Back to California Unemployment

Can you get unemployment after a temporary job ends in California?

So I just finished up a temp assignment that lasted about 4 months through a staffing agency. The client company decided not to renew the contract and now I'm back to square one. I wasn't fired or anything — the assignment just ended. I'm trying to figure out if I'm even eligible to file for California EDD unemployment benefits in this situation because everywhere I look online it says you have to be 'laid off' and I'm not sure a temp job ending counts the same way. I worked full time the whole time, made decent money, so I should meet the wage requirements. But the staffing agency is already trying to assign me to another placement and I don't know if that affects my claim. Do I file against the staffing agency or the client company? Has anyone gone through this and actually gotten approved? Kind of panicking because I don't have another assignment lined up yet and rent is due in two weeks.

Yes you can absolutely file! When a temporary assignment ends because the contract expired or wasn't renewed, California EDD typically treats that as a layoff — you didn't quit and you weren't fired for misconduct. The key thing is you are 'unemployed through no fault of your own' which is the main eligibility requirement. File your claim against the staffing agency since they are technically your employer of record, not the client company. Make sure you report any new assignment income if the agency does place you somewhere — you'd just stop certifying or report the wages accordingly.

Okay that's a huge relief. So when I file on UI Online, I put the staffing agency as my employer? Not the company where I actually did the work?

0 coins

Correct, the staffing agency is your employer for California EDD purposes. They're the ones who paid your wages and handled your payroll taxes. The client site is irrelevant to your claim.

0 coins

This is right. I went through the same thing last year — temp assignment ended, filed against the staffing agency, got approved within 3 weeks no issues.

0 coins

One thing to watch out for: if the staffing agency offers you another assignment that is 'suitable work' and you decline it, that could disqualify you from benefits. Suitable work generally means it's in your field, similar pay, reasonable commute. If they're trying to place you somewhere totally different or significantly lower pay you might be able to refuse without losing benefits but it gets complicated. Don't just ignore their calls thinking it's fine.

0 coins

The new assignment they're talking about is part time and about 30% less pay than what I was making. Does that count as suitable work I'm required to accept?

0 coins

That's actually a gray area. California EDD looks at several factors but a 30% pay cut could be considered unsuitable, especially early in your claim. I'd honestly call EDD and ask them directly before declining — you want documentation that you inquired.

0 coins

yeah dont just decline without asking first, that's how people end up disqualified and then have to do an appeal and wait forever

Getting through to California EDD on the phone to ask questions like this is a nightmare though. I spent 3 weeks trying to reach someone when my temp job ended. A coworker told me about Claimyr (claimyr.com) — it basically gets you in the queue for a callback from an EDD agent without you sitting on hold for hours. There's a video demo at https://youtu.be/JmuwXR7HA10 that shows how it works. I used it when I needed to clarify something about my claim and actually got a call back from EDD the same day. Honestly a lifesaver when you need a real answer fast.

0 coins

I've been dreading calling EDD because everyone says you can never get through. I'll check out that Claimyr thing, thanks.

0 coins

I've heard of this! My neighbor used it when her claim got stuck in adjudication. Said it worked really well.

0 coins

does it actually work or is it one of those scammy things

0 coins

I was skeptical too but it's legit. You can watch the demo video before doing anything — https://youtu.be/JmuwXR7HA10 — and see how it works. EDD called me back within a few hours.

TEMP WORKERS GET SCREWED BY THIS SYSTEM every single time. I did temp work for two years and the first time my assignment ended I didn't even know I could file. Nobody tells you! The staffing agency definitely doesn't tell you because they want you taking whatever placement they throw at you. And California EDD's website is so confusing it doesn't even spell out that temp assignments ending = layoff. I had to find out from a random forum like this one.

0 coins

Omg same, I thought because it was 'temporary' work I wasn't entitled to anything. Applied anyway after a friend pushed me to and got approved.

0 coins

Yeah the staffing agency rep I talked to made it sound like I should just wait for my next assignment and not worry about filing. Starting to think that was not great advice lol

0 coins

EXACTLY. They don't want you to file because it affects their unemployment insurance rates. Always file if you qualify, that's what the system is there for.

To answer the question about the base period wages more specifically: California EDD looks at wages earned in the base period (typically the first 4 of the last 5 completed calendar quarters). If you worked full time for 4 months making decent money, you very likely meet the minimum earnings threshold. The weekly benefit amount is roughly 60-70% of your average weekly wages up to a maximum. For 2025 the max weekly benefit is around $450. File as soon as possible — there's a one week unpaid waiting period but the clock doesn't start until you file.

