EDD Disability vs. Unemployment - can I qualify if temporarily sick?

I'm really confused about whether I can get any EDD benefits right now. I got laid off from my restaurant job 3 weeks ago and was planning to file for unemployment, but then came down with pneumonia. My doctor says I'll be out for at least another 2 weeks before I can start looking for work again. I know one of the UI requirements is being 'able and available' to work immediately, which I'm not right now because of this illness. Does this mean I don't qualify for unemployment until I'm better? Should I apply for SDI instead for the time I'm sick? Will this mess up my unemployment claim when I get better? Anyone dealt with this situation before?

The EDD system is SO CONFUSING!!!! They make it impossible to figure out what to do in situations like this. I ended up in the same boat last year - got sick right after losing my job and had to wait on hold for HOURS trying to figure out which program to apply for! I went thru same thing in January. Applied for SDI online but it took FOREVER to process. I was almost better by the time it got approved. If u need to talk to someone at EDD about it, good luck getting thru on the phone - I tried for 2 weeks straight and kept getting the "we're experiencing high call volume" message.

Yep they did backdate it to when my doctor certified I got sick. Just make sure ur doctor fills out their part of the form quickly! Mine took an extra week which delayed everything.

everyone here is giving you good advice but I want to add one more thing - make sure your doctor is REALLY specific on the form about exactly when you can return to work. My SDI was cut off a week early because my doctor wrote "approximately 3 weeks" instead of giving a specific end date, and EDD interpreted that as the shorter end of the range. i lost a week of benefits and it was a NIGHTMARE trying to get it fixed.

That would be benefits fraud and could result in penalties, having to repay benefits with interest, and possibly even criminal charges. EDD regularly cross-references claims across their programs. If they discover someone is collecting UI while medically unable to work, they will establish an overpayment and may assess a 30% penalty. It's really not worth the risk.

UGHHH I HATE how EDD makes everything so difficult!!! When I was in your situation I ended up not getting ANY benefits for the first 3 weeks because of all the confusion and paperwork delays!!!!!! Make sure you call them and talk to an ACTUAL PERSON before submitting anything!!!! The website is USELESS and just confuses everything!!!!!

Something else to keep in mind: Once you recover and apply for UI, you'll need to report that you received SDI during the certification process. Be 100% accurate with the dates to avoid any overpayment issues down the line. EDD systems do talk to each other and they will eventually catch any overlapping benefit periods.

Yes! I submitted my SDI application yesterday and had my doctor complete their portion today. Now just waiting for it to process. I'll update if I run into any issues but so far the online system was pretty straightforward.
