West Virginia UCC search showing weird results - need help understanding what I'm seeing

Been trying to run searches on the WV Secretary of State portal for existing liens before we file our UCC-1. The search results are confusing me - some show as 'Active' but when I click through the filing details don't match what I expected. Is there a trick to reading these results properly? I'm seeing continuation filings that reference original UCC-1s I can't locate, and some debtor names that seem like they should match but the system says no results found. This is for a equipment financing deal and I really need to make sure we're not missing any prior liens. Anyone else had issues with the WV search functionality?

WV portal can be tricky with exact name matching. Are you searching with and without middle initials? The system is really picky about punctuation too - try removing commas and periods from business names.

Good point about punctuation. I was including the LLC designation exactly as it appears on the articles but maybe I should try variations.

Yeah definitely try with/without the entity type. I've seen filings under 'ABC Company' and 'ABC Company LLC' show up as completely separate results.

The continuation thing is weird but not uncommon. Sometimes the original UCC-1 was filed years ago and might be in their legacy system. Have you tried expanding your date range in the search?

Possibly. WV migrated systems a few years back and some older records might not have transferred cleanly. You might need to call their office directly for pre-2018 filings.

For equipment financing you definitely want to be thorough. Are you searching both individual and business names if there's a personal guarantee involved? Sometimes liens get filed against the principal instead of or in addition to the business entity.

The missing UCC-1 for those continuation filings could be a red flag. If someone filed a continuation on a lapsed or terminated filing, that continuation might be invalid. You'll want to track down the original filing status before assuming those liens are still active.

How would I verify if the original was properly continued? The continuation shows as active but if the underlying UCC-1 lapsed wouldn't that make it invalid?

Exactly right. A continuation on a lapsed filing is worthless. You need to trace the chain from original filing through each continuation to make sure there were no gaps in coverage.

Just dealt with this same issue in WV last week. Turns out their search algorithm doesn't handle apostrophes well - if the business name has an apostrophe try searching both with and without it.

Also watch out for '&' vs 'and' in business names. WV treats them as completely different entities even though they're obviously the same company.