0 coins

So I shouldn't wait to file even if I think I might get another assignment soon? Should I file now and then just stop certifying if I get placed?

0 coins

File now. You can always stop certifying when you start working again. The waiting week is unpaid and you can't get it waived so every day you delay is potentially a day of benefits lost.

0 coins

This is solid advice. Filing early is always better. If you get placed before your first certification, you just report the income. Don't wait to see what happens.

0 coins

Went through basically this same situation. Assignment ended in January, filed the next day, got approved in about 2.5 weeks. The key on my claim was being really specific in the separation reason — I put 'temporary assignment ended, contract not renewed by client, I remain available for work.' Don't just click through the forms vaguely, be descriptive.

0 coins

That's really helpful specificity. Did EDD ever contact you or ask for more info?

0 coins

Nope, just processed straight through. I think being clear in the separation description helped a lot. They just needed to verify I didn't quit voluntarily.

0 coins

good tip. i was vague on mine and it went to adjudication which added like 5 extra weeks of waiting

0 coins

Also make sure you're set up for the job search requirements from the start. In California you need to do 3 job search activities per week by default. When you certify you'll be asked about this. Keep a log — date, company, contact info, type of activity. EDD can audit your job search at any time and if you can't prove you did the activities they can disqualify you and potentially issue an overpayment notice.

0 coins

Wait they can come back and audit you after the fact? That's kind of terrifying. What counts as a job search activity?

0 coins

Applying to jobs, attending a job fair, submitting a resume, networking in a professional capacity — those all count. CalJOBS registration also counts as one activity in your first week. Just keep records of everything with dates.

0 coins

yeah the audit thing is real, my cousin got an overpayment notice like 8 months later because he couldn't prove his job search activities. Not fun.

0 coins

California EDD typically also registers you with CalJOBS which is the state job bank. You'll probably get a notice about completing your profile there within the first couple weeks of your claim.

0 coins

I'm literally in this exact situation RIGHT NOW except my assignment just ended yesterday and I haven't filed yet. This thread is making me want to file immediately. Do you file through UI Online? Is that the main way?

0 coins

Yes, UI Online at ui.edd.ca.gov is the main way. You can also call to file by phone but honestly the online process is faster and easier. Have your employment info, Social Security number, and last employer (staffing agency) info ready.

0 coins

Okay filing tonight. Super nervous about the suitable work question because my agency already texted me about a new placement.

0 coins

Just be honest on the application. If you haven't accepted or declined yet, you're not in violation of anything. You can address the suitable work question if it actually comes up.

0 coins

can you file if the temp job was like really short, mine was only 6 weeks

0 coins

It depends on how much you earned total. California EDD looks at your entire base period, not just your most recent job. So if you had other work during the base period (roughly the past 12-18 months) that counts too. 6 weeks of full time work alone might not meet the minimum threshold depending on your wages.

0 coins

oh okay i did work before that too so maybe i qualify. gonna try filing

0 coins

Apply anyway and let EDD make the determination. Worst case they tell you you don't qualify and you can ask them to review it. Always worth trying.

0 coins

Can we talk about how the PHONE SYSTEM at EDD is an absolute joke? Even if you know exactly what to do, sometimes you just need to talk to a human being about your specific situation and it's basically impossible. Been waiting 2 hours on hold today trying to reach someone about a totally unrelated issue with my current claim. This is 2025 and getting through to a government agency should not require a full day off work.

0 coins

Seriously, try Claimyr — claimyr.com. I know it sounds weird to use a service just to reach EDD but after 3 days of failed calls it was worth every second. They get you into the callback queue so EDD calls you instead of you sitting on hold.

0 coins

I've heard people mention this before. Does it actually get you a REAL agent or one of those automated things that can't actually help you?

0 coins

Real agent. The EDD calls you back directly, it's not some middleman. Same as if you had been on hold and they picked up, just without the hours of hold music.

0 coins

Fine I'll try it. I'm desperate at this point.

0 coins

Something nobody mentioned — when you certify every two weeks, the dates they ask about cover the week you actually worked or didn't work, not the week you're certifying. A lot of people mess this up their first certification and accidentally report wrong. Read each question carefully.

0 coins

Oh wow I definitely would have confused that. So the questions are asking about work and earnings two weeks ago, not this week?

0 coins

Basically yes. They ask about each individual week in the two-week certification period. Makes sense once you do it once but the first time is confusing.

0 coins

The UI Online interface is actually not that bad once you're in there. Just read every question before answering, don't rush through it.

0 coins

temp jobs ending is like the most common reason people file and somehow california edd still makes it confusing. my whole friend group has done this at some point. just file and see what happens honestly

0 coins

Yeah at this point I'm just going to file and figure it out. Thanks everyone for the info.

