Can you collect unemployment after having a baby in California?
So I just had my baby six weeks ago and my situation is kind of complicated. I was working full time at a marketing agency before my due date and had planned to go back after maternity leave, but my employer basically eliminated my position while I was out. They claim it was a 'restructuring' but the timing feels really suspicious. Now I'm sitting here with a newborn trying to figure out if I can even file for unemployment benefits through California EDD. I know there's SDI (state disability insurance) for the pregnancy/birth part and then PFL for bonding time, but my SDI already ended and I'm not sure if I can collect regular UI unemployment now that my job is technically gone. I'm able and available to work, I have childcare lined up actually because my mom is helping, but I have no idea if California EDD will think I'm not 'available' just because I have a newborn. Has anyone gone through this? Can you actually collect unemployment after having a baby when your job disappears during maternity leave? I'm so stressed about this right now.

Yes, you absolutely can file for California EDD unemployment benefits in your situation. What you're describing - having your position eliminated while on maternity leave - is actually a protected situation and you should have a strong claim. The key thing California EDD looks at for regular UI eligibility is whether you were laid off through no fault of your own, and you were. The fact that you have a newborn doesn't automatically disqualify you. What matters is that you certify each week that you are able to work, available for work, and actively looking for work. If your mom is providing childcare and you genuinely are available, you should be fine answering those weekly certification questions honestly.

AuthorThank you, that's reassuring. I was worried they'd automatically deny me because of the baby. So I should just go ahead and file on UI Online?

Yes, file through UI Online as soon as possible. Your benefit year and base period wages will be calculated from before your leave, so you should have enough wages to qualify. Don't delay because there's typically a one week unpaid waiting period and you want your benefits to start as soon as possible.

Same thing happened to my sister actually. She came back from maternity leave and they had 'eliminated her role' too. She filed for California EDD unemployment and got approved no problem. The having a baby part had nothing to do with it - she was just unemployed through no fault of her own. She did have to do the weekly job search requirements though.

AuthorOh good to know your sister went through this! Did she have any issues with the adjudication process or did it go smoothly?

She had a short adjudication period, maybe 2 weeks, but then it cleared and payments started. I think it was because they verified the circumstances of her layoff.

The adjudication hold for job elimination during leave situations is pretty common, California EDD wants to confirm it was a real layoff and not a voluntary quit or something. Usually resolves itself.

I went through almost this exact situation two years ago and want to share what worked for me. When I filed, I made absolutely sure to document that my employer had eliminated my position - I saved every email and the official notice. During adjudication California EDD actually called my former employer. My claim was held for about 3 weeks then approved. One thing that really helped me when I needed to actually TALK to someone at California EDD about my claim status was using a service called Claimyr. I had been trying to get through on the phone for days and kept getting the 'we cannot take your call' message. Claimyr basically holds your place in the phone queue and calls you back when an agent is available. Their site is claimyr.com and there's a video showing how it works at https://youtu.be/JmuwXR7HA10 - for a new mom dealing with a newborn, not having to sit on hold for hours was genuinely a lifesaver.

AuthorOh wow that Claimyr thing sounds incredibly useful right now. I literally cannot sit on hold for 3 hours with a baby who needs feeding every couple hours lol. Will look into this thank you!

claimyr worked for me too when my claim was in adjudication. got a callback within a few hours instead of spending all day redialing

Does Claimyr actually work or is it one of those scammy things? Genuinely asking because I've been trying to reach EDD for two weeks

wait so you can collect unemployment AND PFL at the same time?? I thought they overlapped or something
0 coins
Owen Devar
No, you can't collect PFL (Paid Family Leave) and regular UI unemployment at the same time. They serve different purposes. PFL is for bonding with a new child and is a separate SDI program. Regular unemployment is for when you're unemployed and looking for work. In OP's case, her PFL/SDI period sounds like it has ended and now she's filing for regular UI because her job was eliminated - those are sequential, not overlapping.

ohhhh ok that makes more sense. so sdI first then pfl then if still no job then UI. got it

AuthorYeah I already finished both the SDI pregnancy part and PFL bonding time. Now I'm just regular unemployed with no job to go back to.

THIS IS EXACTLY WHAT HAPPENED TO ME AND I WANT TO WARN YOU. My employer did the same 'restructuring' thing and California EDD flagged my claim because my employer fought it and said I had quit. It went to appeals and took MONTHS. Keep every single piece of documentation. Every email, every text, your official layoff notice, your job description showing your role, everything. If they say you voluntarily quit because you 'didn't return from leave' you need evidence that there was literally no position to return to. I wish someone had told me this earlier.

