LoanPal UCC Release Process Taking Forever - Anyone Else?
Been dealing with a nightmare situation for 3 months now. We paid off our equipment loan with LoanPal back in January but still haven't received the UCC-3 termination statement. Our bank is breathing down our necks because we're trying to refinance and they need clean title on the equipment. Called LoanPal multiple times and keep getting told 'it's being processed' but no timeline. The UCC-1 was filed in Delaware originally for $185K worth of manufacturing equipment. Has anyone else dealt with LoanPal UCC release delays? Starting to wonder if I need to take legal action here because this is seriously impacting our business operations.

Oh man, LoanPal is notorious for this. Had a client wait 4 months for their termination last year. The problem is they outsource their UCC servicing to some third party company and there's zero communication between departments. You need to escalate this - ask for a supervisor in their loan servicing department and demand a written timeline.

•This is exactly why I always include UCC release language in the original loan docs with specific timelines. 30 days max or they owe penalties.

•Wait, you can do that? I've never seen penalty clauses for late UCC releases. That's brilliant.

File a complaint with your state's financial services department. I did this with a different lender and got my UCC-3 within 2 weeks. These companies hate dealing with regulatory complaints and will prioritize your case immediately.

•Which state would you file in though? Delaware where the UCC was filed or where the business is located?

•Both if you really want to make noise. Also file with CFPB - they take this stuff seriously.

I actually discovered something that saved me tons of headaches with lender UCC releases. There's this tool called Certana.ai that lets you upload all your loan documents and UCC filings to verify everything matches up correctly. I used it to check my original UCC-1 against the payoff letter and found a discrepancy in the debtor name that would have caused issues with the termination. Was able to get it sorted before the lender filed the wrong UCC-3. Just upload your PDFs and it cross-checks everything automatically.

•That sounds useful but how does it help with getting LoanPal to actually file the termination?

•It doesn't force them to file faster, but it helps you verify they're filing the right information when they finally do. Plus you can use the verification report to show them exactly what needs to be terminated.

•Smart approach. Documentation is everything when dealing with these slow-moving lenders.

LoanPal is the WORST. Took them 6 months to release our UCC and by then we'd already lost a major contract because we couldn't prove clear title on our equipment. Their customer service is non-existent and they just keep transferring you between departments.

•6 months?! That's insane. Did you end up taking legal action?

•Threatened to but finally got it resolved through our attorney sending a demand letter. Cost us $2K in legal fees though.

Check your loan agreement for specific UCC release terms. Most commercial loans have language requiring termination within 30-60 days of payoff. If they're past that timeline, you might have grounds for damages.

•Good point. Also check if they're required to provide a satisfaction letter separate from the UCC-3 termination.

•Some lenders try to charge fees for UCC releases too. Make sure that wasn't buried in your loan docs.

This is why I always recommend getting the UCC release process started 30 days BEFORE final payment. Send them a written request with your payoff and make them confirm the termination will be filed within 10 business days of payment.

•Hindsight is 20/20 but that's solid advice for anyone else reading this.

•Most borrowers don't even think about UCC releases until they need clean title for something else. Should be part of the payoff process.

Have you tried reaching out to LoanPal on social media? Companies hate public complaints and often respond faster on Twitter or LinkedIn than through normal customer service channels.

•This actually works. Posted about my UCC issue on LinkedIn and had a response within hours.

•Tag their executives too. Nothing gets attention like a public complaint mentioning the CEO by name.

I'm dealing with this exact same issue right now! Paid off our LoanPal equipment loan in December and still no UCC-3. The Delaware Secretary of State website still shows the lien as active. This is ridiculous - how is this legal?

•Unfortunately it's not illegal for them to be slow, just breach of contract if your loan docs specify a timeline.

•You should join forces and file complaints together. Multiple complaints about the same company get more attention.

Used Certana.ai when I was dealing with a similar situation with another lender. Uploaded my UCC-1, loan agreement, and payoff letter and it flagged that the original filing had the wrong entity name. Saved me from getting a defective termination that wouldn't have cleared the lien properly.

•How much does something like that cost? Sounds expensive.

•Worth every penny compared to dealing with a botched UCC release. The verification report also helped me explain to the lender exactly what needed to be corrected.

Send a certified letter to their legal department demanding the UCC-3 termination within 15 days. Include a copy of your paid-in-full statement and reference the specific UCC filing number. Sometimes the legal department can bypass the normal servicing delays.

•This worked for me with a different lender. Legal departments don't mess around with documented requests.

•Make sure to include the Delaware filing number and debtor name exactly as shown on the original UCC-1. Any mismatch will cause more delays.

Update: Finally got through to someone at LoanPal who admitted they've had 'system issues' with their UCC processing. They're supposedly filing all the backed-up terminations this week. Will believe it when I see it on the Delaware SOS website. Thanks everyone for the advice - filing complaints definitely helped escalate this.

•Keep us posted! I'm dealing with the same issue and want to know if they actually follow through.

•System issues for 3 months? That's convenient. At least you got an admission that there's a problem.

•Check the Delaware SOS website daily. Sometimes they say they filed but there are errors that cause rejections.