0 coins

good luck!! it usually works out. the waiting is the worst part

0 coins

One more thing worth mentioning: the staffing agency may try to protest your claim, meaning they contact EDD to dispute your eligibility. This sometimes happens when agencies claim they had 'suitable work' available that you didn't take. If this happens you'll get a notice from EDD and you'll have a chance to respond. Don't panic if you get one, just respond honestly and on time. Missing the response deadline is worse than anything else.

0 coins

Can they actually do that? Even if the assignment just ran out naturally?

0 coins

Yes they can protest any claim. It doesn't mean they'll win, it just means there will be a fact-finding process. As long as you're honest about why you're unavailable for the placement they offered (if that's the case), you have a reasonable argument.

0 coins

Had this happen to me. Agency protested, I responded within the deadline explaining why the offered placement was unsuitable (way different skill set from my experience), and EDD sided with me. The process took about 3 weeks but I got approved.

0 coins

This is why you DOCUMENT EVERYTHING. Keep texts from the agency, emails, anything in writing. If they claim they offered you suitable work you want receipts showing what they actually offered.

0 coins

does anyone know if you can collect unemployment and do gig work at the same time? asking for a friend lol

0 coins

You can earn some income while collecting benefits. You have to report all earnings when you certify. California EDD uses a formula where they deduct a portion of your earnings from your benefit payment — you don't lose the full benefit dollar for dollar until you earn more than your weekly benefit amount. But gig work can get complicated depending on how you're classified.

0 coins

Just make sure you report everything. Unreported earnings while claiming UI is fraud and EDD does catch it, especially with gig platforms that file 1099s.

0 coins

yeah no of course reporting everything, just wondering if it was even allowed thanks

0 coins

UPDATE: I filed last night! It was actually pretty smooth through UI Online. Took maybe 30 minutes. I put the staffing agency as my employer and explained clearly that the assignment ended because the contract term was complete. Fingers crossed it goes through without adjudication.

0 coins

Nice! I'm filing tonight too after reading all of this. Let us know if you hear back quickly!

0 coins

Good luck! If you filed clean with clear separation details, adjudication usually isn't triggered. You should see movement in your claim status within 1-2 weeks.

0 coins

The waiting week thing is annoying though. Like I understood intellectually that there's an unpaid week but it still stings seeing it on the dashboard lol

0 coins

Everyone feels that way about the waiting week. But once you clear it the payments start coming regularly. The two-week certification cycle becomes routine pretty fast.

0 coins

For OP and anyone else dealing with this — if your claim does go to adjudication, do NOT just wait and hope it resolves itself. That's how people end up waiting 8-10 weeks with no payments. You can check your UI Online inbox for notices requesting information and respond quickly. If there's no notice and it's just sitting, that's when calling EDD actually becomes necessary to find out what's stuck.

0 coins

How do you even know if it went to adjudication versus just processing normally?

0 coins

On UI Online there's a claim status page. If it shows 'pending' with an issue code or 'adjudication in progress,' that means something needs to be resolved. Normal processing just shows pending without the issue indicator.

0 coins

And if you're in adjudication and can't figure out why, that's specifically a case where calling EDD matters. I used Claimyr (claimyr.com) when my claim was stuck — actually got through to an agent who told me exactly what document they needed. Saved me probably weeks of waiting.

0 coins

Good to know. I'll keep an eye on the status page.

0 coins

Also just to be thorough — make sure you register with CalJOBS (caljobs.ca.gov) in your first week if California EDD tells you to. Some claimants get a notice about it, some don't depending on their situation. If you get that notice and ignore it, it can pause your benefits. It's pretty quick to set up, like 20 minutes.

0 coins

I actually got that notice in my UI Online inbox already! Glad you mentioned it because I hadn't done it yet.

0 coins

Do it today if you can! EDD gives you a deadline and missing it creates headaches.

0 coins

yeah caljobs is one of those things nobody warns you about and then people are surprised when their payments stop

0 coins

Three weeks into my claim now from when I started this thread (different situation than OP). Payments finally started coming through after being stuck for two weeks. For anyone following this thread — if your payments stall, don't wait more than 10 days before trying to contact EDD. I learned that lesson the hard way. Ended up using that Claimyr service people were talking about upthread and actually got an agent who fixed a verification issue on my account same day.

0 coins

Glad it worked out for you! This thread has been genuinely helpful, I feel way less panicked than I did this morning.

0 coins

The system is aggravating but it does work eventually. Just stay on top of it and don't let things sit unresolved.

0 coins

good to hear a success story, gives me hope for mine
