT of people lately. The problem is that the ID.me verification and EDD portal are two separate systems that don't always communicate properly. File that appeal IMMEDIATELY - don't wait even one day. In your appeal, specifically mention 'technical barrier to access' and that you made multiple good-faith attempts to comply with deadlines. Also request a 'good cause exception' based on technical issues outside your control. Make sure to include dates and times of attempted logins if possible.

Thank you! We'll file the appeal today. Should we include screenshots of the error messages or is just describing what happened enough? This is all so overwhelming.

omg the SAME EXACT THING happened to my cousin!! the EDD system is total garbage these days. he had to call like 50 times to finally get thru to a person who could help him

Did your cousin get it resolved? What did the EDD rep say when he finally reached someone?

yeah eventually. they said it was a 'known issue' with the system and put in some kind of override. took like 3 weeks tho ughhh

I went through this exact situation in January. Here's what worked for me: 1. File the appeal immediately (within 30 days of termination notice) 2. Attach a detailed timeline of all attempts to log in 3. Call EDD directly and request to speak with a Tier 2 specialist who can see the login attempt history on their end 4. Ask for a "technical failure override" - this is an actual thing they can do 5. If your appeal date is scheduled far out, request an expedited hearing based on financial hardship The system has a known bug where the ID.me verification doesn't properly link to some EDD accounts, especially if there was any previous claim history. Keep trying to log in every few days too - sometimes it mysteriously starts working.

Thank you so much for this detailed advice! We'll definitely ask for that technical failure override. But I've been trying to call EDD for days and can't get through - just endless busy signals or the "too many callers" message. How did you actually reach a real person?

I had the exact same problem and wasted WEEKS trying to get through to EDD on my own. Finally used Claimyr (claimyr.com) and they got me connected to an EDD rep in about 20 minutes. The rep was able to see my login attempts in their system and fixed the technical issue on the spot. They have a video showing how it works here: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km. Saved my sanity and my claim from being completely terminated.

The INCOMPETENCE at EDD is UNREAL!!! This happened to me TWICE!!! Their stupid system logged me out while I was in the middle of uploading verification docs and I got disqualified!!! They don't care that THEIR system is broken!!! I had to file an appeal and wait THREE MONTHS for a hearing!!! RIDICULOUS!!!

Three months?? We can't wait that long! Did you try calling them at all during that three month period?

I called EVERYDAY for WEEKS!!! Either busy signals or they hang up on you!!! When I finally got through the rep said there was NOTHING they could do but wait for the appeal!!! Total DISASTER!!!

This is a common issue right now. For technical context: EDD's portal uses a session verification system that sometimes fails to recognize the ID.me token correctly. When filing your appeal, specifically reference California Code of Regulations, Title 22, Section 1326-12(b)(3) which covers technical barriers to filing. You should also submit a separate Identity Verification Escalation Request (DE 1326E) form which bypasses the normal ID system. Don't wait for the appeal date to try fixing this. Keep calling EDD daily, preferably right when they open at 8:00 AM. Ask specifically for a claim specialist who can manually override the verification status. The termination can absolutely be reversed since this is a known system defect on their end.

Thank you for the specific regulation to cite! That's incredibly helpful. We'll definitely include that in our appeal. I'll look for that DE 1326E form online right now.

You're welcome. The DE 1326E form isn't available online - you need to request it from an EDD representative. Make sure to document every call attempt in your appeal, even the failed ones. This establishes your good-faith effort to comply with deadlines despite their system issues.

Yes, you absolutely can and should appeal! You generally have 30 days from the date on the notice to file an appeal. Even if it's been longer, you can still try filing with a statement explaining the delay. Many termination notices get reversed on appeal, especially for technical issues.

Thank you everyone for all the advice! We've filed the appeal today and included all the specific information and regulations you suggested. We're also going to keep trying to call EDD directly. I'll update this thread if we get it resolved so it might help someone else dealing with the same issue.

Good luck! Remember to check your UI Online account daily too - sometimes these technical issues spontaneously resolve and you might suddenly have access again. If that happens, immediately complete any pending tasks even if you've already filed the appeal.

My brother had almost the identical problem last year with his claim. The appeal process actually worked surprisingly well for him. The judge instantly recognized it as a technical issue when they saw the login timestamp data compared to the ID.me verification completion time. They backdated everything and he got all the benefits he was entitled to. Just make sure you gather ALL documentation showing your attempts to comply with deadlines.

That's really reassuring to hear! Did your brother have to wait for the full appeal hearing or did they resolve it earlier in the process?

He did have to wait for the actual hearing, but they scheduled it pretty quickly - about 3 weeks after he filed the appeal. The judge made the decision on the spot and his account was fixed the next day. This was back in September though, not sure if they're more backed up now.