Brooklyn Knight
AuthorOh no, that's terrifying. My employer sent an email saying my position was being eliminated due to restructuring - is that enough documentation?
0 coins
Vincent Bimbach
That email is GOLD. Save it to multiple places. Screenshot it. Email it to yourself on a personal account. That's exactly the kind of evidence you need if your former employer tries to fight your claim.

This is really good advice. Employer-contested claims do take longer and often go to adjudication or even appeals, but having clear written documentation significantly improves your chances of prevailing.

Also keep notes with dates and times of any phone calls, who you spoke with, what was discussed. It all adds up during an appeal.

I'm a little confused about the job search requirements after having a baby. Like do you have to apply to jobs every week when you have a newborn? That seems really hard. I thought there was like a standby status or something?
0 coins
Owen Devar
For regular California EDD unemployment, yes, you generally need to meet the job search requirements - currently three work search activities per week unless you have an approved exemption. Standby status is different and applies to specific situations like union hiring halls or temporary layoffs expecting recall. OP's situation doesn't really sound like standby. But since she said she has childcare lined up through her mom, she should be able to meet the availability and job search requirements. You just have to honestly certify that you're able and available each week.

Brady Clean
ok gotcha. three activities per week doesn't sound too bad actually

To directly answer the title question for anyone finding this thread: yes you can collect California EDD unemployment after having a baby IF you are able to work, available for work, and actively seeking employment. The baby alone does not disqualify you. What matters is your specific circumstances - were you laid off, did you quit, what childcare situation do you have, etc.

Brooklyn Knight
AuthorThis is such a clear answer thank you. I'm going to file today.

one thing nobody mentioned - make sure your base period wages are enough to qualify. if you were on unpaid maternity leave for a while some of those quarters might show low or zero wages which can affect your weekly benefit amount calculation
0 coins
Owen Devar
Great point. California EDD calculates your weekly benefit amount based on wages in your base period, which is typically the first four of the last five completed calendar quarters before you filed. If you were on unpaid leave during part of that time, your benefit amount might be lower than expected. But SDI wage replacement during pregnancy leave does not count as wages for UI purposes. You might want to call EDD to get a benefit estimate before filing so you're not surprised.
0 coins
Brooklyn Knight
AuthorI was on SDI for about 4 months, so that's good to know. I'll try to get an estimate. Though with a newborn I guess calling EDD is going to be a whole ordeal...

seriously try Claimyr for that, claimyr.com - I mentioned it above but getting a callback instead of sitting on hold is so much better especially with a baby in the house needing your attention constantly

Not to be that person but I had a completely different experience. I had a baby, my job ended, I filed for UI and California EDD denied me saying I wasn't available for work because I had an infant and 'no confirmed childcare.' I had to appeal and it took forever. So just be prepared that even if you think you qualify it might not be smooth.
0 coins
Brooklyn Knight
AuthorUgh, that's really discouraging. When they denied you did they ask for proof of childcare?
0 coins
Norah Quay
During the appeal I had to basically prove I had reliable childcare. A written statement from my mom saying she was available to watch the baby was part of what helped turn it around. So get something in writing from your mom just in case.
0 coins
Owen Devar
This is actually really valuable experience to share. If your childcare arrangement is a family member, having a simple written statement confirming their availability can head off a lot of potential issues.

Brooklyn Knight
AuthorI would never have thought of that. Getting a statement from my mom right now. Thank you so much for sharing this even though it was a rough experience.

I remember reading somewhere that California has special protections for people who lose their jobs during pregnancy or maternity leave specifically. Like it's considered discrimination or something. Has anyone looked into whether you could also have a claim against the employer separate from just unemployment?
0 coins
Sophie Footman
Yes, California FEHA prohibits pregnancy discrimination and CFRA protects job reinstatement rights after leave. If your position was eliminated while you were on protected leave it's worth consulting with an employment attorney because you might have both a UI claim and potentially a wrongful termination/discrimination claim. Many employment attorneys offer free consultations.

