EDD overpayment when switching from UI to SDI - disqualified for 2 weeks, need advice!
I was on unemployment and got hurt, so I told them I couldn't work. They paid me anyway, but when I tried to switch to disability, they said I was disqualified for 2 weeks because of overpayment. Now I'm stuck and don't know what to do. Has anyone else dealt with this? Any advice on how to handle the EDD and this overpayment issue?

Ugh, the EDD is such a mess. I had a similar situation last year. Here's what I did: 1. Gathered all my documents (medical records, unemployment certifications, etc.) 2. Called EDD and explained the situation calmly 3. Asked about a waiver for the overpayment 4. Filed an appeal when they initially denied it It took a few months, but I eventually got it sorted out. Stay persistent!

•How long did the appeal process take? I'm in a similar boat and wondering if I should bother 🤔

•It took about 3 months from filing to decision. Definitely worth it tho, saved me like $2k!

•Did you use a lawyer for the appeal or did it yourself?

I found a way to actually get someone on the phone at EDD. I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/1X-mEsLtbmQ

•I was skeptical too, but I tried it and it worked. Saved me hours of frustration. They have good reviews online too

•$20 to actually talk to a human? might be worth it at this point lol

have you tried contacting your local assemblymember? They can sometimes help push things through with EDD faster

•I hadn't thought of that. How do I find out who my assemblymember is?

•Just google '[your city] california assemblymember' and it should come up. Most have forms on their websites for constituent services

This happened to me too! I ended up having to pay back the overpayment 😭 but they let me do a payment plan. Make sure you ask about that if they won't waive it

The whole system is broken. We need a complete overhaul of unemployment and disability in this state. Anyone know if there are any bills in the works to fix this mess?

•There's AB 123 that's supposed to modernize the UI system, but who knows when it'll actually pass 🤷♂️

Pro tip: ALWAYS appeal. Like 40% of appeals get approved just because EDD doesn't show up to the hearing. Worth a shot!

idk if this helps but when I had an overpayment issue I wrote a hardship letter explaining why I couldn't pay it back. They ended up waiving half of it. Worth a try maybe?