Daniel Rivera
yeah I thought so. OP should definitely look into that angle too
0 coins
Brooklyn Knight
AuthorI hadn't even thought about that angle. I'm definitely going to look into a free consultation. Right now I'm focused on getting the UI filed but that's worth exploring.

does the baby's SDI or anything like that count against your unemployment or affect the benefit amount at all lol I'm so confused by all these California programs
0 coins
Sophie Footman
The baby doesn't have any SDI - SDI and PFL are your benefits as the parent/worker, not the baby's. And no, having collected SDI or PFL previously does not reduce your regular UI unemployment benefit amount. They're separate programs funded differently. Your UI benefit amount is based purely on your wages in the base period.

Skylar Neal
ok I clearly had no idea how any of this worked thanks for being patient with my dumb question
0 coins
Brady Clean
not dumb at all these programs are genuinely confusing especially when you're dealing with them for the first time
0 coins
Vincent Bimbach
Also just want to say - the 'able and available' requirement is the thing California EDD scrutinizes most in situations like yours. When you certify each week they literally ask 'were you able to work all days in the week' and 'were you available to accept work if offered.' If you answer no to those because of baby stuff, they can stop your benefits. So make sure your childcare is genuinely reliable before you certify yes to those questions each week.
0 coins
Brooklyn Knight
AuthorThat's really clear, thank you. My mom is genuinely committed to helping and lives five minutes away so I feel okay answering yes honestly.

Then you should be in good shape. Just make sure to do your three job search activities each week and document them in case you ever get audited.

For what it's worth when I was going through my claim after maternity leave I found that calling California EDD directly to ask questions before I even filed helped me understand exactly what to expect. The agents are actually helpful when you can reach them - the problem is just REACHING them. That's where Claimyr saved me again honestly. I used claimyr.com when I had pre-filing questions and got through to an agent who walked me through the whole process. There's a demo video at https://youtu.be/JmuwXR7HA10 if you want to see how it works before trying it.

One more practical note: when you file your initial claim on UI Online, be very specific and factual about how your employment ended. Don't say anything vague. Say clearly that your position was eliminated due to employer restructuring while you were on approved maternity leave and that you were notified by email on [specific date]. The clearer your separation reason, the less likely you are to get a confusing adjudication hold.
0 coins
Brooklyn Knight
AuthorThis is super actionable advice. I'll be very precise with the wording. I have the email with the exact date so I'll use that.

Sophie Footman
Perfect. Exact dates and specific language matching what your employer told you in writing is the gold standard for avoiding unnecessary delays.

Agree 100%. Vague separation reasons are what trigger most adjudication holds in my experience.

random question - if EDD approves you and then you find a part time job while still looking for full time, do you have to report that income? like does having a baby and only being able to do part time work affect things
0 coins
Owen Devar
Yes, absolutely report all part-time earnings when you certify each week. California EDD has a partial benefits formula - you can earn up to 25% of your weekly benefit amount without any reduction, and earnings above that reduce your benefit dollar for dollar. Not reporting earnings is considered fraud and can result in disqualification and repayment demands. As for only being able to do part time because of baby - if you're only available for part-time work you need to disclose that limitation because it affects your availability certification.
0 coins
Brady Clean
ok good to know. I was wondering if people just don't report small amounts and that seems like a really bad idea actually
0 coins
Sophie Footman
Yeah seriously don't do that. California EDD cross-checks with employer payroll records and the EDD data match catches unreported wages constantly. It's never worth it.

Checking back - OP you mentioned you filed this morning. Make sure you set a reminder for when your first certification is due. A lot of people miss their first certification window because they don't realize it opens up after a specific period and has a specific deadline. If you miss it you can potentially lose that week's benefits.
0 coins
Brooklyn Knight
AuthorOh good reminder! I set an alert in my phone for next week. UI Online also shows when the next certification opens I think?

Yes it shows on your dashboard. Also sign up for the email notifications so you get reminders directly.

The certification period opens on Sundays for the two-week period that just ended. You have until midnight Saturday to complete it. Missing a certification is one of the most common mistakes new claimants make.

AuthorI absolutely will update! It's been 5 days since I filed and my status just shows 'pending' on UI Online. I did get a letter saying they may contact my former employer to verify separation details. Fingers crossed they don't try to fight it.

Pending with employer contact is totally normal. Usually resolves within 2-3 weeks if the employer confirms the layoff. The email you saved is your safety net if they try anything.

If it gets stuck or you need to talk to someone about it, seriously use Claimyr - claimyr.com - to get through to an EDD agent. Way easier than trying to get through the regular phone system and helpful for checking on pending claim status when you need a human to explain what's happening.
